This notice advises the public that the National Institute of Standards and Technology (NIST) is seeking comments for the proposed revision of Voluntary Product Standard (PS) 20-20, ``American Softwood Lumber Standard.'' This standard, prepared by the American Lumber Standard Committee, serves the procurement and regulatory needs of numerous Federal, State, and local government agencies by providing for uniform, industry-wide grade-marking and inspection requirements for softwood lumber. The implementation of the standard also allows for uniform labeling and auditing of treated wood and, through a Memorandum of Understanding with the U.S. Department of Agriculture, labeling and auditing of wood packaging materials for international trade. As part of a five-year review process, NIST is seeking public comment and invites interested parties to review the revised standard and submit comments.

In a Request for Information (RFI) that published in the Federal Register on September 7, 2023, NIST requested information on behalf of the U.S. Department of Commerce and the U.S. Government to support the development of an implementation plan for the United States Government National Standards Strategy for Critical and Emerging Technology (USG NSSCET). The USG NSSCET is intended to support and complement existing private sector-led activities and plans, including the American National Standards Institute (ANSI) United States Standards Strategy (USSS), with a focus on critical and emerging technology(ies) (CET). The USG NSSCET reinforces the U.S. Government's support of a private sector-led, open, consensus-based international standards system, corresponding to the World Trade Organization (WTO) Technical Barriers to Trade (TBT) Committee decision that articulates and elaborates on principles that are fundamental to the development of an international standards: transparency; openness; impartiality and consensus; effectiveness and relevance; and coherence. To inform the USG NSSCET implementation, including how to best partner with relevant stakeholders, NIST is requesting information that will support the identification and prioritization of key activities that will optimize the USG NSSCET implementation and further enhance the U.S. Government's ability to support a private sector-led, open, consensus-based international standards system, to which the U.S. Government is an active stakeholder and participant.

The National Institute of Standards and Technology (NIST), an agency of the United States Department of Commerce, in support of efforts to create safe and trustworthy artificial intelligence (AI), is establishing the Artificial Intelligence Safety Institute Consortium (``Consortium''). The Consortium will help equip and empower the collaborative establishment of a new measurement science that will enable the identification of proven, scalable, and interoperable techniques and metrics to promote development and responsible use of safe and trustworthy AI, particularly for the most advanced AI systems, such as the most capable foundation models. NIST invites organizations to provide letters of interest describing technical expertise and products, data, and/or models to enable the development and deployment of safe and trustworthy AI systems through the AI Risk Management Framework (AI RMF). This notice is the initial step for NIST in collaborating with non-profit organizations, universities, other government agencies, and technology companies to address challenges associated with the development and deployment of AI. Many of these challenges were identified under the Executive Order of October 30, 2023 (The Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence) and the NIST AI RMF Roadmap. Much of this research will center on evaluations of and approaches towards safer, more trustworthy AI systems. Participation in the consortium is open to all interested organizations that can contribute their expertise, products, data, and/or models to the activities of the consortium. Selected participants will be required to enter into a consortium Cooperative Research and Development Agreement (CRADA) with NIST. At NIST's discretion, entities which are not permitted to enter into CRADAs pursuant to law may be allowed to participate in the Consortium pursuant to separate non-CRADA agreement.

Preventing the Improper Use of CHIPS Act Funding

The CHIPS and Science Act of 2022, which amended Title XCIX of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (collectively, the CHIPS Act or Act) established an incentives program to reestablish and sustain U.S. leadership across the semiconductor supply chain. The Department of Commerce, through the National Institute of Standards and Technology, is issuing this final rule to implement conditions in the Act that seek to prevent funding provided through the program from being used to directly or indirectly benefit foreign countries of concern.
