The Department of Agriculture (USDA) is adopting, as a final rule, without change, an interim final rule revising the quantity of Class 3 (Native) spearmint oil that handlers may purchase from, or handle for, producers during the 2007-2008 marketing year. This rule continues in effect the action that increased the Native spearmint oil salable quantity from 1,162,336 pounds to 1,172,956 pounds, and the allotment percentage from 48 percent to 53 percent. The marketing order regulates the handling of spearmint oil produced in the Far West and is administered locally by the Spearmint Oil Administrative Committee (Committee). The Committee recommended this rule for the purpose of avoiding extreme fluctuations in supplies and prices and to help maintain stability in the Far West spearmint oil market.

The planning area is located about 30 miles southwest of Bend, Oregon; it is located in Township 20 South, Range 9 East, and Township 21 South, Range 9 East. The alternatives will include the proposed action, no action, and additional alternatives that respond to issues generated through the scoping process. Income Limit Modification

The Rural Housing Service is proposing to revise the existing income limit structure for Single Family Housing Guaranteed Loan Program (SFHGLP) eligibility. Instead of eligible adjusted income based on households ranging from 1-8 persons according to 7 CFR 1980.345 (a), a two tier income structure consisting of a 1-4 member household and a 5-8 member household is proposed. The new adjusted income limit for the 1-4 member household, for example, would be current adjusted income limit for the 4 member household. The present add-on income limits for larger households will remain unchanged. The present multiple income limits (1-8 persons) are cumbersome, and the proposed consolidation is expected to simplify program delivery as well as allow the agency to serve additional qualified homebuyers. The SFHGLP is in partnership with many State Housing Agencies throughout the United States. The majority of these agencies already maintain a two tier income structure, and this proposed change would allow a seamless integration of the respective programs. This proposal would not apply to other housing programs.
Child Nutrition Programs-Income Eligibility Guidelines

This Notice announces the Department's annual adjustments to the Income Eligibility Guidelines to be used in determining eligibility for free and reduced price meals and free milk for the period from July 1, 2008 through June 30, 2009. These guidelines are used by schools, institutions, and facilities participating in the National School Lunch Program (and Commodity School Program), School Breakfast Program, Special Milk Program for Children, Child and Adult Care Food Program and Summer Food Service Program. The annual adjustments are required by section 9 of the Richard B. Russell National School Lunch Act. The guidelines are intended to direct benefits to those children most in need and are revised annually to account for changes in the Consumer Price Index.

Opal Creek Scenic Recreation Area Advisory Council meetings will convene in Stayton, Oregon on Wednesday, April 23, 2008. These meetings are scheduled to begin at 6:30 p.m., and will conclude at approximately 8:30 p.m. Meetings will be held in the South Room of the Stayton Community Center located on 400 West Virginia Street in Stayton, Oregon. The Opal Creek Wilderness and Opal Creek Scenic Recreation Area Act of 1996 (Opal Creek Act) (Pub. L. 104-208) directed the Secretary of Agriculture to establish the Opal Creek Scenic Recreation Area Advisory Council. The Advisory Council is comprised of thirteen members representing state, county and city governments, and representatives of various organizations, which include mining industry, environmental organizations, inholders in Opal Creek Scenic Recreation Area, economic development, Indian tribes, adjacent landowners and recreation intersects. The council provides advice to the Secretary of Agriculture of preparation of a comprehensive Opal Creek Management Plan for the SRA, and consults on a periodic and regular basis on the management of the area. Tentative agenda items include: Elkhorn resort development presentation, abandoned mine closures, and Opal Creek management strategy. A direct public comment period is tentatively schedule to begin at 8 p.m. Time allotted for individual presentations will be limited to 3 minutes. Written comments are encouraged, particularly if the material cannot be presented within the time limits of the comment period. In accordance with the National Environmental Policy Act (NEPA) and the California Environmental Quality Act (CEQA), the U.S. Department of Agriculture (USDA), Forest Service (Forest Service), the U.S. Department of the Interior (DOI), Bureau of Land Management (BLM) and the City of Los Angeles Department of Water and Power (LADWP) will prepare a joint Environmental Impact Statement (EIS) and Environmental Impact Report (EIR) for the proposed Barren Ridge Renewable Transmission Project. This action is in response to LADWP's application to the Forest Service for a special use authorization and amendments to existing special use authorizations, and application to BLM for a right-of-way grant and amendments to existing right-of-way grants. It has been determined that this project is a major federal action which may have a significant impact upon the environment. Therefore, the appropriate environmental analysis document is an EIS/EIR. The EIS/EIR would describe and analyze potential environmental impacts from the proposed project/action and the range of reasonable alternatives. LADWP proposes the following: (1) Construction of a 230 kilovolt (kV) transmission line from the existing Barren Ridge Switching Station to Haskell Canyon on double circuit structures; (2) addition of a 230 kV circuit on existing double circuit structures from Haskell Canyon to the Castaic Power Plant; (3) upgrading of the existing Owens Gorge- Rinaldi (OG-RIN) 230 kV Transmission Line with larger capacity conductors between the Barren Ridge Switching Station and Rinaldi Substation; (4) construction of a new electrical switching station within Haskell Canyon near the southern boundary of the Angeles National Forest. This notice initiates the public participation and scoping process for the EIS/EIR and also serves as an invitation for other interested agencies, individuals, organizations and Native American Tribes to provide comments on the scope and content of the EIS/EIR.

In accordance with Section 122(i) of the Comprehensive Environmental Response, Compensation, and Liability Act, as amended (``CERCLA''), 42 U.S.C. 9622(i), notice is hereby given of an administrative settlement with the owners of an 18-acre parcel (the Settling Parties) within the Beal Mine site in Silver Bow County, Montana. The settlement requires the Settling Parties to convey the parcel to the United States. The settlement includes a covenant not to sue the Settling Parties pursuant Section 107(a) of CERCLA, 42 U.S.C. 9607(a), with regard to the Beal Mine Site. For thirty (30) days following the date of publication of this notice, the United States will receive written comments relating to the settlement. The United States will consider all comments received and may modify or withdraw its consent to the settlement if comments received disclose facts or considerations which indicate that the settlement is inappropriate, improper, or inadequate.

This rule changes the current reporting requirements prescribed under the California pistachio marketing order (order). The order regulates the handling of pistachios grown in California and is administered locally by the Administrative Committee for Pistachios (committee). These changes will modify one existing committee form and add a new form to a currently-approved information collection. The information collected will require handlers to report production and producer data, enabling the committee to obtain better information for preparing its annual marketing policy statement and conducting committee nominations and periodic referenda under the order.

Funds from the fee site will be used for the continued operation and maintenance of Skull Hollow.

The purpose of the meeting is to have a discussion with stakeholders on recent spikes in recalls and illnesses related to Escherichia coli (E. coli) O157:H7, provide updates on FSIS initiatives related to E. coli O157:H7, review perspectives, research progress, and build a foundation for establishing solutions to address the challenges this pathogen causes.
Importation of Uncooked Pork and Pork Products

We are amending the regulations for importing animal products to allow the importation of uncooked pork and pork products from regions where classical swine fever (CSF) is considered to exist if the uncooked pork and pork products originate in a region free of CSF and meet certain other conditions with respect to processing and shipping. This action removes some restrictions on the importation of uncooked pork and pork products while continuing to protect against an incursion of CSF into the United States.

We are proposing to relieve certain restrictions regarding the movement of Hass variety avocados. Specifically, we are proposing to amend our domestic quarantined regulations to provide for the interstate movement of Hass avocados from Mexican fruit fly and sapote fruit fly quarantined areas in the United States with a certificate if the fruit is safeguarded after harvest in accordance with specific measures. We are also proposing to amend our foreign quarantined regulations to remove trapping and bait spray treatment requirements related to Anastrepha spp. fruit flies for imported Hass avocados from Michoacan, Mexico. These actions are warranted in light of research demonstrating the limited host status of Hass avocados to various species of fruit flies in the genus Anastrepha, including Mexican fruit fly and sapote fruit fly. By amending our domestic and foreign quarantined regulations, we would make our domestic and foreign requirements for movement of Hass avocados consistent with each other and would relieve restrictions for Mexican Hass avocado producers. In addition, this action would provide an alternative means for Hass avocados to be moved interstate if the avocados originate from a Mexican fruit fly or sapote fruit fly quarantined area in the United States.
