Department of Commerce 2016 – Federal Register Recent Federal Regulation Documents

The Economic Development Administration (``EDA''), U.S. Department of Commerce (``DOC''), will hold a webinar to discuss proposed updates to the agency's regulations implementing the Public Works and Economic Development Act of 1965, as amended (``PWEDA''). On October 3, 2016, EDA published a Notice of Proposed Rulemaking (``NPRM'') in the Federal Register at 81 FR 68186. Through this NPRM, EDA is proposing important changes to the regulations governing the Revolving Loan Fund (``RLF'') program that are intended to reflect current best practices and strengthen EDA's efforts to evaluate, monitor, and improve RLF performance by establishing the Risk Analysis System, a risk-based management framework, to evaluate and manage the RLF program. EDA also proposes to reorganize the RLF regulations to improve their readability and clarify the requirements that apply to the distinct phases of an RLF award. In addition, EDA proposes specific changes to RLF requirements to make RLF awards more efficient for Recipients to administer and for EDA to monitor. Through this NPRM EDA proposes important, but less comprehensive updates to other parts of its regulations, including revising definitions, replacing references to superseded regulations to reflect the promulgation of the Uniform Administrative Requirements, Cost Principles, and Audit Requirements (2 CFR part 200) (``Uniform Guidance''), streamlining the provisions that outline EDA's application process, and clarifying EDA's property management regulations. Given the more comprehensive nature of the changes being proposed to the RLF program, EDA will use this webinar to focus on the proposed RLF changes and explain both the rationale behind those changes and their potential impact. All members of the public are invited to participate.

The United States Patent and Trademark Office publishes this notice to announce that interested persons may participate at the USPTO's Alexandria, VA office for its Roundtable to be held on December 5, 2016.

This action closes the Witch Flounder Trimester Total Allowable Catch Area to Northeast multispecies common pool vessels fishing with trawl gear for the remainder of Trimester 2, through December 31, 2016. The common pool fishery is projected to have caught 90 percent of its Trimester 2 quota for witch flounder. The closure is intended to prevent an overage of the common pool's quota for this stock.

NOAA's National Geodetic Survey (NGS) conducts a Calibration Base Line (CBL) program for electronic distance measuring instrumentation, hereafter referred to as the CBL Program. The CBL Program provides the surveying and engineering community with a locally accessible standard for measuring length and a means for quantifying and correcting for errors associated with this type of instrumentation. Currently, the CBL Program requires use of NGS equipment and direct participation by NGS personnel when establishing and reestablishing CBLs. NGS is considering changes to the CBL Program which will enable our partners to establish and reestablish their local CBLs using their own instrumentation, with NGS providing a quality review function. NMFS has received a request from the City of Unalaska (COU), for authorization to take marine mammals incidental to construction activities as part of a dock expansion project at the existing Unalaska Marine Center (UMC) Dock in Unalaska, Alaska. Pursuant to the Marine Mammal Protection Act (MMPA), NMFS is requesting comments on its proposal to issue an incidental harassment authorization (IHA) to the COU to incidentally take marine mammals, by Level B Harassment only, during the specified activity.

Based on a request from PulseTech Products Corporation (``PulseTech'') the Department of Commerce (the ``Department'') is initiating changed circumstances reviews to consider the possible revocation, in part, of the antidumping duty (``AD'') order on certain crystalline silicon photovoltaic products from Taiwan and the AD and countervailing duty (``CVD'') orders on certain crystalline silicon photovoltaic products from the People's Republic of China (``PRC'') (together, the ``Orders'') with respect to solar panels incorporated in certain battery charging and maintaining units, as described below.

The Department of Commerce, as part of its continuing effort to reduce paperwork and respondent burden, invites the general public and other Federal agencies to take this opportunity to comment on proposed and/or continuing information collections, as required by the Paperwork Reduction Act of 1995.

This rule updates the Code of Federal Regulations (CFR) legal authority paragraphs in the Export Administration Regulations (EAR) to cite the most recent Presidential notice continuing an emergency declared pursuant to the International Emergency Economic Powers Act. This is a non-substantive rule that only updates authority paragraphs of the EAR. It does not alter any right, obligation or prohibition that applies to any person under the EAR.

The Department of Commerce (``the Department'') has received requests to conduct administrative reviews of various antidumping and countervailing duty orders and findings with September anniversary dates. In accordance with the Department's regulations, we are initiating those administrative reviews.

The U.S. Department of Commerce (``the Department'') preliminarily determines that ammonium sulfate from the People's Republic of China (``PRC'') is, or is likely to be, sold in the United States at less than fair value (``LTFV''). The period of investigation (``POI'') is October 1, 2015, through March 31, 2016. Interested parties are invited to comment on this preliminary determination.

The National Oceanic and Atmospheric Administration (NOAA) wants to provide states and NOAA with a more efficient process for making changes to state coastal management programs (``management programs''). NOAA proposes to revise the Coastal Zone Management Act (CZMA) program change regulations and associated guidance (Program Change Guidance (July 1996) and Addendum (November 2013)) within our regulations. Under the CZMA, a coastal state may not implement any amendment, modification, or other change as part of its approved management program unless the amendment, modification, or other change is approved by the Secretary of Commerce under this subsection. Once NOAA approves the incorporation of a change into a management program, any new or amended management program enforceable policies are applied to federal actions through the CZMA federal consistency provision. This proposed rule addresses the issues raised in NOAA's Advanced Notice of Proposed Rulemaking, 73 FR 29093 (May 20, 2008) (ANPR) to: Provide a more efficient process for states and NOAA to make changes to state management programs; remove unnecessary requirements in the current regulations; establish program change documentation that all states would adhere to; continue to ensure that federal agencies and the public have an opportunity to comment to NOAA on a state's proposed change to its management program; and comply with the requirements of the CZMA and other applicable federal law. The proposed rule also addresses comments submitted on the ANPR.

The Gulf of Mexico Fishery Management Council (Council) will hold a meeting of its Mackerel Advisory Panel.

The Department of Commerce (the Department) finds that revocation of the countervailing duty (CVD) order on stainless steel plate in coils (SSPC) from South Africa would likely lead to the continuation or recurrence of a countervailable subsidy at the levels indicated in the Final Results of Review section of this notice.

The Department of Commerce (``the Department'') is conducting an administrative review of the antidumping duty order on uncovered innerspring units (``innerspring units'') from the People's Republic of China (``PRC''). The period of review (``POR'') is February 1, 2015, through January 31, 2016. The Department preliminarily determines that the sole respondent, Enchant Privilege Sdn Bhd (``Enchant Privilege''), did not cooperate to the best of its ability and is, therefore, basing its margin on adverse facts available (``AFA''). Interested parties are invited to comment on these preliminary results.

In response to a request from the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union; Domtar Corporation; Finch Paper LLC; P.H. Glatfelter Company; and Packaging Corporation of America (collectively, the petitioners), the Department of Commerce (the Department) is initiating an anti-circumvention inquiry pursuant to section 781(c) of the Tariff Act of 1930, as amended (the Act), to determine under the minor alterations provision whether uncoated paper with a GE brightness of 83 +/- 1% (83 Bright paper) is ``altered in form or appearance in minor respects'' from in-scope merchandise such that it may be considered subject to the antidumping (AD) and countervailing duty (CVD) orders on certain uncoated paper.

The U.S. Department of Commerce issued an amended Export Trade Certificate of Review to NFE on October 24, 2016.
