Cotton Futures Classification: Optional Classification Procedure

The Agricultural Marketing Service (AMS) is amending regulations to allow for the addition of an optional cotton futures classification procedureidentified and known as ``registration'' by the U.S. cotton industry and the Intercontinental Exchange (ICE). In response to requests from the U.S. cotton industry and ICE, AMS will offer a futures classification option whereby cotton bales may be certificated for the purpose of an exchange's cotton futures contract using Smith-Doxey data to verify that submitted bales meet more restrictive quality requirements and age parameters established by that exchange. AMS anticipates that the futures classification option will be available in time for the implementation of ICE's Cotton Resolution No. 2, which is scheduled to commence with the March 2014 contract month.

Importation of Ovine Meat From Uruguay

We are amending the regulations governing the importation of certain animals, meat, and other animal products to allow, under certain conditions, the importation of fresh (chilled or frozen) ovine meat from Uruguay. A risk assessment that we have prepared indicates that fresh (chilled or frozen) ovine meat can safely be imported from Uruguay under these conditions. This action will allow the importation of fresh ovine meat from Uruguay into the United States while continuing to protect the United States against the introduction of foot-and-mouth disease.

These changes are being proposed at the request of the Dry Pea industry and will help facilitate the marketing of the class, Smooth Yellow Dry Peas and help ensure the purity of classes for Whole Dry Peas.

Evaluation of Established Plant Pests for Action at Ports of Entry

We are advising the public that we have been and are assessing certain plant pests that are present in the United States to determine whether we should take action to mitigate the risk posed by those pests when they are found in consignments of imported goods at ports of entry into the United States. We have determined that it is no longer appropriate or necessary to take such action on some plant pests on which we had been taking action at ports of entry because we are not taking any regulatory action on those same pests when we find them in interstate movement, due to our scientific determination that we do not need to mitigate their pest risk. This process relieves restrictions that are no longer needed and ensures that actions taken on plant pests found in imported goods are consistent with the actions we take on those same pests when they appear in interstate commerce.

This notice announces the appointment of the members of the Senior Executive Service (SES) and Senior Level (SL) and Scientific or Professional (ST) Performance Review Boards (PRB) for the Department of Agriculture, as required by 5 U.S.C. 4314(c)(4). This rule invites comments on a proposed Hardwood Lumber and Hardwood Plywood Promotion, Research and Information Order (Order). Hardwood lumber and hardwood plywood are used in products like flooring, furniture, moldings, doors, and kitchen cabinets. The program would be financed by an assessment on hardwood lumber manufacturers and hardwood plywood manufacturers and would be administered by a board of industry members selected by the Secretary of Agriculture (Secretary). The assessment rate varies according to the product manufactured. The purpose of the program would be to strengthen the position of hardwood lumber and hardwood plywood in the marketplace and maintain and expand markets for hardwood lumber and hardwood plywood. A referendum would be held among eligible hardwood lumber manufacturers and hardwood plywood manufacturers to determine whether they favor implementation of the program prior to it going into effect. This rule also announces the Agricultural Marketing Service's (AMS) intent to request approval by the Office of Management and Budget (OMB) of new information collection requirements to implement the program.

This proposed rule would increase the assessment rate established for the Citrus Administrative Committee (Committee) for the 2013-14 and subsequent fiscal periods from $0.008 to $0.009 per 4/5 bushel carton of Florida citrus handled. The Committee locally administers the Federal marketing order, which regulates the handling of oranges, grapefruit, tangerines, and tangelos grown in Florida. Assessments upon Florida citrus handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period begins August 1 and ends July 31. The assessment rate would remain in effect indefinitely unless modified, suspended, or terminated.

Revision of the Land Management Plan for the Flathead National Forest

The Flathead National Forest, located in Montana, is initiating the forest planning process pursuant to the 2012 Forest Planning Rule. This process results in a Forest Land Management Plan which describes the strategic direction for management of forest resources for the next ten to fifteen years on the Flathead National Forest. The first phase of the process, the assessment phase, has begun and interested parties have been invited to contribute in the development of the assessment (36 CFR 219.6). The Forest has posted preliminary assessment information to its Web site as well as hosted field tours and an open house. The assessment is expected to be completed in December 2013. The trends and conditions identified in the assessment will help in identifying the need for plan components. The Forest is inviting the public to help us identify the appropriate plan components that will become a proposed action for the land management plan revision.

National School Lunch Program and School Breakfast Program: Eliminating Applications Through Community Eligibility as Required by the Healthy, Hunger-Free Kids Act of 2010

This rule proposes to amend the eligibility regulations for free and reduced price meals under the National School Lunch Program (NSLP) and School Breakfast Program (SBP) to codify the statutory provision that establishes the community eligibility provision, a reimbursement option for eligible local educational agencies and schools that wish to offer free school meals to all children in high poverty schools without collecting household applications. This proposed rule reflects statutory requirements that were implemented through policy guidance following enactment of the Healthy, Hunger-Free Kids Act of 2010 (HHFKA). Implementation of this proposed rule would align the regulations with the statutory provision that establishes administrative and operational requirements for State agencies, local educational agencies, and schools.
Supplemental Nutrition Assistance Program: Trafficking Controls and Fraud Investigations; Extension of Comment Period

The Food and Nutrition Service (FNS) issued a final rule to amend Supplemental Nutrition Assistance Program (SNAP or Program) regulations to allow State agencies to deny a request for a replacement card until contact is made by the household with the State agency, if the requests for replacement cards are determined to be excessive. State agencies which elect to exercise this authority will be required to protect vulnerable persons, such as individuals with disabilities, homeless individuals or the elderly, who may repeatedly lose their Electronic Benefit Transfer (EBT) cards but are not committing fraud. FNS is also changing the EBT card replacement timeframes in the same section to require State agencies to make replacement cards available for pick up or to place the card in the mail within two business days following notice by the household to the State agency that the card has been lost or stolen. FNS is further amending regulations to define the term ``trafficking'' to include the attempt to buy or sell SNAP benefits in cases where an individual makes the offer to sell SNAP benefits and/or EBT card online or in person. Finally, FNS issued an interim final rule (with a request for additional comment) that requires State agencies to monitor EBT card replacement requests and send notices to those clients who have requested four cards within a 12-month period. The State agency shall be exempt from sending this Excessive Replacement Card Notice if it adopts the card withholding option in accordance with the final rule and sends the requisite Withhold Replacement Card Warning Notice on the 4th replacement card request. The comment period is being extended to provide additional time for interested parties to review the interim final rule.

The Farm Service Agency (FSA) is amending the Farm Loan Programs (FLP) regulations for loan making and servicing, specifically those on real estate appraisals, leases, subordination and disposition of security, and Conservation Contract requirements. FSA is also streamlining the loan making and servicing process and giving the borrower greater flexibility while protecting the financial interests of the Government.

On December 15, 2000, the USDA Forest Service published a notice of intent (NOI) in the Federal Register (65 FR 78464) to prepare an environmental impact statement (EIS) for controlling invasive plants in the Carson and Santa Fe National Forests. The agency published a notice of availability (NOA) for the Draft EIS in the Federal Register (69 FR 42722) on July 16, 2004. A record of decision was signed on September 12, 2005 and an NOA was subsequently published in the Federal Register (70 FR 69967) on November 18, 2005. Members of the public appealed the decision before the Regional Forester of the Southwestern Region, who reviewed the decision in accordance with 36 CFR 215.7. The Regional Forester's decision, issued on February 23, 2006, reversed the Responsible Officials' decision on the project, with the following instructions: (1) Complete the analysis of effects on the Management Indicator Species population trend for ptarmigan. (2) Strengthen the disclosure of cumulative effects to wildlife species. (3) Address the concern about the use of picloram in municipal watersheds. On September 10, 2009, the USDA Forest Service published a corrected NOI in the Federal Register (74 FR 46562). The NOI listed the date of completion and distribution for the draft supplemental environmental impact statement (DSEIS) as being December 2009.
