Coastal Nonpoint Pollution Control Program: Approval Decision on Florida's and South Carolina's Coastal Nonpoint Pollution Control Programs
Document Number: 08-596
Type: Notice
Date: 2008-02-11
Agency: Department of Commerce, National Oceanic and Atmospheric Administration, Environmental Protection Agency
Notice is hereby given of the intent to fully approve the Florida and South Carolina Coastal Nonpoint Pollution Control Programs (coastal nonpoint program) and of the availability of the draft decision documents fully approving the Florida and South Carolina coastal nonpoint programs. Section 6217 of the Coastal Zone Act Reauthorization Amendments (CZARA), 16 U.S.C. section 1455b, requires States and Territories with coastal zone management programs that have received approval under section 306 of the Coastal Zone Management Act, 16 U.S.C. section 1455, to develop and implement coastal nonpoint programs. Coastal States and Territories were required to submit their coastal nonpoint programs to the National Oceanic and Atmospheric Administration (NOAA) and the U.S. Environmental Protection Agency (EPA) for approval in July 1995. NOAA and EPA conditionally approved the Florida and South Carolina coastal nonpoint programs on November 18, 1997 and February 23, 1998, respectively. NOAA and EPA have drafted approval decisions describing how Florida and South Carolina have satisfied the conditions placed on their programs and therefore have a fully approved coastal nonpoint program. NOAA and EPA are making the draft decisions for the Florida and South Carolina coastal nonpoint programs available for a 30-day public comment period. If comments are received, NOAA and EPA will consider whether such comments are significant enough to affect the decision to fully approve the programs. Copies of the draft Approval Decisions can be found on the NOAA Web site at https://coastalmanagement.noaa.gov/czm/6217/findings.html or may be obtained upon request from: Allison Castellan, Coastal Programs Division (N/ORM3), Office of Ocean and Coastal Resource Management, NOS, NOAA, 1305 East-West Highway, Silver Spring, Maryland 20910, phone (301) 713-3155, x125, e-mail Allison.Castellan@noaa.gov.

Document Number: 08-497
Type: Proposed Rule
Date: 2008-02-06

We, the National Marine Fisheries Service (NMFS), propose to designate critical habitat for elkhorn (Acropora palmata) and staghorn (A. cervicornis) corals, which we listed as threatened under the Endangered Species Act of 1973, as amended (ESA), on May 9, 2006. Four specific areas are proposed for designation: the Florida unit, which comprises approximately 3,301 square miles (8,671 sq km) of marine habitat; the Puerto Rico unit, which comprises approximately 1,383 square miles (3,582 sq km) of marine habitat; the St. John/St. Thomas unit, which comprises approximately 121 square miles (313 sq km) of marine habitat; and the St. Croix unit, which comprises approximately 126 square miles (326 sq km) of marine habitat. We propose to exclude one military site, comprising approximately 47 square miles (123 sq km), because of national security impacts. We are soliciting comments from the public on all aspects of the proposal, including our identification and consideration of the positive and negative economic, national security, and other relevant impacts of the proposed designation, and the areas we propose to exclude from the designation. A draft impacts report prepared pursuant to section 4(b)(2) of the ESA in support of this proposal is also available for public review and comment.

Notice of availability is hereby given for a 45-day public comment period on ``proposed'' Data Management and Communications (DMAC) standards for implementation of the U.S. Integrated Ocean Observing System (IOOS). A description and references for currently ``proposed'' standards are posted at the following URL: https:// ioosdmac.fedworx.org. At that Web site, standards are categorized in a three level sequence as either ``submitted'', ``proposed'' or ``recommended''. This announcement seeks public comments on those categorized as ``proposed''. The public may view any standard using the anonymous guest login provided; however, submission of comments on the ``proposed'' standards using the website requires registration as provided by the website interface. Public comments are sought as part of the ongoing DMAC standards process adopted by the DMAC Steering Team in May 2006 to manage the review and adoption of standards (including guidance and best practices) in an open, objective, and balanced manner. Suggested standards may be submitted at anytime as this process will run continuously for submission of suggested standards and for public comment on those elevated to ``proposed'' status. Subsequent comment periods will be announced at approximately six-month intervals. The Web site will remain open continuously and display information about the schedule for future comment periods. All substantive comments received during a review period will be considered by a broadly based, expert panel convened by Ocean.US for that purpose. Possible decisions are to: (1) Advance the standard to ``recommended'' status; (2) defer for technical modifications, additional testing or comments; or (3) reject as not appropriate for IOOS implementation. Decisions will be posted to that Web site. Any subsequently modifications or additions to the developing set of IOOS standards shall be subjected to public review and comment through this same process.

NMFS issues this final rule to implement joint Amendment 27 to the Fishery Management Plan (FMP) for the Reef Fish Resources of the Gulf of Mexico (Reef Fish FMP) and Amendment 14 to the Fishery Management Plan for the Shrimp Fishery of the Gulf of Mexico (Shrimp FMP)(Amendment 27/14) prepared by the Gulf of Mexico Fishery Management Council (Council). This final rule reduces the commercial and recreational quotas for red snapper, reduces the commercial minimum size limit for red snapper, reduces the recreational bag limit for red snapper, prohibits the retention of red snapper under the bag limit for the captain and crew of a vessel operating as a charter vessel or headboat, establishes a red snapper recreational season that is open from June 1 through September 30 each year, requires the use of non- stainless steel circle hooks when using natural baits to fish for Gulf reef fish, requires the use of venting tools and dehooking devices when participating in the commercial or recreational reef fish fisheries, and consistent with the Amendment's framework procedure, provides for implementing seasonal closures of the Gulf shrimp fishery to reduce red snapper bycatch based upon the 74 percent bycatch reduction target established in this final rule. In addition, this final rule establishes a framework procedure to adjust the target effort level and any necessary closures for the Gulf shrimp fishery. The measures contained in this final rule are intended to establish a revised red snapper rebuilding plan and to end overfishing of the red snapper resource in the Gulf of Mexico.
