Honey from Argentina: Preliminary Results of Antidumping Duty Administrative Review and Intent Not to Revoke in Part

In response to requests by interested parties, the Department of Commerce (the Department) is conducting an administrative review of the antidumping order on honey from Argentina. The review covers four firms, one of which was selected as a mandatory respondent (see ``Background'' section of this notice for further explanation). The period of review (POR) is December 1, 2004, through November 30, 2005. We preliminarily determine that sales of honey from Argentina have not been made below the normal value (NV) for the respondent firm, Seylinco S.A. (Seylinco). In addition, we will preliminarily apply the de minimis rate calculated for Seylinco as the review-specific rate for those companies subject to this review but not selected as respondents (i.e., Mielar S.A./Compania Apicola Argentina S.A. (Mielar/CAA) and El Mana S.A.). For more detail, see the ``Background'' section below; see also ``Preliminary Results of Review,'' below. If these preliminary results are adopted in our final results of administrative review, we will instruct U.S. Customs and Border Protection (CBP) to assess antidumping duties based on the difference between the export price (EP) and NV. Interested parties are invited to comment on these preliminary results. Parties who submit argument in these proceedings are requested to submit with the argument: (1) a statement of the issues, (2) a brief summary of the argument, and (3) a table of authorities.
Antidumping Proceedings: Calculation of the Weighted-Average Dumping Margin During an Antidumping Investigation; Final Modification

The Department of Commerce is modifying its methodology in antidumping investigations with respect to the calculation of the weighted-average dumping margin. This final modification is necessary to implement the recommendations of the World Trade Organization Dispute Settlement Body. Under this final modification, the Department will no longer make average-to-average comparisons in investigations without providing offsets for non-dumped comparisons. The schedule for implementing this change is set forth in the ``Timetable'' section, below.

On June 1, 2006, the Department of Commerce (the Department) published in the Federal Register the notice of initiation of the second five-year sunset review of the countervailing duty order on oil country tubular goods (OCTG) from Italy, pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act). See Initiation of Five- year (``Sunset'') Reviews, 71 FR 31153 (June 1, 2006) (Second Sunset Review). The Department has conducted an expedited sunset review as provided for in section 751(c)(3)(B) of the Act and 19 CFR 351.218(e)(1)(ii)(C). As a result of this sunset review, the Department finds that revocation of the countervailing duty order would not be likely to lead to continuation or recurrence of a countervailable subsidy. Therefore, the Department is revoking this countervailing duty order.

On July 1, 2005, the Department of Commerce (the Department) published a notice entitled Antidumping or Countervailing Duty Order, Finding, or Suspended Investigation; Opportunity To Request Administrative Review, 70 FR 38099 (July 1, 2005) covering inter alia, stainless steel sheet and strip in coils from Mexico for the period July 1, 2004, through June 30, 2005. In accordance with 19 CFR 351.213(b)(1) and (2), the Department received timely requests that it conduct an administrative review of stainless steel sheet and strip in coils from Mexico for the period July 1, 2004, through June 30, 2005. On August 29, 2005, we published in the Federal Register a notice of initiation of this antidumping duty administrative review covering the period July 1, 2004, through June 30, 2005. See Initiation of Antidumping and Countervailing Duty Administrative Reviews and Requests for Revocation in Part, 70 FR 51009 (August 29, 2005). On June 21, 2006, the Department published the preliminary results of the administrative review of the antidumping duty order on stainless steel sheet and strip in coils from Mexico. Based on our analysis of the comments received, we have made changes in the margin calculation; therefore, the final results differ from the preliminary results. On October 26, 2006 the Department of Commerce (the ``Department'') received a request on behalf of the petitioners, the American Furniture Manufacturers Committee for Legal Trade and its individual members (the ``AFMC'') for a changed circumstances review and a request to revoke in part the antidumping duty (``AD'') order on wooden bedroom furniture from the People's Republic of China with respect to completely upholstered beds that have exposed wooden feet of no more than nine inches in height from the floor. In its October 26, 2006, submission, AFMC stated that it no longer has any interest in antidumping relief from imports of such upholstered beds with respect to the subject merchandise defined in the ``Scope of the Review'' section below. On August 8, 2006, the Department of Commerce (the Department) published the preliminary results of administrative review of the antidumping duty order covering stainless steel sheet and strip in coils from Germany. See Stainless Steel Sheet and Strip in Coils from Germany; Notice of Preliminary Results of Antidumping Duty Administrative Review, 71 FR 45024 (August 8, 2006) (Preliminary Results). The merchandise covered by this order is stainless steel sheet and strip in coils as described in the ``Scope of the Order'' section of this notice. The period of review (POR) is July 1, 2004, through June 30, 2005. In the Preliminary Results we invited parties to provide comments. Based on our analysis of the comments received, we have made changes to the margin calculation. Therefore, the final results differ from the preliminary results. The final weighted-average dumping margin for the reviewed firm is listed below in the section entitled ``Final Results of the Review.''

In response to requests from interested parties, the Department of Commerce is conducting an administrative review of the antidumping duty order on individually quick frozen red raspberries from Chile. This review covers sales of individually quick frozen red raspberries to the United States during the period July 1, 2005 through June 30, 2006. Based on the withdrawal of requests for review with respect to certain companies, we are rescinding, in part, the fourth administrative review.

The period of review (POR) is November 1, 2004 through October 31, 2005. No interested parties submitted comments and we have made no changes to our preliminary results. Therefore, the final results do not differ from the preliminary results.
Fresh Garlic from the People's Republic of China: Partial Rescission and Preliminary Results of the Eleventh Administrative Review and New Shipper Reviews

The Department of Commerce (``the Department'') is conducting an administrative review and new shipper review of the antidumping duty order on fresh garlic from the People's Republic of China (``PRC'') both covering the period of review (``POR'') of November 1, 2004, through October 31, 2005. The Department initiated an administrative review of 34\1\ producers/exporters of subject merchandise from the PRC. See Initiation of Antidumping and Countervailing Duty Administrative Reviews and Requests for Revocation in Part, 70 FR 76024 (December 22, 2005) (``Administrative Review Initiation''). On December 28, 2005, the Department also initiated new shipper reviews with respect to Shandong Longtai Fruits & Vegetables Co., Ltd. (``Longtai''), Qingdao Camel Trading Co., Ltd. (``Qingdao Camel''), Qingdao Saturn, Qingdao Xintianfeng Foods Co., Ltd. (``QXF''), and XuZhou Simple.\2\ Therefore, this reviews covers 39 companies (34 administrative review companies and 5 new shipper companies).\3\

Based on our analysis of the comments received, we have made changes to our margin calculations. Therefore, the final results differ from the preliminary results. The final dumping margins for this review are listed in the ``Final Results of Review'' section below.
