Process for Establishing Rates for Veterinary Services User Fees
Document Number: 2022-21030
Type: Proposed Rule
Date: 2022-10-03
Agency: Department of Agriculture, Animal and Plant Health Inspection Service
We are proposing to amend the regulations concerning user fees that we charge for veterinary diagnostic services and for certain import-related and export-related services for live animals, animal products and byproducts, birds, germplasm, organisms, and vectors. We are proposing to remove the tables providing the individual fees from the regulations and post them on an Animal and Plant Health Inspection Service (APHIS) website instead. The regulations would instead specify the methodology (formula) used to calculate the fees (including imputed costs), and APHIS would update the fees using a notice-based process. Replacing the current user fee listings with a standardized methodology would increase transparency in the process of setting fee rates, align the regulations with other Departmental practices, and allow us to streamline processes and reduce the number of rules needed in order to update the fees.

Animal and Plant Health Inspection Service Indemnity Regulations
Document Number: 2022-19260
Type: Proposed Rule
Date: 2022-09-07
Agency: Department of Agriculture, Animal and Plant Health Inspection Service
We are soliciting public comment on a new approach to indemnity value determination and a new framework for the indemnity regulations. These parts address payment of indemnity for the destruction and disposition of animals the Animal and Plant Health Inspection Service (APHIS) classifies as infected with, suspect of, or exposed to diseases of concern, to eradicate and control foreign animal diseases, emerging diseases, and program diseases. The current regulations for valuing animals for the purpose of indemnification vary from species to species and, in some cases, disease to disease within a species. The new approach would harmonize how APHIS determines animal values and deals with costs associated with transportation, cleaning, disposal, and other points at which variations occur in how APHIS manages indemnity and compensation.

Based on the risk analysis, we have reached a preliminary determination that field testing this veterinary vaccine will not have a significant impact on the quality of the human environment, and that an environmental impact statement need not be prepared. We are making the environmental assessment and risk analysis available for public review and comment. We intend to authorize shipment of this vaccine for field testing following the close of the comment period for this notice unless new substantial issues bearing on the effects of this action are brought to our attention. We also intend to issue a U.S. Veterinary Biological Product license for this vaccine, provided the field test data support the conclusions of the environmental assessment and the issuance of a finding of no significant impact and the product meets all other requirements for licensing.

Importation of Sheep, Goats, and Certain Other Ruminants; Correction
Document Number: 2021-28413
Type: Rule
Date: 2022-01-03
Agency: Department of Agriculture, Animal and Plant Health Inspection Service
The Animal and Plant Health Inspection Service recently issued a final rule that was published in the Federal Register on December 3, 2021. The rule amended the regulations governing the importation of animals and animal products to revise conditions for the importation of live sheep, goats, and certain other non-bovine ruminants, and products derived from sheep and goats, with regard to transmissible spongiform encephalopathies such as bovine spongiform encephalopathy and scrapie. The final rule improperly worded an amendatory instruction that resulted in the unintentional duplication of a sentence and left an obsolete section number in the regulations for the location of the requirements for the importation of sheep and goats from Canada for immediate slaughter. This document corrects that inadvertent error and amends the regulations with the proper wording.
