Multi-Year Revision of Fees for the Fresh Fruit and Vegetable Terminal Market Inspection Services

This proposed rule would revise the regulations governing the inspection and certification for fresh fruits, vegetables and other products by increasing certain fees charged for the inspection of these products at destination markets for the next two fiscal years (FY-2007 and FY-2008) by approximately 15 percent. These revisions are necessary in order to recover, as nearly as practicable, the costs of performing inspection services at destination markets under the Agricultural Marketing Act of 1946 (AMA of 1946). The fees charged to persons required to have inspection on imported commodities in accordance with the Agricultural Marketing Agreement Act of 1937 and for imported peanuts under section 1308 of the Farm Security and Rural Investigation Act of 2002.
Soybean Promotion and Research: Amend the Order To Adjust Representation on the United Soybean Board

The National Forests in North Carolina will begin charging a special recreation permit fee for reserved use of picnic shelters on several sites on the National Forests in North Carolina. Members of the public have requested the ability to reserve use of a picnic shelter in advance of the day of proposed shelter use. There will be no charging for using a picnic shelter as long as no reservation is made. Reservations will be posted on site at least 24 hours in advance of the reservation time. The shelters are located at the Murray Branch Day Use Area on the Appalachian Ranger District, the Cheoah Point Day Use Area on the Cheoah Ranger District, the Old Fort Picnic Area and Mortimer Picnic Area on the Grandfather Ranger District, the Sycamore Flats Picnic Area and Pink Beds Picnic Area on the Pisgah Ranger District, the Cherokee Lake Picnic Area, Jackrabbit Day Use Area and Hanging Dog Day Use Area on the Tusquitee Ranger District, and at Kings Mountain Point Day Use Area on the Uwharrie Ranger District. The cost for reserved use of the shelters will vary between $25-$30 for a half day and $40-$50 for a whole day. The higher use fee will be charged for the larger capacity shelter at Kings Mountain Point Day Use Area. In addition, the National Recreation Reservation Service charges a $9 reservation service fee. Fee revenue will support operations and maintenance of the shelters and future shelter site improvements.

Determination of the 2006 Fiscal Year Interest Rate on Rural Telephone Bank Loans

In accordance with 7 CFR 1610.10, the Rural Telephone Bank (Bank) cost of money rate has been established as 5.49% for all advances made during fiscal year 2006 (the period beginning October 1, 2005 and ending September 30, 2006). All advances made during fiscal year 2006 were under Bank loans approved on or after October 1, 1992. These loans are sometimes referred to as financing account loans. The calculation of the Bank's cost of money rate for fiscal year 2006 is provided in Table 1. Since the calculated rate is greater than or equal to the minimum rate (5.00%) allowed under 7 U.S.C. 948(b)(3)(A), the cost of money rate is set at 5.49%. The methodology required to calculate the cost of money rates is established in 7 CFR 1610.10(c).
Fishtrap EIS, Lolo National Forest, Sanders County, Montana

The Forest Service will prepare a supplemental environmental impact statement (EIS) for the Fishtrap project. The original Fishtrap Record of Decision, signed on November 22, 2005, was litigated in May 2006. The primary issue of the lawsuit was related to treatments intended to maintain and/or enhance old growth stands. As a result of a Court-ordered settlement agreement with Plaintiffs, the Lolo National Forest Supervisor agreed to: (a) Withdraw the project decision; (b) monitor past maintenance/restorative treatments within old growth stands and evaluate the effects of these activities; and (c) prepare a supplemental environmental impact statement (SEIS), incorporating this new information, before proceeding with the project. Over the last several months, Lolo National Forest personnel have been monitoring the effects of past maintenance/restorative treatments in old growth stands and are currently evaluating the information they collected. The Fishtrap SEIS will incorporate the results of this monitoring work. The project proposes to implement timber harvest, pre-commercial thinning, prescribed burning, herbicide treatment of noxious weeds, temporary road construction, road improvement work, and road decommissioning in the Fishtrap Creek drainage, Lolo National Forest, Plains/Thompson Falls Ranger District, Sanders County, Montana.
Opal Creek Scenic Recreation Area (SRA) Advisory Council

The Willamette National Forest is seeking nominees for eight positions on the Opal Creek Advisory Council. The Council was originally established in June 2000 with 13 members. On April 20, 2007, eight member's terms will expire. Five of the current members will remain on the Council to provide continuity for new members. The Advisory Council makes recommendations to the Detroit District Ranger on matters relating to the management of the Opal Creek Scenic Recreation Area (SRA). The Advisory Council is composed of a diverse group of citizens, which allows for sharing of technical knowledge and personal experience. Members represent interests including, but not limited to: Timber industry; environmental organizations; mining industry; land inholders within the Opal Creek Wilderness and SRA; economic development interests; and Indian tribes. Other members serving on the Council as required by the Act represent Marion County, communities within a 25 mile radius of the SRA, State of Oregon, and City of Salem. Positions to be filled are from timber industry, economic development, Indian Tribes, communities within 25-miles of the SRA, the City of Salem, Marion County, the State of Oregon, and one at-large member. Examples of ``at-large'' members who may be interested in serving on this Council include recreation interests, adjacent landowner, educators and researchers. Nominees must be United States citizens, at least 18 years old. Willamette officials will recommend nominees' appointments to the Secretary of Agriculture based on criteria which include: (1) Familiarity with the Opal Creek SRA; (2) Knowledge and understanding of other cultures; (3) Ability to actively participate in diverse team settings; (4) Respect and credibility in local communities; (5) Past experience working with the government planning processes; (6) Demonstrated skill in working toward mutually beneficial solutions to complex issues; and (7) Commitment to attending Advisory Council and other meetings. The basic duties include sharing of technical knowledge and personal experience. Members also represent interests of appropriate groups by (1) generating information necessary for the planning and implementation process from interest groups, and (2) keeping their constituency informed of progress.
Notice of Proposed New Fee Sites; Federal Lands Recreation Enhancement Act, (Title VIII, Pub. L. 108-447)

The Willamette National Forest is planning to charge fees at six recreation sites. All sites have recently been reconstructed or amenities are being added to improve services and experiences. Fees are assessed based on the level of amenities and services provided, cost of operation and maintenance, market assessment, and public comment. The fees listed are only proposed and will be determined upon further analysis and public comment. Funds from fees would be used for the continued operation and maintenance of these recreation sites. Gold Butte and Timber Butte Lookouts will be available for overnight rental. A financial analysis is being completed to determine the rental fee but may range between $40 and $80 per night. Lookout rentals offer a unique experience and are a widely popular offering on National Forests. Gold Butte was recently resorted to maintain the lookout's eligibility to the National Register of Historic Places. Fees would continue to help protect and maintain lookouts and their historic integrity. The fee structure at Harralson Horse Camp would change from the required Recreation Pass to a $10 per campsite for overnight use. A fee of $5 per additional vehicle would be required per campsite. Recreation passes such as the Northwest Forest Pass would continue to cover day use fees at the trailhead. Additional amenities are proposed for the facility and may include hitching rails, additional corrals and campsites, and a water system. Improvements allow visitors with horses to safely secure their stock while protecting area resources from degradation. Elk Lake Campground is currently a fee free site. Improvements are being made including designating up to 17 campsites, installing fire rings, picnic tables and adding garbage service. Three new toilets were installed last year. Improvements will address sanitation and safety concerns, and improve deteriorating resource conditions and recreation experiences. A financial analysis is being completed to determine fee rates. The proposed fee to help maintain this site would range between $6 and $8 a campsite, $12-$16 for a double site, and $5 per one additional vehicle per campsite. Whitewater Trailhead would be re-established as a fee site since amenities such as toilets and garbage service have been added, and interpretive signing is being developed for this site. Recreation Passes such as the Northwest Forest Pass would cover day use fees for this trailhead. Northwest Forest Passes are $5 for a daily pass and $30 for an annual pass. The Forest Service proposes to continue charging a $5 per vehicle fee at Upper Arm Day Use Site from October through March. This newly constructed picnic site and formal swimming area opened in June of 2006, and is operated by Santiam Recreation under a concessionaire special use permit from April through September. The concessionaire currently charges a $5 per vehicle fee during the operating season of their permit.
Lake Tahoe Basin Management Unit, California, South Tahoe Greenway Multi-Use Trail Project

The South Tahoe Greenway Multi-Use Trail is a California Tahoe Conservancy (Conservancy) proposed Class I or better trail that will link Meyers, California to Stateline, Nevada, generally following the former Caltrans U.S. Highway 50 Bypass Corridor. The trail will form the backbone of the bike trail network in South Lake Tahoe and line residential and lodging uses to jobs, schools, shopping, and recreation and community areas. The trail implements specific goals and policies of the Tahoe Regional Planning Agency (TRPA), the USDA Forest Service Lake Tahoe Basin Management Unit (USFS), and Conservancy to provide a non-motorized alternative transportation corridor through South Lake Tahoe. Approximately 0.5 mile of the trail corridor will cross National Forest lands in approximately six locations.

The Priest Lake Ranger District of the Idaho Panhandle National Forests is proposing fuel reduction and forest restoration activities in the vicinity of the community of Nordman, Idaho and near Reeder Bay along Priest Lake. Priorities for treatment are those forest stands which not only have significant ground fuel accumulations, ladder fuels and/or dense tree canopies, but also are located in a geographically strategic site or are adjacent to private property, developments, public infrastructure or other important resources. The project, as proposed, will reduce hazardous forest fuels in the wildland urban interface (WUI), restore forest health and resilience and will provide additional resource benefits to water resources and grizzly bear core habitat. The USDA Forest Service will prepare an environmental impact statement (EIS) to disclose the potential environmental effects of implementing project activities on National Forest System lands within the project area.
Colville National Forest; Washington; Old Curlew Ranger Station Facilities Disposal

The Colville National Forest, USDA Forest Service, will prepare an EIS (environmental impact statement) on a proposal to sell the old Curlew Ranger Station administrative site, a 3-acre parcel including buildings, located on the south side of Curlew, in Ferry County, Washington. The parcel and buildings are no longer needed to meet public service or Forest Service mission requirements. The Forest Service Facility Realignment and Enhancement Act of 2005 authorized the Secretary of Agriculture to sell administrative sites that are no longer needed for National Forest System purposes. Project implementation is scheduled for Fiscal Year 2007. This project is not associated with the proposed Secure Rural Schools Land Sale Initiative. The Colville National Forest invites written comments and suggestions on the scope of the analysis. The agency will give notice of the full environmental analysis and decision-making process so interested and affected people may participate and contribute to the final decision.
South Mississippi Electric Power Association: Notice of Availability of an Environmental Assessment

The Rural Utilities Service, an agency which administers the U.S. Department of Agriculture's Rural Development Utilities Programs (USDA Rural Development) has prepared an Environmental Assessment (EA) related to possible financial assistance to South Mississippi Electric Power Association (SMEPA) for the proposed construction of one approximately 5.76 acre 230:161:69 kV substation, two approximately 0.1 mile 230 kilovolt (kV) electric transmission lines, one 0.4 mile 69 kV electric transmission line, and one microwave tower on an approximate fourteen (14) acre parcel in Greene County, Mississippi. SMEPA is requesting the USDA Rural Development to provide financial assistance for the proposed project.

The Agricultural Marketing Service (AMS) is reopening the comment period for 90 days for the interim final rule for mandatory country of origin labeling (COOL) for fish and shellfish covered commodities that was published in the Federal Register on October 5, 2004 (69 FR 59708). The interim final rule for fish and shellfish became effective on April 4, 2005. The interim final rule imposes requirements on certain retailers and their suppliers to notify their customers of the country of origin and the method of production (wild and/or farm-raised) of specified fish and shellfish products. The interim final rule also specifies recordkeeping responsibilities for affected retailers and their suppliers. AMS requests general comment on the costs and benefits of the interim final rule as well as the specific questions that are listed in this document. All affected persons are hereby given notice of the opportunity to submit written data and views concerning the economic impacts of the interim final rule. AMS will review the submitted comments and information as it promulgates a final rule for mandatory COOL for fish and shellfish. Comments received on issues that are outside the scope of the costs and benefits of the interim final rule will not be considered.
Notice of Availability for the Coal Creek Flood Control and Parkway Final Environmental Impact Statement

The Record of Decision (ROD) for the Coal Creek Flood Control and Parkway Final Environmental Impact Statement is now available to the public. On September 1, 2006, the Natural Resources Conservation Service (NRCS) published a Final Environmental Impact Statement consistent with the National Environmental Policy Act of 1969, as amended, to disclose potential effects to the human environment resulting from proposed flood control improvements to Coal Creek in Cedar City, Utah. A notice of availability for the ROD was previously published in the Federal Register on October 3, 2006. Availability was delayed due to additional information about the proximity of Utah prairie dogs, a threatened species under the Endangered Species Act. The NRCS is now completing formal consultation with the U.S. Fish and Wildlife Service (FWS). No construction will begin until the NRCS has received a biological opinion from the FWS. The ROD authorizes implementation of Alternative C (Replace Main Street diversion/drop structure) in conjunction with the North Field Canal Option and Parkway Option C1.

Ely Westside Rangeland Project

The Ely Ranger District, Humboldt-Toiyabe National Forest will prepare an environmental impact statement (EIS) on a proposal to authorize continued livestock grazing within the Ely Westside Rangeland Project area. The analysis will determine if a change in management direction for livestock grazing is needed to move existing resource conditions within the Ely Westside Rangeland Project area towards desired conditions. Allotments within the project area are Big Creek, Black Rock, Cherry Creek, Currant Creek, Ellison Basin, Hooper Canyon, Irwin Canyon, Illipah, Pine/Quinn Creek, Tom Plain, Treasure Hill, and Troy Mountain. There will also be a $5 fee for an extra vehicle. Overnight camping at other campgrounds on the Caribou-Targhee National Forest have shown that publics appreciate and enjoy the availability of developed recreation facilities. Funds from the fee charges will be used for the continued operation and maintenance of the Beaver Creek Campground.

An Opal Creek Scenic Recreation Area Advisory Council meeting will convene in Stayton, Oregon on Wednesday, December 6, 2006. The meeting is scheduled to begin at 6:30 p.m., and will conclude at approximately 8:30 p.m. The meeting will be held in the South Room of the Stayton Community Center located on 400 West Virginia Street in Stayton, Oregon. The Opal Creek Wilderness and Opal Creek Scenic Recreation Area Act of 1996 (Opal Creek Act) (Pub. L. 104-208) directed the Secretary of Agriculture to establish the Opal Creek Scenic Recreation Area Advisory Council. The Advisory Council is comprised of 13 members representing state, county and city governments, and representatives of various organizations, which include mining industry, environmental organizations, inholders in Opal Creek Scenic Recreation Area, economic development, Indian tribes, adjacent landowners and recreation interests. The council provides advice to the Secretary of Agriculture on preparation of a comprehensive Opal Creek Management Plan for the SRA, and consults on a periodic and regular basis on the management of the area. Tentative agenda items include: Subcommittee reports and recommendations, and Three Pools Site Rehabilitation Project proposal recommendations. A direct public comment period is tentatively scheduled to begin at 8 p.m. Time allotted for individual presentations will be limited to 3 minutes. Written comments are encouraged, particularly if the material cannot be presented within the time limits of the comment period. Written comments may be submitted prior to the December 6th meeting by sending them to Designated Federal Official Paul Matter at the address given below.
Agricultural Inspection and AQI User Fees Along the U.S./Canada Border; Delay of Effective Date

We recently published an interim rule amending the foreign quarantine and user fee regulations by removing the exemptions from inspection for imported fruits and vegetables grown in Canada and the exemptions from user fees for commercial vessels, commercial trucks, commercial railroad cars, commercial aircraft, and international air passengers entering the United States from Canada. That interim rule had an effective date of November 24, 2006. We are delaying the effective date of the removal of the user fee exemption for international air passengers until January 1, 2007, and the effective date for the remaining provisions of the rule, including the removal of the exemption from user fees for commercial vessels, commercial trucks, commercial railroad cars, and commercial aircraft entering the United States from Canada, until March 1, 2007. We are making these changes to allow additional time for affected entities to make necessary preparations to comply with the inspection and collection procedures that we will be instituting as a result of the interim rule.

The U.S. Department of Agriculture (USDA) is amending 7 CFR part 2902, Guidelines for Designating Biobased Products for Federal Procurement, to establish the effective date by which procuring agencies must give a procurement preference for qualifying biobased water tank coatings and bedding, bed linens, and towels. These two items were designated for procurement preference in a final rule published by USDA on March 16, 2006 (71 FR 13686). At that time, however, the effective date by which procuring agencies were required to give these two designated items procurement preference was deferred until such time that additional manufacturers of products within these designated items were identified. This final rule announces that additional manufacturers have been identified for each item and establishes the effective date by which procuring agencies must give these two designated items procurement preference.

This action withdraws a proposed rule published in the Federal Register on January 12, 2005, (70 FR 2034), to amend the Cotton Board Rules and Regulations by adjusting the total rate of assessment per kilogram for imported cotton for use by the Cotton Research and Promotion Program. Based on a stakeholder comment, the Agricultural Marketing Service believes that the proposed rule may not achieve its intended objectives of effectiveness and efficiency.
