In accordance with the Oil Pollution Act of 1990 (OPA), the National Environmental Policy Act (NEPA), and a Consent Decree with BP Exploration & Production Inc. (BP),\1\ the Deepwater Horizon Federal natural resource trustee agencies for the Louisiana Trustee Implementation Group (Louisiana TIG) have prepared a Draft Phase II Restoration Plan 3.3 and Environmental Assessment (Draft RP/EA #3.3). The Draft RP/EA #3.3 describes and proposes restoration project alternatives considered by the Louisiana TIG to restore natural resources and ecological services injured or lost as a result of the Deepwater Horizon oil spill. The Louisiana TIG evaluated these alternatives under criteria set forth in the OPA natural resource damage assessment regulations, and also evaluated the environmental consequences of the restoration alternatives in accordance with NEPA. NMFS is correcting a final rule published on October 2, 2019, that revised the subsistence use regulations for the Eastern Pacific stock of northern fur seals (Callorhinus ursinus). NMFS also is announcing approval by the Office of Management and Budget (OMB) of collection-of-information requirements subject to the Paperwork Reduction Act (PRA) and associated with the regulations revised in the final rule. The final rule incorrectly stated that the collection-of- information requirements subject to the PRA had been approved by the OMB at the time the final rule was published. On January 7, 2020, OMB approved the collection-of-information requirements subject to the PRA. The intent of this final rule is to correct this information and to inform the public of the effectiveness of the collection-of-information requirements associated with the subsistence use regulations revised in the October 2, 2019, final rule.

This final rule will clarify a regulation adopted under the Magnuson-Stevens Fishery Conservation and Management Act (MSA), which cross-references and incorrectly interprets regulations adopted under the National Marine Sanctuaries Act. The Monitor National Marine Sanctuary (Sanctuary) regulations currently prohibit some, but not all, fishing in the Sanctuary. NMFS is clarifying its regulation which incorrectly interprets Sanctuary regulations to prohibit all fishing in the Sanctuary by removing the fishing prohibition text and cross- referencing regulations for national marine sanctuaries.

This period is the same as the 2020 commercial halibut fishery opening dates adopted by the International Pacific Halibut Commission. NMFS is publishing its draft 2020 List of Foreign Fisheries (LOFF), as required by the regulations implementing the Fish and Fish Product Import Provisions of the Marine Mammal Protection Act (MMPA). The draft 2020 LOFF reflects new information received from nations submitting their 2019 Progress Reports on interactions between commercial fisheries exporting fish and fish products to the United States and marine mammals, and updates the 2017 LOFF. NMFS classified each commercial fishery in this draft 2020 LOFF into one of two categories, either ``export'' or ``exempt,'' based upon frequency and likelihood of incidental mortality and serious injury of marine mammals likely to occur incidental to each fishery. The classification of a fishery on the draft 2020 LOFF determines which regulatory requirements will be applicable to that fishery for it to receive a comparability finding necessary to export fish and fish products to the United States from that fishery.

NMFS is closing the commercial fishery for the aggregated large coastal sharks (LCS) and hammerhead shark management groups in the western Gulf of Mexico sub-region. This action is necessary because the commercial landings of sharks in the aggregated LCS management group in the western Gulf of Mexico sub-region for the 2020 fishing season are projected to reach 80 percent of the available commercial quota, and are projected to reach 100 percent of the quota by the end of the fishing season, and the aggregated LCS and hammerhead shark management groups are quota-linked under the regulations. This closure will affect anyone commercially fishing for sharks in the western Gulf of Mexico sub-region.

Therefore, NMFS re-opens the commercial longline component for golden tilefish in the South Atlantic EEZ for 9 days to allow the commercial longline ACL to be caught while minimizing the risk of the commercial ACL being exceeded.

This Notice announces a decision by the National Geodetic Survey (NGS) to supersede the American Samoa Vertical Datum of 2002 (ASVD 02) and revert back to Local Tidal (LT) as the official civilian vertical datum for surveying and mapping activities for the island of Tutuila, American Samoa. As a member of the Federal Geographic Data Committee, NOAA is responsible for defining, maintaining and providing access to the National Spatial Reference System. Within NOAA, the National Geodetic Survey has the responsibility to accomplish this task. Due to geophysical activity, the ASVD 02 vertical datum is destroyed. To provide for vertical control, it is necessary to revert to heights based on a LT datum. To the extent it is legally allowable and feasible, all surveys performed or financed by the Federal agencies using or producing vertical height information will undertake an orderly transition to LT tied to the tide gauge at Pago Pago. Exceptions are for those with specific military related applications, which will use their own datum.

NMFS announces the 2020 recreational fishing season for the Federal charter vessel/headboat (for-hire) component for red snapper in the exclusive economic zone (EEZ) of the Gulf of Mexico (Gulf) through this temporary rule. The red snapper recreational for-hire component in the Gulf EEZ opens on June 1, 2020, and will close at 12:01 a.m., local time, on August 2, 2020. This closure is necessary to prevent the Federal for-hire component from exceeding its quota and to prevent overfishing of the Gulf red snapper resource.

NMFS announces final 2020 and 2021 harvest specifications, apportionments, and Pacific halibut prohibited species catch limits for the groundfish fishery of the Gulf of Alaska (GOA). This action is necessary to establish harvest limits for groundfish during the remainder of the 2020 and the start of the 2021 fishing years and to accomplish the goals and objectives of the Fishery Management Plan for Groundfish of the Gulf of Alaska. The 2020 harvest specifications supersede those previously set in the final 2019 and 2020 harvest specifications, and the 2021 harvest specifications will be superseded in early 2021 when the final 2021 and 2022 harvest specifications are published. The intended effect of this action is to conserve and manage the groundfish resources in the GOA in accordance with the Magnuson- Stevens Fishery Conservation and Management Act.
