The changes to the policy made in this rule are applicable for the 2018 and succeeding crop years for all crops with a contract change date on or after the effective date of the rule, and for the 2019 and succeeding crop years for all crops with a contract change date prior to the effective date of the rule.

This rule implements a recommendation from the Cherry Industry Administrative Board (Board) to establish free and restricted percentages for the 2016-17 crop year under the marketing order for tart cherries grown in the states of Michigan, New York, Pennsylvania, Oregon, Utah, Washington, and Wisconsin (order). The Board locally administers the marketing order and is comprised of producers and handlers of tart cherries operating within the production area, and a public member. This action establishes the proportion of tart cherries from the 2016 crop which may be handled in commercial outlets at 71 percent free and 29 percent restricted. These percentages should stabilize marketing conditions by adjusting supply to meet market demand and help improve grower returns.

Notice is hereby given of the intention of NRCS to issue a series of revised conservation practice standards in the National Handbook of Conservation Practices. These standards include: Anaerobic Digester (Code 366), Contour Farming (Code 330), Crosswind Ridges (Code 588), Dam (Code 402), Mulching (Code 484), Pond Sealing or Lining Geomembrane or Geosynthetic Clay Liner (Code 521), Stream Crossing (Code 578), Strip-Cropping (Code 585), Structure for Water Control (Code 587), Water and Sediment Control Basin (Code 638), Waste Recycling (Code 633), Waste Treatment Lagoon (Code 359). NRCS State Conservationists who choose to adopt these practices for use within their States will incorporate them into section IV of their respective electronic Field Office Technical Guide. These practices may be used in conservation systems that treat highly erodible land (HEL) or on land determined to be a wetland. Section 343 of the Federal Agriculture Improvement and Reform Act of 1996 requires NRCS to make available for public review and comment all proposed revisions to conservation practice standards used to carry out HEL and wetland provisions of the law.
Irish Potatoes Grown in Certain Designated Counties in Idaho, and Malheur County, Oregon; Decreased Assessment Rate

This rule implements a recommendation from the Idaho-Eastern Oregon Potato Committee (Committee) to decrease the assessment rate established for the 2017-2018 and subsequent fiscal periods from $0.0025 to $0.002 per hundredweight of potatoes handled. The Committee locally administers the marketing order which regulates the handling of potatoes grown in certain designated counties in Idaho, and Malheur County, Oregon. Assessments upon potato handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period begins August 1 and ends July 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Grapes Grown in a Designated Area of Southeastern California and Imported Table Grapes; Removing Varietal Exemptions

This proposed rule would implement a recommendation from the California Desert Grape Administrative Committee (Committee) to remove varietal exemptions from the regulations established under the California table grape marketing order (order) and the table grape import regulation (import regulation). The order regulates the handling of table grapes grown in a designated area of southeastern California and is administered locally by the Committee. The import regulation is authorized under section 8e of the Agricultural Marketing Agreement Act of 1937, as amended, and regulates the importation of table grapes into the United States. In conjunction with this proposed rule, administrative exemptions that were previously granted for other varieties of imported grapes, including those that are genetically related to the four varieties exempted under the order's regulations and import regulation, would be removed.

Notice is hereby given of the intention of NRCS to issue revisions to the State Offsite Methods (SOSM) for use in Iowa, North Dakota, Minnesota, and South Dakota. The SOSM is used in completing wetland determinations for USDA program eligibility purposes. The existing SOSM's have been in use since July 2015, NRCS is seeking comments only on the proposed revisions to these documents. The revisions are needed to clarify procedures and improve consistency in application. NRCS State Conservationists in each of these States will incorporate their revised SOSM into Section I of their respective electronic Field Office Technical Guide (FOTG). As identified in the National Food Security Act Manual these revised methods may be used for completion of wetland determinations. Section 343 of the Federal Agriculture Improvement and Reform Act of 1996 requires NRCS to make available for public review and comment all proposed revisions to methods and procedures used to carry out the Highly Erodible Land and wetland compliance provisions of the 1985 Food Security Act (as amended).

The Columbia River Gorge National Scenic Area, located in Hood River, Oregon, is proposing to charge a new standard amenity fee of $5 per vehicle per day for use of services and facilities at the Sandy River Delta site. The 1,400-acre Sandy River Delta site, acquired by the Forest Service in 1991, offers five diverse-use trails (5.25 miles total) including a 1.2-mile accessible gravel trail to the Sandy River Delta confluence and bird blind. The Forest Service provides vault toilets, trash service, picnic tables, parking for vehicles (and vehicles with horse trailers), interpretive signage, and regular patrols of the area. The proposed fee would help cover the costs of operations and maintenance of the vault toilets, trash service, septic pumping, ranger patrols, and hazard tree abatement as well as future improvements and replacement of facilities. This fee is only proposed and will be determined upon further analysis and public comment.

The Ochoco National Forest is preparing an Environmental Impact Statement (EIS) to analyze the effects of revising the 1975 Ochoco Wild and Free Roaming Herd Management Plan (Herd Management Plan). The Herd Management Plan provides guidance for managing wild, free roaming horses within the Big Summit Territory on the Lookout Mountain Ranger District. The 27,300-acre Big Summit Territory is located approximately 30 miles east of Prineville and includes Round Mountain and Duncan Butte. The 1975 Herd Management Plan set an Appropriate Management Level (AML) of 55-65 horses; the Ochoco National Forest Land and Resource Management Plan (LRMP) states horses will be managed at a maximum of 60 head. This project will revise the original Herd Management Plan to comply with the Wild Free Roaming Horse and Burro Act (WFRHBA) of 1971, as amended, and the federal regulation for management of wild and free-roaming horses and burros. The proposed action is consistent with the Ochoco National Forest Land and Resource Management Plan, as amended.

As a condition of entry, the fruit will have to be produced in accordance with a systems approach that includes requirements for fruit fly trapping, pre-harvest inspections, approved production sites, and packinghouse procedures designed to exclude quarantine pests. The fruit will also be required to be imported in commercial consignments and accompanied by a phytosanitary certificate issued by the national plant protection organization of Ecuador stating that the consignment was produced and prepared for export in accordance with the requirements of the systems approach. This action will allow for the importation of fresh pitahaya fruit from Ecuador while continuing to provide protection against the introduction of plant pests into the United States.

The Agricultural Marketing Service (AMS) of the U.S. Department of Agriculture (USDA) is proposing amendments to the United States Standards for Grades of Carcass Beef (beef standards). Specifically, AMS is proposing amendments to the beef standards that would allow dentition and documentation of actual age as additional methods of classifying maturity of carcasses presented to USDA for official quality grading. Currently, the standards include only skeletal and muscular evidence as a determination of classifying maturity of carcasses for the purposes of official USDA quality grading. Official USDA quality grading is used as an indication of meat palatability and is a major determining factor in live cattle and beef value.

The Food Safety and Inspection Service (FSIS) is announcing the availability of and requesting comments on two updated compliance guidelines for small and very small businesses. The new guidelines will assist small and very small meat and poultry establishments understand and comply with the regulatory requirements associated with the destruction of Salmonella and other pathogens (lethality) in ready-to- eat (RTE) products and the control of pathogen growth in heat-treated RTE and not-ready-to-eat (NRTE) products during cooling and hot-holding (stabilization). FSIS is including the time-temperature tables and cooling options in these guidelines that were previously in Appendices A and B, originally made available in 1999, along with new recommendations establishments can use to achieve lethality and stabilization of these products.

The Food Safety and Inspection Service (FSIS) is proposing to amend the poultry products inspection regulations to list the PRC as eligible to export to the United States poultry products from birds slaughtered in the PRC. The PRC is currently eligible to export processed poultry products to the United States if the products are derived from poultry slaughtered in the United States or in other countries eligible to slaughter and export poultry to the United States. FSIS is proposing this action because the Agency has reviewed the PRC's laws, regulations, and poultry slaughter inspection system as implemented and has determined that the PRC's poultry slaughter inspection system is equivalent to the system that the United States has established under the Poultry Products Inspection Act (PPIA) and its implementing regulations. Should this rule become final, slaughtered poultry, or parts or other products thereof, processed in certified PRC establishments, would be eligible for export to the United States. Although the PRC may be listed in FSIS's regulations as eligible to export poultry products to the United States, the products must also comply with all other applicable requirements of the United States, including those of USDA's Animal and Plant Health Inspection Service (APHIS), before any products can enter the United States. All such products would be subject to re- inspection at United States ports-of-entry by FSIS inspectors.

This final rule adjusts representation on the Cattlemen's Beef Promotion and Research Board (Board), established under the Beef Promotion and Research Act of 1985 (Act), to reflect changes in domestic cattle inventories and changes in levels of imported cattle, beef, and beef products that have occurred since the Agricultural Marketing Service (AMS) last reapportioned the Board in July 2014. These adjustments are required by the Beef Promotion and Research Order (Order) and will result in a decrease in Board membership from 100 to 99, effective with the U.S. Department of Agriculture's (USDA) appointments for terms beginning early in the year 2018.
