Fisheries of the Northeastern United States; Summer Flounder Fishery; Commercial Quota Harvested for New York

NMFS announces that the 2005 summer flounder commercial quota available to New York has been harvested and is announcing the closure of summer flounder in Federal waters. Vessels issued a commercial Federal fisheries permit for the summer flounder fishery may not land summer flounder in New York for the remainder of calendar year 2005, unless additional quota becomes available through a transfer. Regulations governing the summer flounder fishery require publication of this notification to advise New York of the closure and to advise vessel permit holders and dealer permit holders that no commercial quota is available for landing summer flounder in New York.

NMFS issues this final rule amending Table 2 to 50 CFR part 679. Table 2 is the source for species codes used in data collection, analysis, and monitoring of the Federal groundfish fisheries. This action is necessary to standardize collection of species information with the State of Alaska Department of Fish and Game (ADF&G), increase effectiveness of rockfish management, reflect current fisheries management interest in skates, and promote better enforcement of rockfish regulations. This final rule is intended to meet the conservation and management requirements of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) with respect to groundfish and to further the goals and objectives of the Alaska groundfish fishery management plans.

In response to requests from interested parties, the Department of Commerce (the Department) is conducting the third administrative review of the antidumping duty order on honey from the People's Republic of China (PRC). The period of review (POR) is December 1, 2003, through November 30, 2004. One named respondent company had no exports or sales of the subject merchandise during the POR; therefore, we are preliminarily rescinding our review of this company. We preliminarily determine that two companies have failed to cooperate by not acting to the best of their ability to comply with our requests for information and, as a result, should be assigned a rate based on adverse facts available. Finally, we have preliminarily determined that five respondents made sales to the United States of the subject merchandise at prices below normal value. We invite interested parties to comment on these preliminary results. Parties that submit comments are requested to submit with each argument (1) a statement of the issue and (2) a brief summary of the argument(s).

NMFS has determined that the Atlantic bluefin tuna (BFT) General category daily retention limit for three of the previously designated restricted fishing days (RFD) for December should be adjusted. These General category RFDs are being waived to provide reasonable opportunity for utilization of the coastwide General category BFT quota. Therefore, NMFS waives three RFDs in December and increases the daily retention limit from zero to two large medium or giant BFT on these previously designated RFDs.

On November 7, 2005, the Department of Commerce (``the Department'') published its affirmative preliminary determination in this proceeding. See Notice of Preliminary Determination of Sales at Less Than Fair Value: Certain Artist Canvas from the People's Republic of China, 70 FR 67412 (November 7, 2005) (``Preliminary Determination''). While the Department did not receive any allegations of ministerial errors in the Preliminary Determination, the Department inadvertently stated an inaccurate manufacturer/producer name in the provided combination rate, and inadvertently failed to include one combination rate. In the Preliminary Determination, the Department stated it would calculate combination rates for certain respondents that are eligible for a separate rate in this investigation. Thus, we granted Jiangsu Animal By-products Import & Export Group Corp. (``Jiangsu By- products'') (i.e., a separate rate applicant) a separate rate and calculated a combination rate for Jiangsu By-products. However, in our Weighted-Average Dumping Margins section, the Department inadvertently stated an inaccurate manufacturer/producer name in the provided combination rate for Jiangsu By-products, and inadvertently failed to include one combination rate for Jiangsu By-products. Therefore, we are correcting the Weighted-Average Dumping Margins section to include the additional combination rate and to correct the manufacturer/producer name.

On September 28, 2005, the U.S. Department of Commerce (``the Department'') published a notice of initiation of an administrative review of the antidumping duty order on small diameter seamless carbon and alloy steel standard, line and pressure pipe (``seamless line and pressure pipe'') from Argentina. The review covers one manufacturer/ exporter, Siderca S.A.I.C. The period of review (``POR'') is August 1, 2004, through July 31, 2005. Following the receipt of a certification of no shipments by Siderca S.A.I.C., we notified interested parties of the Department's intent to rescind this review and provided an opportunity for parties to comment on the rescission. We received no comments. Therefore, we are rescinding this administrative review.

The goal of the Undergraduate Scholarship Program is to increase the number of students who undertake course work and graduate with degrees in the targeted areas integral to NOAA's mission. This program targets students who have completed their sophomore year; attend Minority Serving Institutions; majoring in mathematics, science, or engineering; and have recently declared, or about to declare a major in atmospheric, oceanic, remote sensing technology, or environmental science disciplines. The Undergraduate Scholarship participants must be U.S. citizens and attend an MSI including Hispanic Serving Institutions, Historically Black Colleges and Universities, Tribal College and Universities, Alaska-Native Serving Institutions, and Native Hawaiian Serving Institutions full-time, be pursuing studies in atmospheric science, biology, cartography, chemistry, computer science, engineering, environmental science, geodesy, geography, marine science, mathematics, meteorology, physical science, oceanography, marine biology, photogrammetry, or physics. Participants must have, and maintain, a minimum 3.0 grade point average.

NOAA's Environmental Entrepreneurship Program is soliciting proposals that support environmental revitalization projects. Projects should engage students at MSIs in hands-on training and experiential learning opportunities in the application of NOAA science and business acumen. The program's objective is to increase the number of students proficient in environmental business enterprises. For the purposes of this program, Environmental Business Enterprises is defined as applying skills and techniques in the development and operations of businesses that resolve environmental degradation in local communities. The process involves engaging students in the application of business skills and best management science techniques that will enable students to gain practical experience in resolving environmental degradation in their local communities. Students are expected to learn how to transform business concepts into innovative products or services that support environmental business enterprises. This is achieved through community-based collaborative processes. It is expected that three cooperative agreement awards will be funded in fiscal year 2006. Eligible MSIs may apply for a maximum of $200,000, on a competitive basis, to support environmental revitalization projects, for a two or three-year period. The total funding available is $600,000, subject to Congressional appropriations. The program's vision is an increased number of students at MSIs proficient in environmental business enterprises that advance DOC/ NOAA's mission. Successful programs will build the institution's capacity to train students in developing and operating businesses in local communities where there is a need to sustain or revitalize naturally depleted environments.

The purpose of this document is to advise the public that NOAA's Educational Partnership Program is soliciting not-for-profit organizations to administer its EPP Graduate Sciences Program. The goal of the Graduate Sciences Program is to provide college graduates who have received at least a Bachelor's degree in mathematics, science, economics, law, and engineering, entry-level employment and hands-on research and work experience at NOAA. The program's objective is to increase the number of students who undertake course work and graduate with degrees in the targeted areas integral to NOAA's mission. The goal of the NOAA EPP/MSI Graduate Sciences Program (GSP) is aimed primarily at increasing opportunities and available programs for students in NOAA related fields to pursue research and graduate level educational training in atmospheric, environmental, and oceanic sciences at Minority Serving Institutions (MSI) when possible. All students are competitively selected for positions in NOAA offices and facilities. Participants must be U.S. citizens, have a Bachelor's degree in mathematics, science, law, or engineering, and have, and maintain, a minimum G.P.A. of 3.0 or higher prior to and for the duration of their training. Prior to acceptance into the program, students must be enrolled in an accredited graduate school and obtain a letter of recommendation by a school official. This two-year program provides for formal periods of work, study, and structured classroom training programs in meteorology, hydrology, cartography, oceanography, ecology, remote sensing technology, environmental science and planning, marine science, fisheries biology, computer science, and environmental law. GSP pays for tuition, books, lab fees, campus housing allowance, travel expenses, and salary during 16 weeks of NOAA work experience per year at a NOAA research facility. NOAA scientists are assigned as mentors to graduate scientists during the training period. The progress of the students is monitored throughout the academic year and during the intermittent career work experiences. Under the program, graduate students are required to present their research at conferences, scientific meetings and workshops, education and science forums, etc. The program requires that students participate in an orientation program at NOAA Headquarters in Silver Spring, Maryland, at the beginning of their appointment.

On November 14, 2005, the Economic Development Administration (``EDA'') published a final rule in the Federal Register delaying the effective date, from November 14, 2005 until January 31, 2006, of certain provisions of EDA's interim final rule originally published in the Federal Register on August 11, 2005. EDA is publishing this final rule to revoke the November 14, 2005 final rule. The conference report accompanying the FY 2006 Science, State, Justice, Commerce and Related Agencies Appropriations Act expresses Congressional intent as to specific changes to EDA's August 11, 2005 interim final rule. The changes specified in the conference report include changes to those provisions of the August 11, 2005 interim final for which the effective date was delayed by the final rule published on November 14, 2005. Concurrent with the publication of this final rule, EDA is publishing in the Federal Register an interim final rule to effect those changes to the August 11, 2005 interim final rule specified in the conference report. No. 03-00202 (October 21, 2005) (available at https://www.ia.ita.doc.gov) (``Second Remand Results''); see also, Globe Metallurgical, Inc. v. United States, Slip Op. 05-150 (CIT November 28, 2005) (``Globe Metallurgical III''). In the First Remand Results, the Department recalculated the antidumping margins for Bratsk Aluminum Smelter and Rual Trade Limited (collectively, ``Bratsk'') and ZAO Kremny and SUAL-Kremny-Ural Ltd. (collectively, ``Kremny'') to value the respondents' usage of recycled silicon metal sized zero to five millimeters. See Final Results of Redetermination Pursuant to Court Remand, Globe Metallurgical, Inc. v. United States, Consol. Ct. NMFS has decided not to initiate the rulemaking requested by the North Carolina Department of Environment and Natural Resources, Division of Marine Fisheries (Petitioner), to amend the current time/ area closure for Atlantic sharks off the Mid-Atlantic region. NMFS does not have any new information to support the Petitioner's proposal of a closure inside of 15 fathoms along the North Carolina coast nor the assertion that such a closure would still attain the management goal of protecting juvenile sandbar and prohibited dusky sharks. NMFS will consider new information concerning the impacts of the current time/area closure (which has been in place for one time period from January 1 to July 31, 2005) and the results of upcoming large coastal shark (LCS) and dusky shark stock assessments to determine whether changes to the time/area closure are appropriate. In addition, NMFS will monitor any changes to shark regulations by coastal states and will continue to work with the Atlantic States Marine Fisheries Commission (ASMFC) in terms of development of an interstate shark plan, which may warrant a review of existing Federal regulations and consideration of further changes to the time/area closure.

On October 20, 2005, in Slater Steels Corp. v. United States, Consol. Court No. 02-00551, Slip Op. 05-137 (CIT October 20, 2005) (``Slater III''), a lawsuit challenging the Department of Commerce's (``the Department'') Notice of Amended Final Results of Antidumping Duty Administrative Review: Stainless Steel Bar from India, 67 FR 53336 (August 15, 2002) (``Final Results'') and the accompanying Issues and Decision Memorandum (July 5, 2002) (``Decision Memorandum''), the Court of International Trade (``CIT'') affirmed the Department's third remand determination and entered a judgment order. In the remand determination, the Department did not collapse Viraj Alloys Limited (``VAL'') with Viraj Impoexpo Limited (``VIL'') and Viraj Forgings Limited (``VFL''). The Department calculated an individual antidumping duty margin for VIL/VFL. The Department did not calculate an individual antidumping duty margin for VAL because it did not export the subject merchandise to the United States during the period of review. The resulting antidumping duty margin for VIL/VFL is 0.84 percent. Consistent with the decision of the U.S. Court of Appeals for the Federal Circuit (``Federal Circuit'') in Timken Co. v. United States, 893 F.2d 337 (Fed. Cir. 1990) (``Timken''), the Department will continue to order the suspension of liquidation of the subject merchandise until there is a ``conclusive'' decision in this case. If the case is not appealed, or if it is affirmed on appeal, the Department will instruct the U.S. Customs and Border Protection (``CBP'') to liquidate all relevant entries of subject merchandise for VIL/VFL.

NMFS announces that it is considering, and seeking public comment on the implementation of further minimum carapace length (gauge) increases and escape vent size increases in the Federal lobster fishery, consistent with recommendations for Federal action in the Atlantic States Marine Fisheries Commission's (Commission) Interstate Fishery Management Plan for American Lobster (ISFMP). NMFS would issue these regulations according to its authority under the Atlantic Coastal Fisheries Cooperative Management Act (ACFCMA). While a September 2, 2005, proposed rule considered gauge increases and escape vent size increases as scheduled through 2004 in Addenda II and III to Amendment 3 of the ISFMP, the proposed rule did not address; additional gauge increases scheduled annually from 2005 through 2008 in Lobster Conservation Management Areas (LCMA) 3 and the Outer Cape Lobster Conservation Management Area (OCLCMA), an increase to the escape vent size in LCMA 3 and the OCLCMA scheduled for 2008, and an escape vent size increase for LCMA 1 scheduled for 2007. Accordingly, NMFS is seeking written public comments on these additional gauge and escape vent size requirements as set forth in the ISFMP and recommended for Federal implementation by the Commission.

NMFS issues this final rule to implement Amendment 6 to the Fishery Management Plan for the Shrimp Fishery of the South Atlantic Region (FMP), as prepared and submitted by the South Atlantic Fishery Management Council (Council). This final rule requires an owner or operator of a trawler that harvests or possesses penaeid shrimp (brown, pink, or white shrimp) in or from the exclusive economic zone (EEZ) off the southern Atlantic states to obtain a commercial vessel permit for South Atlantic penaeid shrimp; requires an owner or operator of a vessel in the South Atlantic rock shrimp or penaeid shrimp fishery to submit catch and effort reports and to carry an observer on selected trips; and requires bycatch reduction devices (BRDs) in nets in the rock shrimp fishery. In addition, this final rule removes provisions of the regulations applicable to other fisheries off the southern Atlantic states that are no longer applicable and makes minor corrections. Amendment 6 also establishes stock status determination criteria for South Atlantic penaeid shrimp; revises the specifications of maximum sustainable yield (MSY) and optimum yield (OY) for South Atlantic rock shrimp; revises the stock status determination criteria for South Atlantic rock shrimp; revises the bycatch reduction criterion for the certification of BRDs; and transfers from the Council to the Regional Administrator, Southeast Region, NMFS (RA), responsibilities for the specification of the protocol for testing BRDs. In addition, NMFS informs the public of the approval by the Office of Management and Budget (OMB) of the collection-of-information requirements contained in this final rule and publishes the OMB control numbers for those collections. The intended effects of this rule are to provide additional information for, and improve the effective management of, the shrimp fisheries off the southern Atlantic states and to correct and clarify the regulations applicable to other southern Atlantic fisheries.

NMFS is considering whether to propose regulations to protect wild spinner dolphins (Stenella longirostris) in the main Hawaiian Islands from ``take,'' as defined in the Marine Mammal Protection Act (MMPA) and its implementing regulations, or to otherwise adversely affect the dolphins. The scope of this advance notice of proposed rulemaking (ANPR) encompasses the activities of any person or conveyance that may result in the unauthorized taking of spinner dolphins and/or that may diminish the value to the dolphins of habitat routinely used by them for resting and/or that may cause detrimental individual-level and population-level impacts. The proposed regulation would apply only to the main Hawaiian Islands and only to spinner dolphins.
