The Food Safety and Inspection Service (FSIS) is responding to comments on a January 28, 2008 Federal Register notice (73 FR 4767- 4774), which described upcoming policy changes in the FSIS Salmonella Verification Program and outlined a new voluntary Salmonella Initiative Program (SIP) for meat and poultry slaughter establishments that agree to share internal food safety data with FSIS in order to receive waivers of regulatory requirements. SIP benefits public health in that it encourages slaughter establishments to test for microbial pathogens and to respond to the ongoing results by taking steps when necessary to regain process control and thus to minimize the presence of pathogens of public health concern. In addition, SIP enables FSIS to use establishment data to enhance public health protection. In this notice, the Agency is announcing several policy developments and changes regarding SIP. This notice also includes Agency responses to comments on SIP and on other issues discussed in the January 2008 Federal Register notice.

The Rural Utilities Service (RUS), an agency of the United States Department of Agriculture, announces the Delta Health Care Services Grant Program application window for Fiscal Year 2011 funding of $2,994,000 in grant funds to be competitively awarded for the Delta Health Care Services Grant Program. A NOFA was previously published on April 4, 2011, in the Federal Register, at 76 FR 18513 announcing the Delta Health Care Services Grant Program application window and the availability of $3,000,000 in grant funds that were provided in fiscal year 2010, to be competitively awarded for the Delta Health Care Services Grant Program. We have been informed that, due to the serious flooding and devastating tornadoes in the Delta Region, a number of potential applicants could not complete an application in time to meet the application deadline of June 3, 2011 in the notice of funds availability previously published on April 4, 2011, in the Federal Register, at 76 FR 18513. We believe that it is in the best interests of the residents of the Delta Region to open a second application period to enable those potential applicants and others to have a chance to benefit from this grant program.

The Forest Service will prepare a supplemental environmental impact statement (SEIS), to examine surface resource impacts connected with extracting gold from placer deposits within a 4.25-acre (approx.) area, in response to a mining claimant's proposed plan of operations. A Notice of Intent (NOI) was first published for this proposal under the name of Tracy Placer Mine, on April 21, 2006, Volume 71, No. 77, pages 20640-20642. A Notice of Availability was published for the DEIS on March 20, 2009, but due to unforeseen circumstances, the project was put on hold before a comment period was completed. The Forest Service is now preparing a SEIS to address changed conditions and minor changes to the alternatives since the DEIS was first made available. The name of the project is hereby changed to Cedar Gulch Mine to reflect the actual name of the placer claim, rather than the claim owner's name. This is in keeping with Forest Service policy. Proposed mining would occur along the south bank of Sucker Creek, about 11 miles southeast of Cave Junction, Oregon. The purpose for preparing this SEIS is to forecast and disclose environmental consequences to surface resources, resulting from road use and mine operations, as well as to ascertain reasonable operational terms and conditions needed during development of locatable mineral resources of the United States (as authorized by the Mining Law of 1872, as amended).

As set forth in 7 CFR 4279.107(b), Rural Development (the Agency) has the authority to charge an annual renewal fee for loans made under the Business and Industry (B&I) Guaranteed Loan Program. Pursuant to that authority, the Agency is establishing the renewal fee rate at one-fourth of 1 percent for the B&I Guaranteed Loan Program. This rate will apply to all loans obligated in Fiscal Year 2011 that are made under the B&I program. As established in 7 CFR 4279.107, the amount of the fee on each guaranteed loan will be determined by multiplying the fee rate by the outstanding principal loan balance as of December 31, multiplied by the percent of guarantee. As set forth in 7 CFR 4279.107(a) and 4279.119(b)(4), each fiscal year the Agency shall establish a limit on the maximum portion of B&I guarantee authority available for that fiscal year that may be used to guarantee loans with a B&I guarantee fee of 1 percent or guaranteed loans with a guarantee percentage exceeding 80 percent. Allowing the guarantee fee to be reduced to 1 percent or exceeding the 80 percent guarantee on certain B&I guaranteed loans that meet the conditions set forth in 7 CFR 4279.107 and 4279.119, will increase the Agency's ability to focus guarantee assistance on projects which the Agency has found particularly meritorious. For 1 percent fees, the borrower's business supports value-added agriculture and results in farmers benefiting financially, or such projects are high impact as defined in 7 CFR 4279.155(b)(5), and located in rural communities that remain persistently poor, which experience long-term population decline and job deterioration, are experiencing trauma as a result of natural disaster, or are experiencing fundamental structural changes in its economic base. For guaranteed loans exceeding 80 percent, such projects must be a high-priority project in accordance with 7 CFR 4279.155 (and meet the other requirements of 7 CFR 4279.119(b)). Not more than 12 percent of the Agency's quarterly apportioned B&I guarantee authority will be reserved for loan requests with a guarantee fee of 1 percent, and not more than 15 percent of the Agency's quarterly apportioned guarantee authority will be reserved for guaranteed loan requests with a guarantee percentage exceeding 80 percent. Once the respective quarterly limits are reached, all additional loans for that quarter will be at the standard fee and guarantee limits in 7 CFR part 4279.

Pursuant to 7 CFR part 4284, subpart G, the Rural Business- Cooperative Service (RBS), an Agency within the Rural Development mission area, announces the availability of grants of up to $50,000 per application for single-state projects from the Rural Business Opportunity Grant (RBOG) program for Fiscal Year (FY) 2011, to be competitively awarded. For multi-state projects, grant funds of up to $150,000 will be available on a competitive basis. These limits do not apply to specific funding for certain specifically designated rural areas as discussed below. For FY 2011, approximately $2.5 million is available and will be distributed as follows: $990,000 is reserved for projects benefitting Federally Recognized Native American Tribes (FRNAT) in rural areas and $1,488,000 is unreserved. Applicants should note that in FY 2010 the RBOG program was highly competitive. Approximately $2.5 million was available in reserved and unreserved funds. The Agency received 430 applications and was able to fund 27 applications, a rate of 6 percent.

This notice informs the public that the U.S. Department of Agriculture (USDA) in Fiscal Year 2006 established a demonstration Rural Development Voucher Program, as authorized under Section 542 of the Housing Act of 1949 as amended, (without regard to Section 542(b)). This notice informs the public that funding is available for the Rural Development Voucher Program. The notice also sets forth the general policies and procedures for use of these vouchers for Fiscal Year 2011. Pursuant to the requirements in the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2010, Public Law 111-80 (October 16, 2009) and the Department of Defense and full-year continuing Appropriations Act, 2011 Public Law 112-10 (April 15, 2011), Rural Development Vouchers are only available to low income tenants of Rural Development-financed multifamily properties where the Section 515 loan has been prepaid, either through prepayment or a foreclosure action, prior to the loan's maturity date and after September 30, 2005.

Implementation of Revised Lacey Act Provisions

The Food, Conservation and Energy Act of 2008 amended the Lacey Act to provide, among other things, that importers submit a declaration at the time of importation for certain plants and plant products. The declaration requirements of the Lacey Act became effective on December 15, 2008, and enforcement of those requirements is being phased in. We are soliciting public comment on regulatory options that could address certain issues that have arisen with the implementation of the declaration requirement. These options include establishing certain exceptions to the declaration requirement and modifying the Declaration Form PPQ 505 to simplify the collection of information.
