Watermelon Research and Promotion Plan; Importer Membership Requirements

This rule amends the Watermelon Research and Promotion Plan's (Plan) importer membership requirements to serve on the National Watermelon Promotion Board (Board). The Board recommended eliminating the requirement that an importer import more than 50 percent of the total volume handled and imported in order to qualify as an importer member. This change allows for additional parties to qualify as an importer member. The U.S. Department of Agriculture (USDA or Department) conducted a referendum among eligible producers, handlers, and importers of watermelons from January 13 through 27, 2014. Seventy- four percent of those voting in the referendum favored amendment of the Plan. Additional revisions are made to remove unnecessary language in the Plan and regulations. Also, a section of the regulations is clarified and revised accordingly.
Grapes Grown in a Designated Area of Southeastern California; Increased Assessment Rate

This proposed rule would increase the assessment rate established for the California Desert Grape Administrative Committee (Committee) for the 2014 and subsequent fiscal periods from $0.0165 to $0.0200 per 18-pound lug of grapes handled. The Committee locally administers the marketing order, which regulates the handling of grapes grown in a designated area of southeastern California. Assessments upon grape handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period began on January 1 and ends December 31. The assessment rate would remain in effect indefinitely unless modified, suspended, or terminated.

Re-Establishment of the Council for Native American Farming and Ranching

The Department of Agriculture is announcing the re- establishment of the Council for Native American Farming and Ranching (Council). The purpose of the Council is to provide recommendations to the Secretary on how to eliminate barriers to Native American participation in Farm Service Agency farm loan programs and other farm programs. The Council will discuss issues related to the participation of Native American farmers and ranchers in USDA farm loan programs and transmit recommendations concerning any changes to FSA regulations or internal guidance or other measures. The Council is necessary and in the public interest. The Department of Agriculture is seeking nominations for individuals to be considered Council members. Candidates who wish to be considered for membership on the Council for Native American Farmers and Ranchers should submit an AD-755 application form and resume to the Secretary of Agriculture. The Agricultural Act of 2014 (referred to as the 2014 Farm Bill) extends the authorization, with some changes, of many Farm Service Agency (FSA) programs and Commodity Credit Corporation (CCC) programs administered by FSA. This document announces to producers the continuation of the following programs and notes specific changes as mandated by the 2014 Farm Bill: The 2014 crop Marketing Assistance Loans (MAL), Loan Deficiency Payments (LDP), Noninsured Crop Disaster Assistance Program (NAP), Sugar Program, Milk Income Loss Contract Program (MILC), and Dairy Indemnity Payment Program (DIPP). The 2014 Farm Bill also continues, with modifications, the Adjusted Gross Income (AGI) eligibility provisions and payment limits that apply to many FSA and CCC programs. As specified in the 2014 Farm Bill, producers must submit annual acreage reports of all cropland on a farm to qualify for MAL and LDP benefits, and most commodity programs. All of the programs listed above will be continued under existing regulations, except as specified in this document. This document will be followed by amendments to the applicable regulations to implement changes required by the 2014 Farm Bill.

A Plan of Operation has been submitted by Rare Element Resources, Inc., for the purpose of constructing and operating a rare earth elements mine in the Black Hills National Forest, Bearlodge District in Crook County, Wyoming. The Bear Lodge Project proposed action consists of the Bull Hill Mine, the Miller Creek access road, the power line, and ongoing mineral exploration. The connected action, the Upton hydrometallurgical processing plant and the tailings storage facility are located 45 miles away on private lands outside of Upton in Weston County, Wyoming. Notice is hereby given that the U.S. Department of Agriculture, Forest Service, Black Hills National Forest, will prepare an Environmental Impact Statement (EIS) to determine and analyze the effects of construction and operation of a proposed rare earth elements mine and continued mineral exploration within mining claims held by Rare Element Resources, Inc. on National Forest System (NFS) land. While the Upton Plant is a connected action, there is no federal authorization for private land and therefore will not be analyzed in detail. The Bear Lodge Project proposed action consists of the following components: Construction and operation of an open-pit mine operation at Bull Hill and associated support facilities, including, but not limited to, a Physical Upgrade (PUG) plant, access route, waste rock facility and sedimentation ponds, located approximately 12 miles (or 6 air miles) north of Sundance, Wyoming; Access road along County Roads 208, 266 and 8 and NFS Roads 854 and 851. A 69kV, above ground transmission line crossing approximately 1.5 miles NFS lands, while the remainder of the 13-mile line would be on private and State of Wyoming lands; and The continuation of mineral exploration by drilling, trenching and bulk sampling located on lands surrounding the proposed mine. The Bear Lodge Project connected action includes: Construction and operation of a hydrometallurgical (Hydromet) plant for further concentration and recovery of the rare earth elements into a rare earth carbonate concentrate product on private land outside the city limits of Upton, Wyoming. This plant is recognized as a connected action, but will not be analyzed in detail in the EIS;

Eligibility of the Republic of Korea To Export Poultry Products to the United States

The Food Safety and Inspection Service (FSIS) is amending the Federal poultry products inspection regulations to add the Republic of Korea (Korea) to the list of countries eligible to export poultry products to the United States. FSIS has reviewed Korea's poultry laws, regulations, and inspection system, as implemented, and has determined that they are equivalent to the Poultry Products Inspection Act (PPIA), the regulations implementing this statute, and the U.S. food safety system for poultry. Under this final rule, slaughtered poultry or parts or other products thereof processed in certified Korean establishments will be eligible for export to the United States. All such products will be subject to re-inspection at United States ports of entry by FSIS inspectors.

The Rural Utilities Service (RUS) announces its Revolving Fund Program (RFP) application window for Fiscal Year (FY) 2014. In addition to announcing the application window, RUS announces the available funding of $1,000,000 for competitive grants. The RFP is authorized under section 306(a)(2)(B) of the Consolidated Farm and Rural Development Act (Con Act), 7 U.S.C. 1926 (a)(2)(B). Under the RFP, qualified private, non-profit organizations receive RFP grant funds to establish a lending program for eligible entities. Eligible entities for the revolving loan fund will be the same entities eligible, under paragraph 1 or 2 of Section 306(a) of the Con Act, 7 U.S.C. 1926(a)(1) or (b)(2), to obtain a loan, loan guarantee, or grant from the RUS Water, Waste Disposal and Wastewater loan and grant programs. This year administrative discretion points may be awarded for work plans that: 1. Directs loans to the smallest communities with the lowest incomes emphasizing areas where according to the American Community Survey data by census tracts show that at least 20% of the population is living in poverty. This emphasis will support Rural Development's goal of providing 20% of its funding by 2016 to these areas of need. 2. Directs loans to areas which lack running water, flush toilets, and modern sewage disposal systems, and areas which have open sewers and high rates of disease caused by poor sanitation, in particular, colonias or Substantially Underserved Trust Areas. 3. Directs loans that emphasize energy and water efficient components to reduce costs and increase sustainability of rural systems.

The Rural Utilities Service (RUS) announces its Household Water Well System Grant Program (HWWS) funding availability and application window for Fiscal Year (FY) 2014. RUS will make grants to qualified private non-profit organizations to establish lending programs for homeowners to borrow up to $11,000 to construct or repair household water wells for an existing home. The HWWS Grant Program is authorized under 7 U.S.C. 1926e. Regulations may be found at 7 CFR 1776. Of particular note this year, the RUS will assign administrative discretion points to applications that: 1. Direct loans to rural areas where according to the American Community Survey data by census tracts show that at least 20 percent of the population is living in poverty. Importation of Potatoes From Mexico

We are amending the regulations concerning the importation of fruits and vegetables to allow the importation of fresh potatoes (Solanum tuberosum L.) from Mexico into the United States. As a condition of entry, the potatoes must be produced in accordance with a systems approach employing a combination of mitigation measures to prevent the introduction and dissemination of plant pests into the United States. The potatoes must be imported in commercial consignments, must be produced by a grower who is registered in a certification program, must be packed in registered packinghouses, must be washed, cleaned, and treated with a sprout inhibitor, and must be inspected after packing for quarantine pests. The potatoes must also be accompanied by a phytosanitary certificate that declares that the conditions for importation have been met. Finally, the national plant protection organization (NPPO) of Mexico must provide a bilateral workplan to the Animal and Plant Health Inspection Service (APHIS) that details the activities that the NPPO of Mexico will carry out to meet these requirements, subject to APHIS' approval. This action allows the importation of potatoes from Mexico while continuing to protect against the introduction of plant pests into the United States.

This proposed rule would adjust representation on the Cattlemen's Beef Promotion and Research Board (Board), established under the Beef Promotion and Research Act of 1985 (Act), to reflect changes in cattle inventories as well as cattle and beef imports that have occurred since the most recent Board reapportionment rule became effective in July 2011. In accordance with the Paperwork Reduction Act of 1995, the Farm Service Agency (FSA) is seeking comments from all interested individuals and organizations on an extension with a revision of currently approved information collection associated with the Emergency Conservation Program (ECP) and Biomass Crop Assistance Program (BCAP). This information is collected in support of, respectively, Section 401 of the Agricultural Credit Act of 1978, as amended, and Section 9011 of the Farm Security and Rural Investment Act of 2002, as amended.
Extension of Dairy Forward Pricing Program

This final rule extends the Dairy Forward Pricing Program in accordance with the Agricultural Act of 2014 (2014 Farm Bill). The Dairy Forward Pricing Program was first authorized in section 1502 of the Food, Conservation and Energy Act of 2008. The program allows handlers regulated under the Federal milk marketing order program to pay producers and cooperative associations in accordance with the terms of a forward contract and not have to pay the minimum Federal order uniform price for milk. Establishing new contracts under the Dairy Forward Pricing Program has been prohibited since the expiration of the program on September 30, 2013. The 2014 Farm Bill (H.R. 2642) was signed into law on February 7, 2014, and extends the program to allow new contracts to be entered into until September 30, 2018. Any forward contract entered into up and until the September 30, 2018, deadline is subject to a September 30, 2021, expiration date to meet the terms of the contract.
Peanut Promotion, Research, and Information Order; Amendment to Primary Peanut-Producing States and Adjustment of Membership

This rule adds the State of Arkansas as a primary peanut- producing State under the Peanut Promotion, Research, and Information Order (Order). The Order is administered by the National Peanut Board (Board) with oversight by the U.S. Department of Agriculture (USDA). This rule also adds a seat on the Board for the State of Arkansas. Under the Order, primary peanut-producing States must maintain a 3-year average production of at least 10,000 tons of peanuts. Arkansas's peanut production meets this requirement. Primary peanut-producing States also have a seat on the Board. This action was recommended by the Board and ensures that the Board's representation reflects changes in the geographical distribution of the production of peanuts.
Lyon-Mineral Resource Advisory Committee

The Lyon-Mineral Resource Advisory Committee (RAC) will meet in Yerington, Nevada. The committee is authorized under the Secure Rural Schools and Community Self-Determination Act (Pub. L. 110-343) (the Act) and operates in compliance with the Federal Advisory Committee Act. The purpose of the committee is to improve collaborative relationships and to provide advice and recommendations to the Forest Service concerning projects and funding consistent with the title II of the Act. This notice corrects notices of Intent (NOI) published in the Federal Register on February 4, 2008 (73 FR, No. 23, pages 6453-6454) and March 28, 2008 (73 FR, No. 61 pages 16621-16622), to prepare a supplemental environmental impact statement (SEIS) to analyze and disclose environmental effects relative to oil and gas leasing on portions of the forest previously identified as suitable and available for oil and gas leasing in the Bridger-Teton National Forest Land and Resource Management Plan. The Forest Service is providing this corrected NOI because it intends to prepare a new draft and final SEIS in place of the draft and final SEIS released in February 2010 and January 2011, respectively. Extensive public involvement efforts were conducted with the 2008 scoping period. Because extensive public comments covering the range of relevant issues for the analysis were received in the 2008 scoping period and in the comment period on the 2010 Draft SEIS, an additional scoping period is not being conducted. Scoping comments and comments on the Draft SEIS previously submitted will be considered in preparation of the new SEIS. Scoping for a supplemental environmental impact statement is not required [40 CFR 1502.9(c)(4)]. The public will have another opportunity to comment on this project when the new Draft SEIS is released. A draft Record of Decision will be released with the new Final SEIS, and will be subject to the pre-decisional (objection) administrative review process [36 CFR 218]. Individuals and entities who submitted timely, specific written comments regarding this project during the 2008 scoping period and the 2010 Draft SEIS comment period and those who submit comments on the new 2014 Draft SEIS will be eligible to file objections.

Chapter 35), this notice announces the Agricultural Marketing Service's (AMS) intention to request emergency approval from the Office of Management and Budget (OMB) for a new collection under the Farmers' Market and Local Food Promotion Program. The Farmers' Market and Local Food Promotion Program, includes two AMS competitive grant programs: Farmers' Market Promotion Program (FMPP) and Local Food Promotion Program (LFPP). This new collection establishes forms and documentation under the Local Food Promotion Program.
