The Department of Agriculture re-established the Forest Resource Coordinating Committee (Committee) pursuant to Section 8005 of the Food, Conservation, and Energy Act of 2008 (Act) (Pub. L. 110-246), and the Federal Advisory Committee Act (FACA), (5 U.S.C. App. 2). The Act passed into law as an amendment to the Cooperative Forestry Assistance Act of 1978 on June 18, 2008. The Committee has been re- established to continue coordinating non-industrial private forestry activities within the U.S. Department of Agriculture (USDA) and the private sector. The Secretary of Agriculture (Secretary) has determined that the work of the Committee is in the public's interest and relevant to the duties of the USDA. Therefore, the Secretary is seeking nominations to fill a vacancy and three expiring positions, with terms of 3 years, in the Conservation Organization, Forest Industry, Nonindustrial Private Forest Landowner, and Conservation District categories. The nominees must be associated with such organizations and be willing to represent that sector as it relates to non-industrial private forestry. The public is invited to submit nominations for membership on the Committee, either as a self-nomination or a nomination of any qualified and interested person.

The agenda also describes regulations affecting small entities as required by section 602 of the Regulatory Flexibility Act, Public Law 96-354. The Regulatory Flexibility Act requires that agencies publish semiannual regulatory agendas in the Federal Register describing regulatory actions they are developing that may have a significant economic impact on a substantial number of small entities (5 U.S.C. 602). Executive Order 12866 ``Regulatory Planning and Review,'' signed September 30, 1993 (58 FR 51735), and Office of Management and Budget memoranda implementing section 4 of that Order establish minimum standards for agencies' agendas, including specific types of information for each entry. The Unified Agenda of Federal Regulatory and Deregulatory Actions (Unified Agenda) helps agencies fulfill these requirements. All Federal regulatory agencies have chosen to publish their regulatory agendas as part of the Unified Agenda. Editions of the Unified Agenda prior to fall 2007 were printed in their entirety in the Federal Register. Beginning with the fall 2007 edition, the Internet is the basic means for conveying regulatory agenda information to the maximum extent legally permissible. This proposed rule invites comments on the termination of Marketing Order No. 947 (order), which regulates the handling of Irish potatoes grown in Modoc and Siskiyou Counties, California, and in all counties in Oregon, except Malheur County, and the rules and regulations issued thereunder. The order is administered locally by the Oregon-California Potato Committee (Committee), which recommended termination of the marketing order at a meeting held on March 7, 2013. This recommendation is based on the Committee's determination that the order is no longer an effective marketing tool for the Oregon- California potato industry, and that termination would best serve the current needs of the industry while also eliminating the costs associated with operating the marketing order.
Kiwifruit Grown in California and Imported Kiwifruit; Relaxation of Minimum Grade Requirement

This rule relaxes the minimum grade requirement under the marketing order for kiwifruit grown in California (order), and for kiwifruit imported into the United States that are shipped to the fresh market, by increasing the tolerance of kiwifruit which is ``badly misshapen'' from 7 percent to 16 percent. The order is administered locally by the Kiwifruit Administrative Committee (Committee). This change is intended to facilitate the packing of fruit to meet the minimum grade requirement of ``KAC No. 1'', and reduce costs associated with re-sorting and repacking this grade of fruit. The change in the import regulation is required under section 8e of the Agricultural Marketing Agreement Act of 1937.

The Department of Agriculture (USDA), Grain Inspection, Packers and Stockyards Administration (GIPSA) is amending the regulations that cover the official grain inspection and weighing service procedures that GIPSA's Federal Grain Inspection Service (FGIS) performs under the authority of the United States Grain Standards Act (USGSA), as amended. Specifically, GIPSA is amending the regulations issued under the USGSA pertaining to grain exported in large reusable containers typically loaded onto export ships. In this final rule, GIPSA will add new definitions for ``composite'' and ``average'' grades, limit the number of containers that may be averaged or combined to form a single lot, restrict the inspection and weighing of container lots to the official service provider's area of responsibility, specify a 60-day retention period for file samples representing such container lots, make consistent the weighing certification procedures for container lots with those for inspection certification procedures, and make other miscellaneous changes. GIPSA believes that these revisions will help facilitate the marketing of U.S. grain shipped for export.

The Manti-La Sal National Forest is proposing to add the Orange Olsen Administrative Site facilities into the recreation rental program. The facilities proposed for the recreation rental program include: (1) Orange Olsen Dwelling and (2) Orange Olsen Bunkhouse with four trailer pads. The proposal is to charge $60.00 per night at the Dwelling and $40.00 per night at the Bunkhouse. The fee for the Bunkhouse would also include four trailer pads with water and sewer hookups. Visitors will have the option of reserving the Dwelling or the Bunkhouse separately, or the entire site. Fees are assessed based on the level of amenities and services provided, cost of operation and maintenance, and market comparison. Funds from fees would be retained locally and used for the operations and maintenance, and future improvements including historical information on the cabins. The Orange Olsen Dwelling has a front room, two bedrooms (sleeping up to six people), kitchen, and bathroom with shower. An accessible ramp provides entrance to the back door of the facility. The Orange Olsen Bunkhouse has a combination kitchen/bedroom (sleeping up to four people), bathroom with shower, and four trailer pads with water and sewer hookups. Both of the buildings have photovoltaic (solar) lighting, propane fueled appliances, water, and sewer.

The Coronado National Forest is proposing to add the Portal CCC House and Portal Bunkhouse into the recreation rental program. The proposal is to charge $125.00 per night at the Portal CCC House and $100.00 per night at the Portal Bunkhouse. The Portal CCC House has two bedrooms (one with a futon couch, the second with a set of bunk beds), a single bathroom (with a shower), a small dining/living room combination, and a fully-equipped kitchen. It can accommodate up to five people. The Portal Bunkhouse has one bedroom (with a set of bunk beds and a small rollaway bed), a single bathroom (with a shower), and a small kitchen/dining room combination. It can accommodate up to four people. Both facilities have electric lights, heat, and running water. Other cabin rentals on National Forests in Arizona have shown the public appreciates the enhanced recreational opportunity afforded by these rehabilitated historic structures. Revenues from the rentals will be used for the continued operation and maintenance of this facility and other properties in the Arizona ``Rooms with a View'' Cabin Rental Program.

This rulemaking proposes to amend the Summer Food Service Program (SFSP) regulations to incorporate changes mandated by Section 738 of the Consolidated Appropriations Act, 2008. The changes extend simplified cost accounting and reporting procedures to SFSP sponsors in all States, and eliminate the cost comparison requirements for determining payments to sponsors. This rulemaking would amend SFSP regulations to address these statutory changes. In addition, this rulemaking proposes several discretionary changes to improve administrative efficiency and reduce paperwork in the management of the SFSP. The intended effect of this rulemaking is to simplify and streamline administration while ensuring the integrity of the Program. Finally, this rulemaking proposes a change to the National School Lunch Program regulations to create consistency among the Child Nutrition Programs with regard to notice procedures.

This process will ultimately result in a Forest Land Management Plan which describes the strategic direction for management of forest resources for the next ten to fifteen years on these National Forests (NFs). The first two phases of the processpreparing an assessment and developing a proposed action for plan revisionhave begun. The 2012 Planning Rule requires the Forest Service to notify interested parties of development of a proposed plan or plan revision (36 CFR 219.16(a)(1). This notice meets that requirement. The Salmon-Challis National Forest is proposing to begin charging fees at three recreation sites. All sites have recently been reconstructed or amenities have been added to improve services and experiences. Fees are assessed based on the level of amenities and services provided, cost of operation and maintenance, market assessment, and public comment. Funds from fees would be used for the continued operation and maintenance of these recreation sites. Two campgrounds on the Challis-Yankee Fork Ranger District, Custer 1 and Flat Rock Extension Campground received extensive rehabilitation in 2007 and are conveniently located near the Historic Custer Townsite and the Yankee Fork of the Salmon River. The funds collected will be used for the continued operation and maintenance of these popular campgrounds. The proposed fee would be $5.00 per night. Twin Creek Picnic Area is currently a fee free site, however improvements made in 2008 and 2009 included new toilet facilities and a rehabilitated drinking water system and addressed sanitation and safety concerns, an overall improvement to the recreation experience. The proposed fee to help maintain this site would be $20.00 per day to reserve and use the large group picnic site which features the historic CCC-era picnic shelter, parking, drinking water, group fire place and horseshoe pits.

Importation of Fresh Citrus Fruit From Uruguay, Including Citrus

We are amending the fruits and vegetables regulations to allow the importation of several varieties of fresh citrus fruit, as well as Citrus hybrids and the Citrus-related genus Fortunella, from Uruguay into the continental United States. As a condition of entry, the fruit will have to be produced in accordance with a systems approach that includes requirements for importation in commercial consignments, pest monitoring and pest control practices, grove sanitation and packinghouse procedures designed to exclude the quarantine pests, and treatment. The fruit also will have to be accompanied by a phytosanitary certificate issued by the national plant protection organization of Uruguay with an additional declaration confirming that the fruit is free from all pests of quarantine concern and has been produced in accordance with the systems approach. These actions will allow for the importation of fresh citrus fruit, including Citrus hybrids and the Citrus-related genus Fortunella, from Uruguay while continuing to protect the United States against the introduction of plant pests.

In response to recent amendments to the Lacey Act, we are establishing definitions for the terms ``common cultivar'' and ``common food crop'' and several related terms. The amendments to the Act expanded its protections to a broader range of plant species, extended its reach to encompass products, including timber, that derive from illegally harvested plants, and require that importers submit a declaration at the time of importation for certain plants and plant products. Common cultivars and common food crops are among the categorical exclusions to the provisions of the Act. The Act does not define the terms ``common cultivar'' and ``common food crop'' but instead gives authority to the U.S. Department of Agriculture and the U.S. Department of the Interior to define these terms by regulation. Our definitions specify which plants and plant products will be excluded from the provisions of the Act, including the declaration requirement.
