Persulfates From the People's Republic of China: Final Results of Antidumping Duty Administrative Review

We invited interested parties to comment on our preliminary results. Based on our analysis of the comments received, we have made certain changes to our calculations. The final weighted-average dumping margin for this review is listed in the ``Final Results of Review'' section below.
Stainless Steel Sheet and Strip in Coils from Italy: Preliminary Results of Countervailing Duty Changed Circumstances Review and Intent to Revoke Order

On January 4, 2006, in response to a request by domestic producers of the subject merchandise, the Department of Commerce (``the Department'') published a notice of initiation of a changed circumstances review of the countervailing duty order on stainless steel plate in coils, as described below. See Stainless Steel Sheet and Strip in Coils from Italy: Initiation of Countervailing Duty Changed Circumstances Review and Notice of Consideration of Revocation of Order, 71 FR 329 (January 4, 2006) (``Initiation Notice''). In the Initiation Notice, we invited interested parties to comment on the Department's initiation and the proposed revocation of the countervailing duty order on stainless steel sheet and strip in coils from Italy. We did not receive any comments. Absent any comments, we preliminarily conclude that producers accounting for substantially all of the production of the domestic like product to which this order pertains lack interest in the relief provided by the order. Therefore, we preliminarily revoke this order, in whole, with respect to products entered, or withdrawn from warehouse, for consumption on or after November 17, 1998, i.e., the publication date of the Department's preliminary determination in the underlying investigation, because domestic parties have expressed no interest in the continuation of the order. See Preliminary Affirmative Countervailing Duty Determination and Alignment of Final Countervailing Duty Determination with Final Antidumping Duty Determination: Stainless Steel Sheet and Strip in Coils from Italy, 63 FR 63900 (November 17, 1998) (``Preliminary Determination''). Unless the Department receives opposition from domestic producers whose production totals more than 15 percent of the domestic like product, the Department will revoke the order on stainless steel sheet and strip in coils in the final results of this review.

The National Voluntary Laboratory Accreditation Program (NVLAP) and National Institute of Standards and Technology (NIST) Personal Identity Verification Program (NPIVP) will hold a public workshop on March 3, 2006, at NIST headquarters in Gaithersburg, MD. The purpose of the workshop is the exchange of information among NVLAP, laboratories interested in seeking accreditation for the testing of Personal Identity Verification (PIV) components, vendors interested in having their product NPIVP-certified and Federal agencies seeking NPIVP certified products. The workshop will also review the mandates of Homeland Security Presidential Directive (HSPD) 12, as well as Federal Information Processing Standard (FIPS) 201, Standard for Personal Identity Verification of Federal Employees and Contractors, and the associated Special Publications (SP) in general and more specific in relation to NVLAP, interested laboratories, vendors and Federal agencies. The results of the workshop discussions will be used in the development of the NVLAP Personal Identity Verification (PIV) Laboratory Accreditation Program (PIV LAP). There is no charge for the workshop; however, because of security regulations, advance registration is mandatory. There will be no on- site, same-day registration. On August 10, 2005, the Department of Commerce (the Department) published in the Federal Register its preliminary results of administrative review of the countervailing duty order on polyethylene terephthalate film, sheet, and strip from India for the period January 1, 2003, through December 31, 2003. See Notice of Preliminary Results and Rescission in Part of Countervailing Duty Administrative Review: Polyethylene Terephthalate Film, Sheet, and Strip from India, 70 FR 46483 (August 10, 2005) (Preliminary Results). The Department has now completed this administrative review in accordance with section 751(a) of the Tariff Act of 1930, as amended (the Act). Based on information received since the Preliminary Results and our analysis of the comments received, the Department has revised the net subsidy rates for Jindal Polyester Limited/Jindal Poly Films Limited of India (Jindal) and Polyplex Corporation Ltd. (Polyplex), as discussed in the ``Memorandum from Stephen J. Claeys, Deputy Assistant Secretary, to David M. Spooner, Assistant Secretary for Import Administration concerning the Final Results of Countervailing Duty Administrative Review: Polyethylene Terephthalate Film, Sheet, and Strip from India'' (Decision Memorandum) dated concurrently with this notice and hereby adopted by this notice. On August 29, 2005, the Department of Commerce (the Department) published in the Federal Register a notice announcing the initiation of an administrative review of the antidumping duty order on stainless steel sheet and strip in coils (SSSSC) from Japan. See Initiation of Antidumping and Countervailing Duty Administrative Reviews and Requests for Revocation in Part, 70 FR 51009 (Initiation Notice). The period of review (POR) is July 1, 2004 to June 30, 2005. We are preliminarily rescinding this review because there were no entries of SSSSC for consumption in the United States during the POR that are subject to review.

Notice of Final Results of the Eleventh Administrative Review of the Antidumping Duty Order on Certain Corrosion-Resistant Carbon Steel Flat Products from the Republic of Korea

On September 7, 2005, the Department of Commerce (the Department) published the Preliminary Results of the antidumping duty administrative review for certain corrosion-resistant carbon steel flat products (CORE) from the Republic of Korea (Korea). See Certain Corrosion-Resistant Carbon Steel Flat Products from Korea: Notice of Preliminary Results and Partial Rescission of Antidumping Duty Administrative Review, 70 FR 53153 (September 7, 2005) (Preliminary Results). This review covers five manufacturers and exporters of the subject merchandise: Union Steel Manufacturing Co., Ltd. (Union); Pohang Iron & Steel Company, Ltd. (POSCO) and Pohang Coated Steel Co., Ltd. (POCOS) (collectively, the POSCO Group); Hyundai HYSCO (HYSCO); Dongbu Steel Co., Ltd. (Dongbu) (collectively, respondents); and Dongshin Special Steel Co., Ltd. (Dongshin). The period of review (POR) is August 1, 2003, through July 31, 2004. As a result of our analysis of the comments received, these final results differ from the Preliminary Results. For our final results, we have found that during the POR, the POSCO Group, Union and Dongbu sold subject merchandise at less than normal value (NV). We have also found that HYSCO did not make sales of the subject merchandise at less than NV (i.e., it has a zero or de minimis dumping margin). Regarding Dongshin, because it failed to respond to the Department's questionnaire, we have preliminarily determined to resort to adverse facts available and assigned to Dongshin the ``All Others'' rate in effect for this order (17.70 percent), which is the highest margin upheld in this proceeding. See Preliminary Results at 53155-56. Since the publication of the Preliminary Results, we have not received any comments regarding Dongshin from interested parties that would warrant reconsideration of our finding. Therefore, we have continued to assign a rate of 17.70 percent to Dongshin. The final results are listed in the ``Final Results of Review'' section below. Furthermore, we rescinded the request for review of the antidumping order for SeAH Steel Corporation (SeAH) because neither SeAH nor its affiliates had exports or sales of subject merchandise to the United States during the POR. For more information, see Preliminary Results at 53154.
Continuation of Antidumping and Countervailing Duty Orders: Fresh and Chilled Atlantic Salmon from Norway

Stainless Steel Sheet and Strip in Coils From Taiwan; Final Results and Partial Rescission of Antidumping Duty Administrative Review

This review covers 16 manufacturers/exporters. The period of review (POR) is July 1, 2003, through June 30, 2004. We provided interested parties with an opportunity to comment on the preliminary results of review. After analyzing the comments received, we made changes to the margin calculations for two respondents, Chia Far Industrial Factory Co., Ltd. (Chia Far) and Yieh United Steel Corporation (YUSCO). Therefore, the final results of review differ from the preliminary results of review. The final weighted-average dumping margins for the reviewed firms are listed below in the section entitled ``Final Results of Review.''
Atlantic Highly Migratory Species; Atlantic Swordfish Quotas

NMFS proposes to amend the regulations governing the North and South Atlantic swordfish fisheries to modify the North and South Atlantic Swordfish quotas for the 2005 fishing year (June 1, 2005, through May 31, 2006) to account for updated landings information from the 2003 and 2004 fishing years. This action is necessary to ensure that current quotas are based on the most recent landings information and account for any underharvest from previous fishing years, consistent with the regulations at 50 CFR part 635. Additionally, this action proposes to implement a subsequent recommendation by the International Commission for the Conservation of Atlantic Tuna (ICCAT) (Recommendation 04-02), which extends the 2005 North Atlantic swordfish management measures. The recommendation specifies that the extension of the 2005 North Atlantic swordfish quota is through the 2006 fishing year, but this proposed action would extend the 2005 North Atlantic swordfish management measures until ICCAT provides a recommendation for a new U.S. allocation of the North Atlantic swordfish total allowable catch. ICCAT's Standing Committee for Research and Statistics (SCRS) plans to conduct a stock assessment for North Atlantic swordfish in 2006. If the stock assessment is completed as anticipated, ICCAT intends to review the results during the Fall 2006 meeting and develop new management recommendations. In the event that ICCAT does not recommend a new U.S. allocation, this action proposes to extend the 2005 North Atlantic swordfish management measures until such time as ICCAT provides the recommendation.

NMFS announces the receipt of applications, and the intent to issue EFPs for vessels participating in an observation program to monitor the incidental take of salmon and groundfish in the shore-based component of the Pacific whiting fishery. The EFPs are necessary to allow trawl vessels fishing for Pacific whiting to delay sorting their catch, and thus to retain prohibited species and groundfish in excess of cumulative trip limits, until the point of offloading. These activities are otherwise prohibited by Federal regulations.

The Assistant Administrator for Fisheries (AA), NOAA, announces temporary restrictions consistent with the requirements of the ALWTRP's implementing regulations. These regulations apply to lobster trap/pot and anchored gillnet fishermen for 15 days in an area southeast of Portland, ME, totaling approximately 886 nm\2\ to 1,569 nm\2\ (3,039 km\2\ to 5,382 km\2\), depending on the temporal and spatial overlap with two other DAM zones currently in effect. The two other overlapping DAM zones are in effect from 0001 hours February 3, 2006 through 2400 hours February 17, 2006,and from 0001 hours February 10, 2006, through 2400 hours February 24, 2006. The purpose of this action is to provide protection to an aggregation of northern right whales (right whales).

NMFS announces that the directed fishery for Loligo squid in the Exclusive Economic Zone (EEZ) will be closed effective 0001 hours, February 13, 2006. Vessels issued a Federal permit to harvest Loligo squid may not retain or land more than 2,500 lb (1,134 kg) of Loligo squid per trip for the remainder of the quarter (through March 31, 2006). This action is necessary to prevent the fishery from exceeding its Quarter I quota and to allow for effective management of this stock.

The final judgment in this case was not in harmony with the Department's April 2002 Final Results.

On November 2, 2005, NMFS published a proposed rule to revise current critical habitat (CH) under the Endangered Species Act of 1973 (ESA) for the northern right whale (Eubalaena glacialis) by designating areas within the North Pacific Ocean. Two areas are proposed for designation: an area in the southeast Bering Sea and a second area in the Gulf of Alaska south of Kodiak Island. In response to a request, a public hearing on this proposed rule will be held on March 2, 2006, in Anchorage, AK.

The review covers one producer of the subject merchandise. The period of review (POR) is September 1, 2003, through August 31, 2004. Based on our analysis of comments received, these final results differ from the preliminary results. The final results are listed below in the Final Results of Review section.

Pursuant to section 751(c) of the Tariff Act of 1930, as amended (the Act), the International Trade Commission (ITC), in its sunset review, determined that revocation of the antidumping duty (AD) order on certain internal combustion forklift trucks (forklifts) from Japan would not be likely to lead to continuation or recurrence of material injury to an industry in the United States within a reasonably foreseeable time. See Internal Combustion Industrial Forklift Trucks from Japan, 71 FR 5070 (January, 31 2006) (ITC Determination). Therefore, pursuant to section 751(d)(2) of the Act and 19 CFR 351.222(i)(1)(iii), the Department is revoking the AD order on forklifts from Japan.

On September 8, 2005, the Department of Commerce (``the Department'') published the preliminary results of the administrative review of the antidumping duty order on certain cut-to-length carbon steel plate from Romania. The review covers Mittal Steel Galati, S.A. (``Mittal Steel'', formerly Ispat Sidex S.A.) a manufacturer of the subject merchandise, and Metalexportimport SA (``MEI''), an unaffiliated exporter. The period of review is August 1, 2003, through July 31, 2004. This administrative review also covers additional producers/exporters of the subject merchandise: Metanef, S.A. (``Metanef''), MINMET S.A. (``MINMET''), CSR SA Resita (``CSR'') and Combinatul de Oteluri Speciali Tirgoviste (``COST''), for which the Department is now finally rescinding this review because these producers/exporters, with the exception of CSR, did not ship subject merchandise during the period of review (``POR''). With respect to CSR, Nucor Corporation (``Nucor''), a petitioner in this proceeding, filed a timely request for withdrawal of the administrative review for this company.

NMFS is opening directed fishing for sablefish with fixed gear managed under the Individual Fishing Quota (IFQ) Program. The season will open 1200 hrs, Alaska local time (A.l.t.), March 5, 2006, and will close 1200 hrs, A.l.t., November 15, 2006. This period is the same as the 2006 IFQ and Community Development Quota season for Pacific halibut adopted by the International Pacific Halibut Commission (IPHC). The IFQ halibut season is specified by a separate publication in the Federal Register of annual management measures.

NMFS announces that the Administrator, Northeast (NE) Region, NMFS (Regional Administrator), is implementing a yellowtail flounder trip limit of 1,500 lb (680.4 kg) per day, up to a maximum of 15,000 lb (6,804.1 kg) per trip, for NE multispecies Days-at-Sea (DAS) vessels fishing in both the Western and Eastern U.S./Canada Areas. This action is required by the regulations enacting Amendment 13 to the NE Multispecies Fishery Management Plan and is necessary to prevent the GB yellowtail flounder total allowable catch (TAC) from being caught before the end of the 2005 fishing year and to increase the likelihood that the GB yellowtail TAC will be available through the end of the 2005 fishing year on April 30, 2006. This action is being taken to slow the rate of harvest of GB yellowtail flounder under the authority of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson- Stevens Act).

This notice announces that anyone entering the charter sport fishery for Pacific halibut in and off Alaska after December 9, 2005 (control date) will not be assured of future access to that fishery if a management regime that limits the number of participants is developed and implemented under the authority of the Northern Pacific Halibut Act of 1982 (Halibut Act). This notice is necessary to publish the intent of the North Pacific Fishery Management Council (Council) that participation credit may not be granted for operating in the charter halibut fishery if initial entry into the fishery occurs after the control date. This notice is intended to promote public awareness of a potential eligibility criterion for future access to the charter halibut resource, and to discourage new entrants into the charter halibut fishery while the Council discusses whether and how access to the halibut resource by the charter sport fishery should be controlled. This announcement does not prevent any other date for eligibility in the fishery or another method of controlling fishing effort from being proposed and implemented.
