Right, humpback and fin whales, which are listed as endangered under the Endangered Species Act, are occasionally injured or killed through incidental entanglement in fishing gear. Based on gear retrieved from entangled whales, interactions can occur with any component of the fishing gear, including buoy lines, groundlines, gillnet floatlines, and surface systems. Provisions of the Atlantic Large Whale Take Reduction Plan (ALWTRP) require that permit holders using trap/pot and gillnet gear comply with requirements designed to reduce the serious injury and mortality of large whales. One such gear modification requires the use of sinking groundlines. Other risk reduction measures include adding weak links to fixed fishing gear which can assist entangled whales in breaking free after an interaction has occurred.

The period of review (POR) is February 1, 2007, through January 31, 2008. We gave interested parties an opportunity to comment on the preliminary results. Based on our analysis of the comments received and an examination of our calculations, we have made changes for the final results. NMFS announces the receipt of an application for an exempted fishing permit (EFP) from the Florida Fish and Wildlife Conservation Commission, Fish and Wildlife Research Institute. This study would place observers aboard vessels of opportunity in the Gulf of Mexico recreational for-hire fishery to collect reef fish for determination of age structure and sex composition and to tag and release reef fish to evaluate discard mortality. If granted, the EFP would authorize the applicant, within certain conditions, to collect and possess reef fish that would otherwise be prohibited because of existing fishing regulations.

The Assistant Regional Administrator for Sustainable Fisheries, Northeast Region, NMFS (Assistant Regional Administrator), has made a preliminary determination that the subject Exempted Fishing Permit (EFP) application that was submitted by the Cornell Cooperative Extension of Suffolk County (CCE) warrants further consideration and should be issued for public comment. The EFP would exempt participating vessels from summer flounder size restrictions and summer flounder minimum mesh size regulations. The Assistant Regional Administrator has also made a preliminary determination that the activities authorized under the EFP would be consistent with the goals and objectives of the Summer Flounder, Scup, and Black Sea Bass Fishery Management Plan (FMP). However, further review and consultation may be necessary before a final determination is made.

NMFS closes the commercial fishery for golden tilefish in the exclusive economic zone (EEZ) of the South Atlantic. In addition, for a person on board a vessel for which a Federal commercial or charter vessel/headboat permit for the South Atlantic Snapper-Grouper Fishery has been issued, the provisions of the closure (restriction to the bag and possession limits and prohibition of sale or purchase) apply regardless of whether the golden tilefish are harvested in state waters or the South Atlantic EEZ. NMFS has determined that the quota for the commercial fishery for golden tilefish will have been reached by July 15, 2009. This closure is necessary to protect the golden tilefish resource.
