Department of Defense September 2009 – Federal Register Recent Federal Regulation Documents

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR) Secretariat will be submitting to the Office of Management and Budget (OMB) a request to review and approve an extension of a previously approved information collection requirement concerning bid guarantees, performance and payment bonds, and alternative payment protections. A request for public comments was published at 74 FR 27024, June 5, 2009. No comments were received.

Under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35), the Federal Acquisition Regulation (FAR) Secretariat will be submitting to the Office of Management and Budget (OMB) a request to review and approve a new information collection requirement regarding HUBZone Program revisions.

The Department of the Army announces the availability of an FEIS for the implementation of the decision to increase numbers and types of aviation assets and training at Fort Wainwright, Fort Richardson, or other military installations in Alaska. The proposed aviation unit, an Aviation Task Force or Combat Aviation Brigade, would potentially consist of up to 62 medium and heavy lift helicopters, 30 combat scout helicopters, 24 attack helicopters, and between 1,200 to 2,850 Soldiers.

The Department of the Army announces the availability of the DEIS, which evaluates the potential environmental and socioeconomic impacts of BRAC actions at Fort Monroe, Virginia.

The Department of the Navy (DON), after carefully weighing the operational and environmental consequences of the proposed action, announces its decision to deepen approximately five miles of Norfolk Harbor Channel, the Federal navigational channel in the Southern Branch of the Elizabeth River, separating Norfolk and Portsmouth, Virginia. Dredging in the heavily-used waterway would occur from the Lamberts Point Deperming Station in the Lamberts Bend Reach, south to Naval Support Activity Norfolk Naval Shipyard, commonly referred to as the Norfolk Naval Shipyard (NNSY), in the Lower Reach. Dredged material would be placed at The U.S. Army Corps of Engineers' (USACE) Craney Island Dredged Material Management Area (CIDMMA). The deepening project will establish continuously safe and expeditious transit routes for U.S. Naval Ships to Lamberts Point Deperming Station and NNSY. Dredging would occur completely within the existing USACE-maintained federal navigation channel. In its decision, the Navy considered applicable executive orders, including an analysis of the effects of its actions in compliance with the Endangered Species Act, the Coastal Zone Management Act, and the National Historic Preservation Act, and the

Pursuant to the Federal Advisory Committee Act of 1972 (5 U.S.C., Appendix as amended), the Sunshine in the Government Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.150, and in accordance with section 10(a)(2) of Public Law, DoD announces that the DoD Task Force on the Prevention of Suicide by Members of the Armed Forces, a subcommittee of the Defense Health Board (DHB), will meet on October 8, 2009.

Under the provisions of the Federal Advisory Committee Act of 1972 (5 U.S.C., Appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. paragraph 552b, as amended), and 41 CFR 102- 3.150, the Department of Defense announces that the U.S. Nuclear Command and Control System Comprehensive Review Advisory Committee will meet to review and discuss contents of its Final Report. The meeting is closed to the public.

The Defense Finance and Accounting Service is deleting a system of records notice from its existing inventory of records systems subject to the Privacy Act of 1974 (5 U.S.C. 552a), as amended.

Under the provisions of the Federal Advisory Committee Act of 1972 (5 U.S.C., Appendix, as amended), the Government in the Sunshine Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.150, the Department of Defense announces that the United States Air Force Scientific Advisory Board (SAB) meeting will take place on Wednesday and Thursday, October 7th-October 8th, 2009 at the SAF/AQ Conference and Innovation Center, 1560 Wilson Blvd., Arlington, VA 22209. The meeting on Wednesday, October 7th, will be from 8 a.m.-4:30 p.m., and the meeting on Thursday, October 8th, will be from 7:45 a.m.-12:15 p.m.

Pursuant to Section 102(2)(C) of the National Environmental Policy Act of 1969, as implemented by the Council on Environmental Quality Regulations (40 Code of Federal Regulations [CFR] Parts 1500-1508), the U.S. Department of the Navy (Navy) has prepared and filed with the U.S. Environmental Protection Agency a Draft Supplemental Environmental Impact Statement (Draft SEIS) to evaluate potential environmental effects of significant new circumstances and information not available at the time the Final Environmental Impact Statement for Renewal of Authorization to Use Pinecastle Range, Ocala National Forest, Florida, (January 2002) (2002 FEIS) was completed.

The U.S. Army Corps of Engineers (USACE) intends to prepare a supplemental environmental impact statement (EIS) for the Louisiana Coastal Area (LCA)Louisiana, Modification of Davis Pond Diversion Project. This modification project will be designed to increase wetland restoration outputs. This supplemental EIS will be tiered off of the programmatic final EIS for the Louisiana Coastal Area (LCA)Louisiana, Ecosystem Restoration Study, November 2004, and the final EIS for the LCALouisiana, Freshwater Diversion to Barataria and Breton Sound Basins Study, September 1984. The record of decision (ROD) for the programmatic final EIS was signed on November 18, 2005 and the ROD for the freshwater diversion final EIS was signed on July 16, 1987.

The notice of an open meeting scheduled for Sep 15, 2009 published in the Federal Register on August 31, 2009 (74 FR 44828) has a revised classification and agenda. The survivability and deployability study of ground platforms session (1230-1330) will be a classified session at the Secret clearance level. A second unclassified session (1345-1430) has been added to adopt recommendations from the ASB Installation 2025 study. The meeting will now be adjourned at 1445 EDT.

The Department of the Army announces the availability of the ROD that implements MCOE actions at Fort Benning including construction, operation and maintenance of proposed operational facilities, training areas (including ranges and maneuver areas), and infrastructure to accommodate the consolidated Armor and Infantry missions of the MCOE and the increase in military personnel and students due to Army growth.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to establish procedures for contracting officers to provide contractor information into the Past Performance Information System (PPIRS). This case sets forth requirements for reporting defective cost or pricing data and terminations for cause or default. Evaluation of past performance information, especially terminations, manages risks associated with timely, effective and cost efficient completion of contracts, a key objective of the President's March 4, 2009, Memorandum on Government Contracting.
