Ski Area Water Rights on National Forest System Lands

The U.S. Forest Service (Forest Service or Agency) is proposing to amend its internal directives for ski area concessions by adding two clauses to the Special Uses Handbook, FSH 2709.11, chapter 50, to address water rights necessary for and that primarily support operation of ski areas on National Forest System (NFS) lands. A revised water rights clause for ski area permits is needed because the current water rights clause cannot be implemented as intended in many States and because the current clause does not ensure that sufficient water is available for operation of ski areas on NFS lands. Implementation of a revised water rights clause would ensure that water will be available for ski areas on NFS lands. Additionally, there would be greater consistency and accountability in authorization of water uses and ownership of water rights for ski areas.
Avocados Grown in South Florida and Imported Avocados; Clarification of the Avocado Grade Requirements

This proposed rule invites comments on changes to the minimum grade requirements currently prescribed under the Florida avocado marketing order (order) and a technical correction to the avocado import regulation. The order regulates the handling of avocados grown in South Florida, and is administered locally by the Avocado Administrative Committee (Committee). For South Florida-grown avocados, this proposed rule would align the regulations with current industry practice. It would remove language permitting the commingling of avocados with dissimilar characteristics in containers for shipment within the production area. All avocado shipments within the production area would need to meet the provisions of a U.S. No. 2 grade, as provided in the United States Standards for Grades of Florida Avocados. For imported avocados, this rule would also make a technical correction to the avocado import regulation to clarify that the minimum grade requirement for imported avocados remains unchanged at a U.S. No. 2.

This final rule establishes regulations for seasons, harvest limits, and methods and means related to the taking of wildlife for subsistence uses in Alaska during the 2014-15 and 2015-16 regulatory years. The Federal Subsistence Board (Board) completes the biennial process of revising subsistence hunting and trapping regulations in even-numbered years and subsistence fishing and shellfish regulations in odd-numbered years; public proposal and review processes take place during the preceding year. The Board also addresses customary and traditional use determinations during the applicable biennial cycle. This rulemaking replaces the wildlife taking regulations that expire on June 30, 2014. This rule also revises wildlife customary and traditional use determinations.

Consistent with a court order on March 29, 2013, the U.S. Forest Service (Forest Service) is proposing to amend the agency's travel management rule (TMR) to require designation of National Forest System (NFS) roads, NFS trails, and areas on NFS lands where over-snow vehicle (OSV) use is allowed, restricted, or prohibited. Under the amended subpart C, the responsible official could establish a system of routes and areas where OSV use is prohibited except where allowed or a system of routes and areas where OSV use is allowed unless prohibited. The proposed rule would continue to exempt OSV use from subpart B of the TMR, which provides for designation of a system of routes and areas where motor vehicle use is allowed and prohibits motor vehicle use off the designated system.

The Department of Agriculture, Forest Service, will prepare an Environmental Impact Statement (EIS) to allocate a portion of the overall visitor capacity to outfitter and guide (O/G) use within four ranger districts of the Tongass National Forest. The project will consider marine shoreline-based commercial non-motorized recreation use on Admiralty Island National Monument and Juneau, Hoonah and Sitka Ranger Districts. The Shoreline II project area includes all areas used by non-motorized outfitter and guide activities that originate from the marine shoreline areas. The project area generally extends \1/2\ mile inland. The project area extends further inland where specific outfitter and guide activities and locations are accessed from the shoreline (i.e., goat/deer hunting, canoe route/portage, freshwater fishing on anadromous and other fish-bearing streams and lakes). The Record of Decision will disclose how the Forest Service decides to allocate (or distribute) shoreline-based recreation capacity for O/G uses. This decision will replace the 2004 Shoreline Outfitter/Guide Record of Decision.

This agenda provides summary descriptions of significant and not significant regulations being developed in agencies of the U.S. Department of Agriculture (USDA) in conformance with Executive Orders (EO) 12866 ``Regulatory Planning and Review,'' and 13563 ``Improving Regulation and Regulatory Review.'' The agenda also describes regulations affecting small entities as required by section 602 of the Regulatory Flexibility Act, Public Law 96-354. This agenda also identifies regulatory actions that are being reviewed in compliance with section 610(c) of the Regulatory Flexibility Act. We invite public comment on those actions as well as any regulation consistent with EO 13563. The Agricultural Act of 2014 was signed into law on February 7. The new law makes major changes in commodity programs, streamlines conservation programs, modifies provisions of the Supplemental Nutrition Assistance Program (SNAP), and expands programs for specialty crops, organic farmers, bioenergy, rural development, and beginning farmers and ranchers. Implementing these changes will require USDA to modify existing regulations and in some cases introduce new regulatory actions. Due to the rigorous process in place for modifying and proposing such actions, much of the information necessary for inclusion in the Spring Regulatory Agenda was unavailable at the time of publication. USDA takes seriously its commitments to transparency, collaboration and public participation, and strongly encourages the public to review the steps it is taking to implement the Agricultural Act of 2014, including up-to-date regulatory information, at its Farm Bill Web site: https://www.usda.gov/wps/portal/usda/ usdahome?navid=farmbill. The Food Safety and Inspection Service (FSIS) is announcing the dollar limitations on the amount of meat and meat food products, poultry, and poultry products that a retail store can sell to hotels, restaurants, and similar institutions without disqualifying itself for exemption from Federal inspection requirements. In accordance with FSIS's regulations, for calendar year 2014, the dollar limitation for meat and meat food products is being increased from $69,600 to $70,400 and for poultry products from $54,500 to $57,100. FSIS is changing the dollar limitations from calendar year 2013 based on price changes for these products evidenced by the Consumer Price Index.

Idaho Roadless Rule

The U.S. Department of Agriculture (USDA), Forest Service is modifying the boundaries for the Big Creek, Grandmother Mountain, Pinchot Butte, Roland Point, and Wonderful Peak Idaho Roadless Areas on the Idaho Panhandle National Forests to include lands acquired within and/or adjacent to these roadless areas. In addition, the Forest Service is correcting mapping errors involving Forest Plan Special Areas in the Salmo-Priest and Upper Priest Idaho Roadless Areas. The Forest Service is also making an administrative correction to add the Buckhorn Ridge Idaho Roadless Area to the list under the Kootenai National Forest. These modifications and corrections are pursuant to Forest Service regulations.

The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim rule that decreased the assessment rate established for the California Olive Committee (Committee) for the 2014 and subsequent fiscal years from $21.16 to $15.21 per ton of assessable olives handled. The Committee locally administers the marketing order, which regulates the handling of olives grown in California. Assessments upon olive handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal year began January 1 and ends December 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.

The Forest Service announces that it has discontinued preparation of an Environmental Impact Statement (EIS) for the court ordered removal of Green Mountain Lookout. The Forest Service discontinued preparation of the EIS due to the passage and signing of the ``Green Mountain Lookout Heritage Protection Act'' (Pub. L. 113- 99). The Act amends the Washington State Wilderness Act of 1984 by striking the period at the end and inserting the following: ``and except that with respect to the lands described in section 3(5), the designation of such lands as a wilderness area shall not preclude the operation and maintenance of Green Mountain Lookout.'' Furthermore, the Act prohibits the Forest Service from moving the lookout from its current location on Green Mountain unless the Secretary of Agriculture determines that moving the Lookout is necessary to preserve the Lookout or to ensure the safety of individuals on or around Green Mountain.
