This rule increases the assessment rate established for the South Texas Onion Committee (Committee) for the 2012-13 and subsequent fiscal periods from $0.025 to $0.03 per 50-pound equivalent of onions handled. The Committee locally administers the marketing order that regulates the handling of onions grown in South Texas. Assessments upon onion handlers are used by the Committee to fund reasonable and necessary expenses of the program. The fiscal period begins August 1 and ends July 31. The assessment rate will remain in effect indefinitely unless modified, suspended, or terminated.

The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim rule that revised the quantity of Class 1 (Scotch) and Class 3 (Native) spearmint oil that handlers may purchase from, or handle on behalf of, producers during the 2012-2013 marketing year under the Far West spearmint oil marketing order. The interim rule increased the Scotch spearmint oil salable quantity from 782,413 pounds to 2,622,115 pounds and the allotment percentage from 38 percent to 128 percent. In addition, the interim rule increased the Native spearmint oil salable quantity from 1,162,473 pounds to 1,348,270 pounds and the allotment percentage from 50 percent to 58 percent. This change is expected to moderate extreme fluctuations in the supply and price of spearmint oil. Also, this change will help maintain stability in the Far West spearmint oil market.

In addition, modifications to correct mapping errors involving Forest Plan Special Areas in the Salmo-Priest, and Upper Priest Idaho Roadless Areas are addressed. An administrative correction is proposed to Sec. 294.29 to add the Buckhorn Ridge Idaho Roadless Areas to the list under the Kootenai National Forest. Importation of Fresh Oranges and Tangerines From Egypt Into the United States

We are advising the public that we have prepared a pest list associated with oranges and tangerines from Egypt that identifies pests of concern. Subsequently, we prepared a commodity import evaluation document to determine the risk posed by peach fruit fly in oranges and tangerines from Egypt. Based on that evaluation, we have concluded that the application of one or more designated phytosanitary measures will be sufficient to mitigate the pest risk. In addition, we are advising the public that we have prepared a treatment evaluation document that describes a new treatment schedule that can be used to neutralize peach fruit fly and Mediterranean fruit fly in oranges and tangerines. We are making the pest list, commodity import evaluation document, and treatment evaluation document available to the public for review and comment.
Availability of an Environmental Assessment for Field Testing of a Yersinia Pestis Vaccine, Live Raccoon Poxvirus Vector

We are advising the public that the Animal and Plant Health Inspection Service has prepared an environmental assessment concerning authorization to ship for the purpose of field testing, and then to field test, an unlicensed Yersinia Pestis Vaccine, Live Raccoon Poxvirus Vector. The environmental assessment, which is based on a risk analysis prepared to assess the risks associated with the field testing of this vaccine and related information, examines the potential effects that field testing this veterinary vaccine could have on the quality of the human environment. Based on the risk analysis and other relevant data, we have reached a preliminary determination that field testing this veterinary vaccine will not have a significant impact on the quality of the human environment, and that an environmental impact statement need not be prepared. We intend to authorize shipment of this vaccine for field testing following the close of the comment period for this notice unless new substantial issues bearing on the effects of this action are brought to our attention. We also intend to issue a U.S. Veterinary Biological Product license for this vaccine, provided the field test data support the conclusions of the environmental assessment and the issuance of a finding of no significant impact and the product meets all other requirements for licensing.

The USGSA provides GIPSA's Federal Grain Inspection Service (FGIS) with the authority to charge and collect reasonable fees to cover the cost of performing official services. The fees also cover the costs associated with managing the program. After a financial review of GIPSA's Fees for Official Inspection and Weighing Services, including a comparison of the costs and revenues associated with official inspection and weighing services, GIPSA is revising local and national tonnage fees (assessed in addition to all other applicable fees) for all export grain shipments serviced by GIPSA field offices.

This proposed rule would establish the quantity of spearmint oil produced in the Far West, by class, that handlers may purchase from, or handle on behalf of, producers during the 2013-2014 marketing year, which begins on June 1, 2013. This proposal invites comments on the establishment of salable quantities and allotment percentages for Class 1 (Scotch) spearmint oil of 1,344,858 pounds and 65 percent, respectively, and for Class 3 (Native) spearmint oil of 1,432,189 pounds and 61 percent, respectively. The Spearmint Oil Administrative Committee (Committee), the agency responsible for local administration of the marketing order for spearmint oil produced in the Far West, recommended these limitations for the purpose of avoiding extreme fluctuations in supplies and prices to help maintain stability in the spearmint oil market.

The Six Rivers National Forest will prepare an Environmental Impact Statement (EIS) to disclose the impacts associated with the re- authorization of livestock grazing in the Trinity Summit area on the Lower Trinity Ranger District through an adaptive management process. The planning area is located on National Forest System lands administered by the Lower Trinity Ranger District in Humboldt County, California within the upper Mill Creek and Tish Tang a Tang Creek watersheds to the east of Hoopa Valley Indian Reservation. Small portions of the planning area are located in the headwaters of Horse Linto Creek and Red Cap Creek. The majority of the grazing lands fall within the Trinity Wilderness and are considered to be culturally significant. The grazing lands are located in all or portions of T. 7 N., R. 6 E., R. 7 E.; T. 8 N., R. 5 E.; R. 6 E., R. 7 E.; and T. 9 N., R. 5 E., R. 6 E., R. 7 E.

The Committee locally administers the marketing order that regulates the handling of apricots grown in designated counties in Washington. The interim rule decreased the assessment rate to reflect a reduction in the manager's salary and the Committee's operating expenditures.

Coconino National Forest; Arizona; Flagstaff Watershed Protection Project

The Forest Service is preparing an environmental impact statement (EIS) to document the potential effects of the Flagstaff Watershed Protection Project (FWPP). The analysis will evaluate and disclose the effects of implementing treatments on the National Forest to reduce the threat of high severity wildfire and subsequent flooding in two watersheds around Flagstaff. Specifically, two key areas have been identified for analysis and treatment under this project: The Dry Lake Hills portion of the Rio de Flag Watershed north of Flagstaff, and the Mormon Mountain portion of the Upper Lake Mary Watershed south of Flagstaff. The project area includes approximately 10,543 acres (roughly 7,569 acres in the Dry Lake Hills portion and 2,974 on Mormon Mountain), and proposed treatments would include thinning and prescribed fire on roughly 8,810 of those acres. The EIS will analyze a variety of harvesting methods, including the use of traditional ground- based equipment, hand thinning, and also methods atypical for the region, including cable and helicopter logging, in order to treat steep, inaccessible terrain.

New Ski Area Water Rights Clause

There will be three open houses, one in Denver, Colorado; one in Salt Lake City, Utah; and one in Lake Tahoe, California, to provide initial public input on a new water rights clause for ski area permits issued by the Forest Service. There will be several stations at the open houses that will remain open from 4:00 p.m. to 6:30 p.m.; there will be no presentations by the Forest Service. The open houses will allow the public to provide comments and suggestions that the Forest Service will consider in developing a new ski area water rights clause. There will be another opportunity for the public to comment when the proposed clause is published in the Federal Register for public notice and comment.
