DoD has issued an interim rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) to implement Section 807 of the National Defense Authorization Act for Fiscal Year 2007. Section 807 places limitations on contractors acting as lead system integrators in the acquisition of major DoD systems. Such contractors may have no direct financial interest in the development or construction of any individual system or element of any system of systems unless an exception applies.

Under the provisions of the Federal Advisory Committee Act of 1972, (5 U.S.C. Appendix, as amended), the Sunshine in the Government Act of 1976 (5 U.S.C. 552b, as amended), and 41 CFR 102-3.65, the Department of Defense gives notice that it is renewing the charter for the Department of Defense Education Benefits Board of Actuaries (hereafter referred to as the Board). The Board, pursuant to 10 U.S.C. 2006(e), is a non-discretionary Federal advisory committee established to: (1) Annually advise the Secretary of Defense on the actuarial status of the Department of Defense Education Benefits Fund (hereafter referred to as the Fund); (2) shall furnish its advice and opinion on matters referred to it by the Secretary; review valuations of the Fund conducted under the provisions of 10 U.S.C., Sec. 2006(f); (3) report to the Secretary of Defense annually on the actuarial status of the Fund; and (4) recommend to the President and Congress such changes as, in the Board's judgment, are necessary to protect the public interest and maintain the Fund on a sound actuarial basis. The Board shall be composed of not more than three members appointed by the Secretary of Defense from among qualified professional actuaries who are members of the Society of Actuaries. The members shall serve for a term of 15 years, except that a member of the Board appointed to fill a vacancy occurring before the end of the term for which the predecessor was appointed shall serve only until the end of such term. A member may serve after the end of the term until a successor has taken office. A member of the Board may be removed by the Secretary of Defense for misconduct or failure to perform functions vested in the Board, and for no other reason. Members may not be reappointed for successive terms. The Chairperson of the Board shall be designated by the Under Secretary of Defense (Personnel and Readiness), on behalf of the Secretary of Defense, for a five-year term. Board Members appointed by the Secretary of Defense, who are not Federal officers or employees, shall serve as Special Government Employees under the authority of 5 U.S.C. 3109, and shall, under the authority of 10 U.S.C. 2006(e)(1)(C), serve with compensation, to include travel and per diem for official travel. The Board shall meet at the call of the Designated Federal Officer, in consultation with the Chairperson, the Secretary of Defense or the Under Secretary of Defense (Personnel & Readiness). The Designated Federal Officer shall be a full-time or permanent part-time DoD employee, and shall be appointed in accordance with established DoD policies and procedures. The Designated Federal Officer or Alternate Designated Federal Officer shall attend all Board meetings and subcommittee meetings. The Board is authorized to establish subcommittees and workgroups, as necessary and consistent with its mission. Board subcommittees and workgroups shall operate under the provisions of Federal Advisory Committee Act of 1972, the Sunshine in the Government Act of 1976, and other appropriate Federal regulations. Board subcommittees and workgroups shall not work independently of the Board and shall report all their recommendations and advice to the Board for full deliberation and discussion. Board subcommittees and workgroups have no authority to make decisions on behalf of the Board and may not report directly to the Department of Defense or any Federal officers or employees who are not members of the Board. Pursuant to the Federal Advisory Committee Act of 1972 and 41 CFR 102-3.140(c), members of the public or interested groups may submit written statements to the members of the Board. Written statements may be submitted at any time to the Board's Designated Federal Officer or in response to the stated agenda of a planned meeting. The Department of the Navy announces its decision to extend Kilo Wharf by 400 feet (122 meters) to the west at Apra Harbor Naval Complex, Guam, Mariana Islands. The project includes dredging of reef flat and other marine habitats, construction of an additional mooring island, and improvements to the existing wharf. Improvements to the existing wharf include upgrades to the primary and secondary electrical power supply; upgraded lightning protection and grounding system; new electrical substation building, perimeter fencing, and floodlighting system; and seismic upgrades.

Notice of Availability of the Record of Decision for Army Growth and Force Structure Realignment

The Department of the Army announces the availability of the Record of Decision (ROD) for Army Growth and Force Structure Realignment. This ROD announces the Army's decisions for growing and realigning U.S. Army forces within the Continental United States (CONUS). Pursuant to the National Environmental Policy Act (NEPA), the Department of the Army prepared a Programmatic Environmental Impact Statement (PEIS) that evaluated the potential environmental and socio- economic effects associated with alternatives for Army growth and realignment. In the Final PEIS, which was published on 26 OCT, 2007, the Army identified Alternative Three as the preferred alternative. The Record of Decision explains that the Army will proceed with its preferred alternative, Alternative Three. This alternative best supports Army Modular Transformation; implements Global Defense Posture Realignment (GDPR) decisions; adds the necessary Combat Support and Combat Service Support Soldiers to the Active and Reserve components of the Army; and grows the Army by six Active component Brigade Combat Teams (BCTs) and fifteen Active and Reserve component support brigades. Each of the BCTs will be Infantry BCTs. In addition, the PEIS analysis was used to relocate a Maneuver Enhancement Brigade (MEB) headquarters and two Heavy Brigade Combat Teams (HBCTs). The HBCTs will be activated in Germany and retained until FY12 and FY13 before returning to the United States. A return of these BCTs to the United States is not a part of previous decisions to implement Base Realignment and Closure (BRAC) 2005. This decision and analysis within this PEIS do not include BRAC 2005 stationing actions, which are considered part of the baseline condition for analysis. This decision will result in a total growth in Army forces by approximately 74,200 Soldiers, and will realign forces to improve readiness and responsiveness to meet future challenges.

At this meeting, the Board will discuss interim finding and recommendations resulting from ongoing Task Force activities. The Board will also discuss plans for future consideration of scientific and technical aspects of specific strategies, tactics, and policies as they may affect the U.S. national defense posture and homeland security. In accordance with section 10(d) of the Federal Advisory Committee Act, Public Law 92-463, as amended (5 U.S.C. App. 2) and 41 CFR 102- 3.155, the Department of Defense has determined that these Defense Science Board Quarterly meeting will be closed to the public. Intent to Prepare an Environmental Impact Statement for Power Upgrades Project Within the Fort Meade Complex, MD

The National Security Agency (NSA) announces that it intends to prepare an Environmental Impact Statement (EIS) as part of the environmental planning process for power and utility upgrades at Fort George G. Meade, Maryland (hereafter referred to as Fort Meade). The project was initiated to address aging infrastructure reliability issues as well as meet mission growth requirements. The Proposed Action includes the construction of generator facilities, two electrical substations, a boiler plant and chiller plant, as well as ancillary facilities and parking. The proposed utility upgrades would allow for 100 percent self-contained redundancy, should off site power sources fail. Publication of this notice begins a scoping process that identifies and determines the scope of environmental issues to be addressed in the EIS. This notice requests public participation in the scoping process and provides information on how to participate.
