Certain Steel Nails From the People's Republic of China: Amended Preliminary Determination of Sales at Less Than Fair Value

On January 23, 2008, the Department of Commerce (the ``Department'') published the preliminary determination of sales at less than fair value (``LTFV'') in the antidumping investigation of certain steel nails from the People's Republic of China (``PRC''). We are amending our preliminary determination to correct certain ministerial errors with respect to the antidumping duty margin calculation for Illinois Tool Works Inc. and Paslode Fasteners (Shanghai) Co., Ltd. (collectively, ``Paslode''). The corrections to Paslode's margin also affect the margin applied to companies granted separate-rate status.

On August 7, 2007, the Department of Commerce (Department) published in the Federal Register its preliminary results of the administrative review of the antidumping duty order on polyethylene terephthalate film, sheet and strip (PET film) from India. See Certain Polyethylene Terephthalate Film, Sheet and Strip From India: Preliminary Results of Antidumping Duty Administrative Review, 72 FR 44086 (August 7, 2007) (Preliminary Results). The review covers one respondent, MTZ Polyfilms, Ltd. (MTZ). Based on our analysis of comments received on the Preliminary Results, we have made changes to our calculations for MTZ. Therefore, the final results differ from the preliminary results of review. The final weighted-average dumping margin for MTZ is listed in the ``Final Results of the Review'' section below.

On August 3, 2007, the Department of Commerce (the Department) published the preliminary results of the administrative review of the antidumping duty order on stainless steel sheet and strip in coils (SSSSC) from Taiwan (72 FR 43236). This review covers three producers/ exporters of the subject merchandise to the United States. The period of review (POR) is July 1, 2005, through June 30, 2006. We are rescinding the review with respect to nine companies because these companies had no shipments of subject merchandise during the POR. Based on our analysis of the comments received, we have made certain changes in the margin calculations. Therefore, the final results differ from the preliminary results. The final weighted-average dumping margins for the reviewed firms are listed below in the section entitled ``Final Results of Review.''

In response to a request from Nucor Corporation (Nucor), a domestic interested party, the Department of Commerce (the Department) is conducting an administrative review of the Agreement Suspending the Antidumping Investigation of Certain Cut-to-Length Carbon Steel Plate from the Russian Federation (the Agreement) for the period January 1, 2006 through December 31, 2006, to review the current status of the Agreement and compliance with the Agreement by Joint Stock Company Severstal (Severstal). For the reasons stated in this notice, the Department preliminarily determines that Severstal is in compliance with the Agreement. The preliminary results are set forth in the section titled ``Preliminary Results of Review,'' infra. Interested parties are invited to comment on these preliminary results. Parties who submit comments are requested to provide: (1) a statement of the issues, and (2) a brief summary of the arguments.

EDA's mission is to lead the federal economic development agenda by promoting innovation and competitiveness, preparing American regions for growth and success in the worldwide economy. As part of this mission, EDA administers the Trade Adjustment Assistance for Firms (TAAF) Program under the Trade Act of 1974, as amended, through a national network of eleven Trade Adjustment Assistance Centers (each, a TAAC) to provide technical assistance to firms that have lost domestic sales and employment due to increased imports of similar or competitive goods. This program announcement applies only to the current eleven EDA-funded TAACs, and provides information necessary to clarify the requirements for operating and providing technical assistance to trade- impacted firms as a TAAC under a cooperative agreement with EDA for fiscal years 2008-2010. This notice does not solicit new applications for TAAC operators.

We, the National Marine Fisheries Service (NMFS), propose to designate critical habitat for elkhorn (Acropora palmata) and staghorn (A. cervicornis) corals, which we listed as threatened under the Endangered Species Act of 1973, as amended (ESA), on May 9, 2006. Four specific areas are proposed for designation: the Florida unit, which comprises approximately 3,301 square miles (8,671 sq km) of marine habitat; the Puerto Rico unit, which comprises approximately 1,383 square miles (3,582 sq km) of marine habitat; the St. John/St. Thomas unit, which comprises approximately 121 square miles (313 sq km) of marine habitat; and the St. Croix unit, which comprises approximately 126 square miles (326 sq km) of marine habitat. We propose to exclude one military site, comprising approximately 47 square miles (123 sq km), because of national security impacts. We are soliciting comments from the public on all aspects of the proposal, including our identification and consideration of the positive and negative economic, national security, and other relevant impacts of the proposed designation, and the areas we propose to exclude from the designation. A draft impacts report prepared pursuant to section 4(b)(2) of the ESA in support of this proposal is also available for public review and comment.

The Department of Commerce (``the Department'') is currently conducting the 2006-2007 administrative and new shipper reviews of the antidumping duty order on brake rotors from the People's Republic of China (``PRC''). We preliminarily determine that sales have not been made below normal value (``NV'') with respect to certain exporters who participated fully and are entitled to a separate rate in the administrative or new shipper reviews. If these preliminary results are adopted in our final results of these reviews, we will instruct U.S. Customs and Border Protection (``CBP'') to assess antidumping duties on entries of subject merchandise during the period of review (``POR'') for which the importer-specific assessment rates are above de minimis. Interested parties are invited to comment on these preliminary results. We will issue the final results no later than 120 days from the date of publication of this notice.
International Code Council: The Update Process for the International Codes

The International Code Council (ICC), under whose auspices the International Codes (``I-Codes'') are developed, maintains a process for updating these model codes based on receipt of proposals from interested individuals and organizations. Each of the I-Codes are comprehensively updated and re-published every three years with a supplement released between each edition. The most current versions of the I-Codes are the 2006 editions and the 2007 supplements to the 2006 editions. The 2009 editions of the I-Codes, the subject of this notice, will be released in the first quarter of 2009. The purpose of this notice is to invite public participation in the Code Development Hearings. At this session, all proposed changes submitted for the family of the 2009 I-Codes will be considered by the respective Code Development Committees, with the assembled body of the International Code Council members also afforded the opportunity to vote via an assembly action. Proposals for consideration at these hearings were received by the August 20, 2007, deadline and were made publically available as an electronic document on November 7, 2007, and as a printed Monograph on December 18, 2007. The publication of this notice by the National Institute of Standards and Technology (NIST) on behalf of ICC is being undertaken as a public service. NIST does not necessarily endorse, approve, or recommend any of the codes or standards referenced in the notice. Session Dates: The Code Development Hearings of the 2007/2008 Code Development Cycle will occur between February 18 and March 1, 2008, at the Palm Springs Convention Center in Palm Springs, California. On November 5, 2007, the Bureau of Industry and Security published a final rule that amended the Export Administration Regulations (EAR) to implement the agreement reached at the December 2006 plenary meeting of the Wassenaar Arrangement on Export Controls for Conventional Arms and Dual-Use Goods and Technologies. The November 5 final rule contained errors in Parts 742 and 744, and Categories 1, 3, 6 and 7 on the Commerce Control List. This rule corrects those errors. In addition, the November 5th rule indirectly affected an item of the list of eligible items for Authorized Validated End-User (VEU) Applied Materials China, Ltd. This rule corrects that item listing to harmonize with revisions of the November 5th rule.
