On July 9, 2010, the Department of Commerce (``Department'') initiated the third sunset review of the antidumping duty order on petroleum wax candles from the People's Republic of China (``PRC''). On the basis of a timely notice of intent to participate and an adequate substantive response filed on behalf of a domestic interested party, as well as an inadequate response from any respondent interested parties (in this case, no response), the Department conducted an expedited sunset review. As a result of the sunset review, the Department finds that revocation of the antidumping duty order would be likely to lead to continuation or recurrence of dumping at the margins identified in the Final Results of Review section of this notice.

The Environmental Technologies Trade Advisory Committee (ETTAC) was established under the Federal Advisory Committee Act, as amended, 5 U.S.C. App., and pursuant to Section 2313(c) of the Export Enhancement Act of 1988, as amended, 15 U.S.C. 4728(c). ETTAC was first chartered on May 31, 1994. By statute, the ETTAC advises, through the Secretary of Commerce, the Environmental Trade Working Group (ETWG) of the Trade Promotion Coordinating Committee (TPCC). The Secretary appoints the chair of the ETWG from among the employees of the Department. Although the ETWG is not currently active, the Department continues to function as chair of the ETWG, and the Department, as ETWG chair, utilizes the advice of the ETTAC and shares it with the TPCC or relevant TPCC member agencies as appropriate. ETTAC advises on the development and administration of policies and programs to expand U.S. exports of environmental technologies, goods, and services. The Department of Commerce rechartered the ETTAC on October 25, 2010 and is currently seeking nominations for membership on the ETTAC for the new charter term.

The Department of Commerce (Department) is conducting new shipper reviews (NSRs) of Jinxiang Chengda Imp & Exp Co., Ltd. (Chengda), Jinxiang Yuanxin Imp & Exp Co., Ltd. (Yuanxin), and Zhengzhou Huachao Industrial Co., Ltd. (Huachao) under the antidumping duty order on fresh garlic from the People's Republic of China (PRC) covering the period of review (POR) of November 1, 2008 through October 31, 2009. As discussed below, we preliminarily determine that Yuanxin's and Huachao's sales are bona fide and that these sales have been made in the United States at prices below normal value (NV). Yuanxin and Huachao have also demonstrated their eligibility for a separate rate in these NSRs. In addition, we find Chengda's sales to be not bona fide. As such, we are preliminarily rescinding the NSR for Chengda. The dumping margins are set forth in the ``Preliminary Results of the Review'' section below. If these preliminary results are adopted in our final results of review, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties on entries of subject merchandise during the POR for which importer-specific assessment rates are above de minimis. On October 12, 2010, the Deputy Assistant Secretary of the U.S. Department of Commerce (the Department) signed the final results of the administrative review of the antidumping duty order on brass sheet and strip (BSS) from Germany for the period of review (POR) March 1, 2008, through February 28, 2009. In preparing documentation for the release to the interested parties, we noted that we had inadvertently referred to business proprietary information (BPI) in explaining the Department's position for certain comments discussed in the Issues and Decision Memorandum accompanying the final results of the instant review. This error was discovered prior to publication in the Federal Register; therefore, the Department did not publish the original notice or place the Issues and Decision memorandum on the Import Administration Web site. In order to ensure that such BPI is not inappropriately released to any party, we have amended the accompanying Issues and Decision memorandum to remove BPI. The original Department's position containing the BPI information for Comments 1 and 5 are included as BPI in the Cost and Sales Calculation Memorandum for reference.\1\ There was no substantive change to the Department's positions associated with this change. The original signed notice of final results of the instant review was public in its entirety. We have adopted the entire original notice below correcting only the citation to the Issues and Decision Memorandum. This notice is being published in place of the original.
