This temporary rule extends a closure of Federal waters. The FDA has determined that oceanographic conditions and alga sampling data suggest that the northern section of the Temporary Paralytic Shellfish Poison (PSP) Closure Area remain closed to the harvest of bivalve molluscan shellfish, with the exception of sea scallop adductor muscles harvested and shucked at sea, and that the southern area remain closed to the harvest of whole or roe-on scallops. The regulations contained in the temporary rule, emergency action, first published in 2005, and have been subsequently extended several times at the request of the U.S. Food and Drug Administration (FDA). NMFS is publishing the regulatory text associated with this closure in this temporary emergency rule in order to ensure that current regulations accurately reflect the codified text that has been modified and extended numerous times, so that the public is aware of the regulations being extended.

NMFS is required by the ESA to develop and implement recovery plans for the conservation and survival of ESA-listed species. Pursuant to the Marine Mammal Protection Act (MMPA), NMFS is requesting comments on its proposal to issue an IHA to the Agency to incidentally harass, by Level B Harassment only, a small number of harbor seals (Phoca vitulina richardii), California sea lions (Zalophus califonianus), and northern elephant seals (Mirounga angustirostris) during the specified activity.

NMFS proposes 2010 specifications and management measures for Atlantic mackerel, squid, and butterfish (MSB). This action proposes to maintain quotas for Atlantic mackerel (mackerel), Illex squid (Illex), Loligo squid (Loligo), and butterfish at the same levels as 2009. This action also proposes to modify accounting procedures for underages of Trimester 1 quotas in the Loligo fishery so that Trimester 1 quota underages that are greater than 25% of the Trimester 1 quota would be allocated equally to Trimesters 2 and 3, and underages that are less than 25% of the Trimester 1 quota would be allocated to Trimester 3. Additionally, this action proposes to increase the minimum mesh size requirement for codend covers in the Loligo fishery from 4.5 inches to 5 inches. These proposed specifications and management measures promote the utilization and conservation of the MSB resource.

On July 1, 2009, the Department of Commerce (``the Department'') initiated a sunset review of the antidumping duty order on chloropicrin from the People's Republic of China (``PRC'') pursuant to section 751(c) of the Tariff Act of 1930, as amended (``the Act''). The National Institute of Standards and Technology (NIST) will hold a public workshop on December 1-3, 2009, at the National Transportation Safety Board (NTSB) Board Room/Conference Center. The workshop is open to the public but registration is required. The registration fee will be $90.00. The purpose of the 3-day workshop is to provide a high-level tutorial of the six part standard, ISO/IEC 24727Identification cardsIntegrated circuit card programming interfaces, a multi-part standard for interoperable identification, authentication, and signature services for credentials and applications. The workshop will also provide sessions on the use of ISO/IEC 24727 to include an overview of NIST IR 7611, Use of ISO/IEC 24727Service Access Layer Interface for Identity (SALII): Support for Development and use of Interoperable Identity Credentials, which describes ISO/IEC 24727 from the perspective of the Federal Information Processing Standard (FIPS) 201Personal Identity Verification (PIV) of Federal Employees and Contractors.

After we, NMFS, received a petition to list Atlantic wolffish (Anarhichas lupus) as threatened or endangered under the Endangered Species Act (ESA), we established a biological review team (BRT) to conduct a status review. We (NMFS) have reviewed the BRT's status review report and other available scientific and commercial information and have determined that listing Atlantic wolffish as threatened or endangered under the ESA is not warranted at this time. We also announce the availability of the status review document.
Tetrahydrofurfuryl Alcohol From the People's Republic of China: Final Results of the Expedited Sunset Review of the Antidumping Duty Order

On July 1, 2009, the Department of Commerce (``Department'') initiated a sunset review of the antidumping duty order on tetrahydrofurfuryl alcohol (``THFA'') from the People's Republic of China (``PRC'') pursuant to section 751(c) of the Tariff Act of 1930, as amended (``Act''). See Initiation of Five-year (``Sunset'') Review, 74 FR 31412 (July 1, 2009) (``Sunset Initiation''); see also Notice of Antidumping Duty Order: Tetrahydrofurfuryl Alcohol from the People's Republic of China, 69 FR 47911 (August 6, 2004) (``Order''). On July14, 2009, Penn A Kem LLC (formerly, Penn Specialty Chemicals) (``PAK''), the petitioner in the THFA investigation, notified the Department that it intended to participate in the sunset review. The Department did not receive a substantive response from any respondent party. Based on the notice of intent to participate and adequate response filed by the domestic interested party, and the lack of response from any respondent interested party, the Department conducted an expedited sunset review of the Order pursuant to section 751(c)(3)(B) of the Act and 19 CFR 351.218(e)(1)(ii)(C)(2). As a result of this sunset review, the Department finds that revocation of the Order would likely lead to continuation or recurrence of dumping, at the levels indicated in the ``Final Results of Sunset Review'' section of this notice, infra.

NMFS closes commercial harvest of greater amberjack in the exclusive economic zone (EEZ) of the Gulf of Mexico (Gulf). NMFS has determined that the commercial greater amberjack quota will have been reached by November 7, 2009. This closure is necessary to prevent overfishing of Gulf greater amberjack.
