NMFS has received a request from BNSF Railway (BNSF) for authorization to take marine mammals incidental to a Railway Bridge Heavy Maintenance Project in King County, Washington. Pursuant to the Marine Mammal Protection Act (MMPA), NMFS is requesting comments on its proposal to issue two consecutive incidental harassment authorization (IHAs) to incidentally take marine mammals during the specified activities. NMFS is also requesting comments on possible one-time, one- year renewals for each IHA that could be issued under certain circumstances and if all requirements are met, as described in Request for Public Comments at the end of this notification. NMFS will consider public comments prior to making any final decision on the issuance of the requested MMPA authorizations and agency responses will be summarized in the final notice of our decision.

Pacific Island Fisheries; Garapan Fishing Base Shoreline Revetment
NMFS announces the availability of a draft environmental assessment (EA) evaluating the potential effects of constructing a rock revetment along Garapan Fishing Base, Saipan, Commonwealth of the Northern Mariana Islands (CNMI). Garapan Fishing Base supports sustainable fishing infrastructure including a boat ramp, trailer parking, and other community activities such as shore fishing, community markets and recreation. Stabilizing the shoreline would protect public land and infrastructure and reduce erosion resulting in improved water quality in Saipan Lagoon along shore.

East Coast Fisheries of the United States; Request for Comments
Several fishery management bodies on the East Coast of the U.S. are convening three public webinars to continue work on an initiative called East Coast Climate Change Scenario Planning. This is a joint effort of the Atlantic States Marine Fisheries Commission (ASMFC), the New England Fishery Management Council (NEFMC), the Mid- Atlantic Fishery Management Council (MAFMC), the South Atlantic Fishery Management Council (SAFMC), and NOAA Fisheries. The focus of the webinars will be to explore the key drivers of change that could shape East Coast fisheries over the next 20 years. There will be opportunity for questions and engagement from the public as well as a brief update on this multi-year initiative.

Coastal Nonpoint Pollution Control Program: Proposal To Find That Louisiana Has Satisfied All Conditions of Approval Placed on Its Coastal Nonpoint Pollution Control Program
The National Oceanic and Atmospheric Administration (NOAA) and the U.S. Environmental Protection Agency (EPA) (hereafter, ``the agencies'') invite public comment on the agencies' proposed finding that Louisiana has satisfied all conditions the agencies established as part of their 1998 approval of the State's coastal nonpoint pollution control program (coastal nonpoint program). The Coastal Zone Act Reauthorization Amendments (CZARA) direct states and territories with coastal zone management programs previously approved under Section 306 of the Coastal Zone Management Act to develop and implement coastal nonpoint programs, which must be submitted to the Federal agencies for approval. Prior to making such a finding, NOAA and the EPA invite public input on the Federal agencies' rationale for this proposed finding.

Final Management Plan for the Kachemak Bay National Estuarine Research Reserve
Notice is hereby given that the Office for Coastal Management, National Ocean Service, National Oceanic and Atmospheric Administration, U.S. Department of Commerce approves the revised management plan for the Kachemak Bay National Estuarine Research Reserve in Alaska. In accordance with applicable Federal regulations, the University of AlaskaAnchorage's Alaska Center for Conservation Science revised the reserve's management plan, which replaces the plan previously approved in 2012.

We are finalizing specifications for the 2022 Atlantic deep- sea red crab fishery, including an annual catch limit and total allowable landings limit. This action is necessary to fully implement previously projected allowable red crab harvest levels that will prevent overfishing and allow harvesting of optimum yield. This action is intended to establish the allowable 2022 harvest levels, consistent with the Atlantic Deep-Sea Red Crab Fishery Management Plan.
Fisheries of the Northeastern United States; Southern Red Hake Rebuilding Plan; Framework Adjustment 62 to the Small-Mesh Multispecies Fishery Management Plan
NMFS approves and implements Framework Adjustment 62 for Whiting, Red Hake, and Offshore Hake to the Northeast Multispecies Fishery Management Plan. This action establishes a 10-year rebuilding plan, including a rebuilding schedule and change in possession limits for the overfished southern red hake stock. This action is necessary to meet the statutory requirements for an overfished stock and rebuilding plan consistent with the Magnuson-Stevens Fishery Conservation and Management Act. This action is intended to rebuild the southern red hake stock and help achieve optimum yield in the commercial fishery.
Research Track Assessment for Gulf of Maine Haddock
NMFS will convene the Research Track Assessment Peer Review Meeting for the purpose of reviewing Gulf of Maine haddock stock. The Research Track Assessment Peer Review is a formal scientific peer- review process for evaluating and presenting stock assessment results to managers for fish stocks in the offshore U.S. and Canadian waters of the northwest Atlantic. Assessments are prepared by the research track working group and reviewed by an independent panel of stock assessment experts from the Center of Independent Experts (CIE). The public is invited to attend the presentations and discussions between the review panel and the scientists who have participated in the stock assessment process.

Atlantic Highly Migratory Species; Supplement to Draft Amendment 14 to the 2006 Consolidated Atlantic Highly Migratory Species Fishery Management Plan; Meeting of the Atlantic Highly Migratory Species Advisory Panel
NMFS announces the availability of a supplement to Draft Amendment 14 to the 2006 Consolidated Atlantic Highly Migratory Species (HMS) Fishery Management Plan (FMP). Draft Amendment 14 is being undertaken to revise the mechanism or ``framework'' used in establishing quotas and related management measures for Atlantic shark fisheries. The revised framework would modify the procedures followed in establishing the acceptable biological catch (ABC) and annual catch limits (ACLs) for Atlantic sharks and the process used to account for carryover or underharvests of quotas. NMFS provides details for application of the tiered ABC control rule and reopens the comment period on the ABC control rule for Atlantic HMS shark fisheries and Amendment 14 will not make changes to the current quotas or other management measures. Any operational changes to HMS fishery management measures as a result of Amendment 14 will be considered in future rulemakings, as appropriate. NMFS will hold a half-day HMS Advisory Panel (AP) meeting on this topic in February 2022. The intent of the HMS AP meeting is to discuss the ABC control rule for Atlantic HMS shark fisheries and collect comments regarding the application of the tiered ABC control rule. The meeting is open to the public.

NMFS publishes the standard ex-vessel prices and fee percentage for cost recovery under the Central Gulf of Alaska (GOA) Rockfish Program (Rockfish Program). This action is intended to provide participants in a rockfish cooperative with the standard prices and fee percentage for the 2021 fishing year, which was authorized from April 1 through November 15. The fee percentage is 2.77 percent. The fee payments are due from each rockfish cooperative on or before February 15, 2022.

NMFS announces that the Western Pacific Fishery Management Council (Council) proposes to amend the Fishery Ecosystem Plan for the American Samoa Archipelago (FEP). If approved, Amendment 5 would establish a rebuilding plan for the American Samoa bottomfish stock complex. The Council recommended Amendment 5 to rebuild the bottomfish stock, which is overfished and experiencing overfishing.

NMFS has received a request from the Sonoma County Water Agency (SCWA) for authorization to take marine mammals incidental to Russian River estuary management activities in Sonoma County, California, over the course of five years (2022-2027). As required by the Marine Mammal Protection Act (MMPA), NMFS is proposing regulations to govern that take and requests comments on the proposed regulations.
Review of Nomination for Mariana Trench National Marine Sanctuary
The Office of National Marine Sanctuaries (ONMS) of the National Oceanic and Atmospheric Administration (NOAA) is requesting written comments to facilitate ONMS' five-year review of the nomination for the Mariana Trench National Marine Sanctuary (NMS) at the five-year interval. In particular, NOAA is requesting relevant information as it pertains to its 11 evaluation criteria for inclusion in the inventory. In this five-year review, NOAA will pay particular attention to any new information about the significance of the area's natural or cultural resources, changes to any threats to these resources, and any updates to the management framework of the area. NOAA has provided the original nominating parties, The Pew Charitable Trusts and Friends of the Marianas Trench, an opportunity to share their views on these same questions. Following this information gathering and internal analysis, NOAA will make a final determination on whether or not the Mariana Trench NMS nomination will remain in the inventory for another five- year period.
Review of Nomination for Hudson Canyon National Marine Sanctuary
The National Oceanic and Atmospheric Administration (NOAA) is seeking written comments on its five-year review of the nomination for Hudson Canyon National Marine Sanctuary (NMS). Comments should focus solely on any new and relevant information relating to NOAA's 11 sanctuary nomination evaluation criteria. NOAA will pay particular attention to any additional details about the significance of the area's natural or cultural resources, changes to any threats to these resources, and evolving management efforts, or human uses in the proposed area (e.g., wind energy proposals in the area). NOAA will make a final determination on whether the Hudson Canyon NMS nomination remains relevant and responsive to the evaluation criteria after it analyzes the comments it receives and, if so, whether Hudson Canyon NMS is to remain in the nomination inventory for another five-year period. With this five-year review, NOAA is not seeking comments on whether to start the sanctuary designation process for the Hudson Canyon NMS proposal.
Pacific Island Fisheries; Annual Catch Limit and Accountability Measures; Main Hawaiian Islands Deep 7 Bottomfish for Fishing Years 2021-2024
In this final rule, NMFS implements an annual catch limit (ACL) of 492,000 lb (223,167 kg) for Deep 7 bottomfish in the main Hawaiian Islands (MHI) for each of the three fishing years 2021-22, 2022-23, and 2023-24. As an in-season accountability measure (AM), if NMFS projects that the fishery will reach the ACL in any given fishing year, we would close the commercial and non-commercial fisheries in Federal waters for the remainder of the fishing year. As a post-season AM, if NMFS determines that the catch exceeded the ACL in a fishing year, we would reduce the ACL for the following fishing year by the amount of the overage. This rule supports the long-term sustainability of Deep 7 bottomfish.

Regulations implementing the Northeast Multispecies Fishery Management Plan require at-sea and electronic monitoring companies to be approved by NMFS to provide monitoring services to sectors. This action will allow sectors to contract for electronic monitoring services with any of the approved service providers for fishing year 2022.

The proposed action is intended to increase post-hooking survival of oceanic whitetip sharks.
