Revision of Land Management Plan for the Nantahala and Pisgah National Forests

As directed by the National Forest Management Act, the USDA Forest Service is preparing the Nantahala and Pisgah National Forests' revised land management plan (forest plan) and will also prepare an Environmental Impact Statement (EIS) for this revised forest plan. This notice briefly describes the nature of the decision to be made, a general proposed action based on the preliminary identified need to change the existing plan, and information concerning public participation. It also provides estimated dates for filing the EIS and the name and address of the responsible agency official and the individuals who can provide additional information. Finally, this notice identifies the applicable planning rule that will be used for completing this plan revision. The revised forest plan will supersede the existing forest plan that was approved by the Regional Forester in 1987, and significantly amended in 1994. The existing forest plan will remain in effect until the revised forest plan takes effect.

Through this Notice, USDA is announcing its intent to renew the Charter of the NOSB; the current charter expires on May 10, 2014. The USDA is also requesting nominations to fill four (4) upcoming vacancies on the NOSB. Farm Storage Facility Loan Program, Security Requirements

The Commodity Credit Corporation (CCC) is amending the Farm Storage Facility Loan (FSFL) Program regulations to increase the loan amount, for which additional security or a severance agreement is required, from $50,000 to $100,000. We are making a related change for loans secured with collateral that does not have any resale value. The purpose of these amendments is to make the loan process easier for borrowers, especially producers who may not have additional security, but are unlikely to default on a relatively small loan. Raising the threshold for which additional security is required from $50,000 to $100,000 should help more small producers qualify for a loan between $50,000 and $100,000, and will likely reduce their cost to qualify for such a loan.

This final decision proposes to permanently adopt revised transportation credit balancing fund provisions for the Appalachian and Southeast milk marketing orders. Specifically, this document Establishes a variable mileage rate factor using a fuel cost adjustor to determine the transportation credit payments of both orders; increases the transportation credit assessment rate for the Appalachian order to $0.15 per hundredweight; and establishes a zero diversion limit standard on loads of milk requesting transportation credits. Separate decisions will address the proposed adoption of an intra- market transportation credit provision for the Appalachian and Southeast orders and for increasing the transportation credit rate assessment for the Southeast order. This final decision is subject to producer approval. Producer approval for this action will be determined concurrently with amendments adopted in a separate final decision that amends the Class I pricing and other provisions of the Appalachian, Southeast, and Florida milk marketing orders.

This decision also proposes to adopt amendments that increase the maximum administrative assessment for the Appalachian, Florida and Southeast marketing orders. The Santa Fe National Forest (Forest), located in northern New Mexico, is initiating the first phase of the forest planning process pursuant to the 2012 National Forest System land management planning rule. This process will result in a revised forest land management plan (Forest Plan) which describes the strategic direction for management of forest resources on the Santa Fe National Forest for the next ten to fifteen years. The first phase of the process, the assessment phase, is beginning on the Santa Fe National Forest and interested parties are invited to contribute in the development of the assessment. The Forest will be hosting public forums throughout April and May 2014 where we will invite the public to share information relevant to the assessment including existing information, current trends, and local knowledge.

The Ochoco National Forest is preparing an environmental impact statement (EIS) to analyze the effects of managing fuels and vegetation within the 38,145-acre Gap project area, which is east of Prineville, Oregon. The project area includes National Forest System lands in the Upper North Fork Crooked River and Horse Heaven Creek- Crooked River Watersheds. The alternatives that will be analyzed include the proposed action, no action, and additional alternatives that respond to issues generated through the scoping process. The Ochoco National Forest will give notice of the full environmental analysis and decision making process so interested and affected people may participate and contribute to the final decision.
Dried Prunes Produced in California; Increased Assessment Rate

This rule increases the assessment rate established for the Prune Marketing Committee (Committee) for the 2013-14 and subsequent crop years from $0.22 to $0.28 per ton of salable dried prunes handled. The Committee locally administers the marketing order, which regulates the handling of dried prunes grown in California. Assessments upon dried prune handlers are used by the Committee to fund reasonable and necessary expenses of the program. The crop year begins August 1 and ends July 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.
Soybean Promotion, Research, and Consumer Information Program: Amendment of Procedures and Notification of Request for Referendum

This interim final rule would amend the procedures to Request a Referendum by removing the specific number of soybean producers eligible to request a referendum under the Soybean Promotion, Research, and Consumer Information program, commonly known as the Soybean Checkoff Program. The number of soybean producers will be replaced with language that allows the Secretary of Agriculture (Secretary) to update this number based on information provided by USDA. Additionally, this action would remove specific USDA and Farm Service Agency (FSA) Web site and office addresses and replace them with more flexible language. These changes will enable AMS to announce future Requests for Referendum without engaging in additional notice-and-comment rulemaking. This rule also serves as AMS' official notice that soybean producers may request a referendum to determine if producers want a referendum on the Soybean Promotion and Research Order (Order), as authorized under the Soybean Promotion, Research, and Consumer Information Act (Act). If at least 10 percent (not in excess of one- fifth of which may be producers in any one State) of eligible producers, as determined by USDA, participate in the Request for Referendum, a referendum will be held within 1 year from that determination. If results of the Request for Referendum indicate that a referendum is not supported, a referendum would not be conducted. The results of the Request for Referendum will be published in the Federal Register.

The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim rule that relaxed the minimum grade requirement under the marketing order for kiwifruit grown in California (order), and for kiwifruit imported into the United States that are shipped to the fresh market, by increasing the tolerance of kiwifruit which is ``badly misshapen'' from 7 percent to 16 percent. This change is intended to facilitate the packing of fruit to meet the minimum grade requirement of ``KAC No. 1,'' and reduce costs associated with re-sorting and repacking this grade of fruit.

Special Supplemental Nutrition Program for Women, Infants and Children (WIC): Revisions in the WIC Food Packages

This final rule considers public comments submitted in response to the interim rule revising the WIC food packages published on December 6, 2007. The interim rule implemented the first comprehensive revisions to the WIC food packages since 1980. The interim rule revised regulations governing the WIC food packages to align them more closely with updated nutrition science and the infant feeding practice guidelines of the American Academy of Pediatrics, promote and support more effectively the establishment of successful long-term breastfeeding, provide WIC participants with a wider variety of food, and provide WIC State agencies with greater flexibility in prescribing food packages to accommodate participants with cultural food preferences. This rule makes adjustments that improve clarity of the provisions set forth in the interim rule.

The Uinta-Wasatch-Cache National Forest is proposing to charge fee at The Upper Falls Picnic Site in Provo Canyon, Utah. The site will include a $6.00 Standard Amenity fee that will be charged year-round. Fees are assessed based on the level of amenities and services provided, cost of operations and maintenance, and market assessment. Funds from fees would be used for the continued operation and maintenance and improvements of this picnic area. An analysis of the nearby County, City, and Federal day-use sites with similar amenities shows that the proposed fees are reasonable and typical of similar sites in the area.

This rule relaxes the minimum size requirement for oranges from 2-6/16 inches to 2-3/16 inches in diameter. The Ochoco National Forest is preparing an environmental impact statement (EIS) to analyze the effects of changing grazing management in four grazing allotments on the Ochoco National Forest. These four allotments are Bear Creek, Elkhorn, Snowshoe, and Trout Creek. The proposed action would reauthorize term grazing permits, make rangeland improvements, manage livestock use and distribution to facilitate the improvement of riparian conditions, including streambank stability, riparian vegetation, and water temperature, and would conduct riparian restoration activities on some streams in the project area. These actions are needed to achieve and maintain consistency with the Ochoco National Forest Land and Resource Management Plan, as amended.
