Intergovernmental Advisory Committee Meeting, Northwest Forest Plan

The Intergovernmental Advisory Committee (IAC), Northwest Forest Plan (NWFP), has scheduled an educational field trip on August 17, 2005, from 8 a.m. to 5 p.m. in Yreka, California. The purpose of the field trip is to have the committee learn more about fire-prone systems and how they affect local communities. The IAC will be given an update on the work of the Regional Interagency Executive Committee (RIEC) Fire-Prone Systems subcommittee, as well as other RIEC subcommittee efforts. These topics are based on key findings and trends from the April 19-20, 2005, Science and the Northwest Forest Plan, Knowledge Gained Over a Decade conference and advice received from the IAC on April 21, 2005. Due to travel limitations, the field trip is open to committee members only. Written comments may be submitted for the meeting record.
Telecommunications Policies on Specifications, Acceptable Materials, and Standard Contract Forms

The Rural Utilities Service (RUS), an agency delivering the U.S. Department of Agriculture's Rural Development Utilities Programs, proposes amending certain regulations on telecommunications policies to include requirements presently contained in RUS Bulletin 345-3, ``Acceptance of Standards, Specifications, Equipment, Contract Forms, Manual Sections, Drawing, Materials and Equipment for the Telephone Program.'' This proposed rule would establish and codify provisions for RUS acceptance and Technical acceptance of materials used in telecommunications systems. This rule also proposes to integrate the existing regulatory sections on field trials into the procedure for product acceptance and inclusion in this codification, as well as to clarify and reorganize the field trial section. This rule would affect borrowers that are parties to planning and construction of telecommunication facilities with RUS funds and manufacturers and contractors providing products to RUS borrowers.
Revision of Land Management Plan, Dixie and Fishlake National Forests, Located in Southwest Utah.

The Dixie and Fishlake National Forests will exercise their option to adjust the land management plan revision process from compliance with the 1982 planning regulations, to conform with new planning regulations adopted in January 2005. This adjustment will have the following effects: 1. The new rule redefines forest plans to be more strategic and flexible to better facilitate adaptive management and public collaboration. 2. The new rule focuses more on the goals of ecological, social, and economic sustainability and less on prescriptive means of producing goods and services. 3. The Responsible Official who will approve the final plan will now be the Forest Supervisor instead of the Regional Forester. 4. The forests will establish an environmental management system (per ISO 14001:2004(E)) prior to completion of the revised forest plan. 5. The emphasis of public involvement will be a collaborative effort between the public and the Forest Service to incorporate the most desirable management options into a single broadly supported management direction package that will become the Forest Plan. 6. Administrative review will change from a post-decision appeals process to a predecision objection process. Public Involvement: There has been a great deal of public participation and collaborative work on this planning process over the past few years, including more than 75 public meetings. The Jacob Ryan Vegetation Management project would perform vegetation treatments on approximately 30,000 acres around Jacob Lake in Northern Arizona. The proposal would conduct ponderosa pine individual tree selection and group selection, commercial thinning, with ponderosa pine precommercial thinning of saplings, meadow restoration, fuels reduction, fuel break maintenance, hazard tree removal, and old growth and wildlife habitat management. This proposal would enhance habitat for the northern goshawk and its prey species by providing a mix of cover and more open foraging areas in accordance with the Kaibab National Forest Land and Resource Management Plan; reduce the fuel loading across the planning area; maintain fuelbreaks designed to slow the spread of wildfire; reduce the likelihood of ice on highway U.S. Highways 89A and 67 by removing trees that shade the highway; decrease the sources of dwarf mistletoe infection where they threaten the maintenance or attainment of desired forest structure; and remove young trees from selected areas that were formerly meadows.

Saltcedar; Availability of an Environmental Assessment and Finding of No Significant Impact

We are advising the public that the Animal and Plant Health Inspection Service has prepared an environmental assessment relative to the control of saltcedar (Tamarix spp.). The environmental assessment considers the effects of, and alternatives to, the release of a nonindigenous leaf beetle, Diorhabda elongata, into the environment to reduce the severity of saltcedar infestations. The environmental assessment provides a basis for our conclusion that the release into the environment of the biological control agent will not present a risk of introducing plant pests into the United States or disseminating plant pests within the United States and will not have a significant impact on the quality of the human environment. Based on its findings of no significant impact, the Animal and Plant Health Inspection Service has determined that an environmental impact statement need not be prepared.

This proposed rule invites comments on procedures for a California Clingstone Peach Diversion Program. The program would be voluntary and consist entirely of tree removal. The program would be implemented under clause (3) of section 32 of the Act of August 24, 1935, as amended. Based on 2003 and prior season acreage, production, supply, and marketing information for California clingstone peaches, the proposed program is expected to bring the domestic canned peach supply more in line with the market and provide relief to growers faced with excess acreage and supplies, and with low prices. The program would ensure that removal is not part of the normal process of tree replacement. This rule also announces the Agricultural Marketing Service's intention to request approval by the Office of Management and Budget (OMB) of the new information collection requirements necessary to implement the proposed California Clingstone Peach (Tree Removal) Diversion Program.

Irish Potatoes Grown in Washington; Modification of Special Purpose Shipment Regulations

This rule modifies the special purpose shipment regulations currently prescribed under the Washington potato marketing order. The marketing order regulates the handling of Irish potatoes grown in Washington, and is administered locally by the State of Washington Potato Committee (Committee). This rule modifies the reporting requirements, procedures, and safeguard provisions for making certain special purpose potato shipments. Under the marketing order, such special purpose shipments may be exempted from the quality, assessment, or inspection requirements. The changes include removal of the special purpose exemption for exported potatoes, clarification of the reporting procedures for potatoes diverted to processing, and addition of safeguard provisions for shipments of seed potatoes and shipments to charitable organizations. These changes will help facilitate special purpose shipments, while enhancing the Committee's compliance program.
Sweet Cherries Grown in Designated Counties in Washington; Order Amending Marketing Order No. 923

This rule amends the marketing order (order) for sweet cherries grown in Washington. Sweet cherry growers, voting in a mail referendum held March 1 through March 21, 2005, voted on four amendments proposed by the Washington Cherry Marketing Committee (Committee), which is responsible for local administration of the order, and two amendments proposed by the Agricultural Marketing Service of USDA. Of the six amendments proposed, three were favored, including: Adding authority for the Committee to accept voluntary contributions for research and promotion; establishing tenure limitations for Committee members; and requiring that continuance referenda be conducted every 6 years. The three amendments that failed include: adding authority for promotion, including paid advertising, and production research projects; adding authority for supplemental rates of assessment for individual varieties of cherries; and, adding a public member to the Committee. These amendments will not be implemented.
Nectarines and Peaches Grown in California; Revision of Handling Requirements for Fresh Nectarines and Peaches

The Department of Agriculture (USDA) is adopting, as a final rule, with changes, an interim final rule revising the handling requirements for California nectarines and peaches by modifying the grade, size, maturity, and pack requirements for fresh shipments of these fruits, beginning with 2005 season shipments. This rule also authorizes continued shipments of ``CA Utility'' quality nectarines and peaches, and revises weight-count standards for fruit in volume-filled containers. The marketing orders regulate the handling of nectarines and peaches grown in California and are administered locally by the Nectarine Administrative and Peach Commodity Committees (committees). This rule enables handlers to continue to ship fresh nectarines and peaches in a manner that meets consumer needs, increases returns to producers and handlers, and reflects current industry practices.

We are adopting as a final rule, without change, an interim rule that amended the Karnal bunt regulations by adding certain areas in La Paz, Maricopa, and Pinal Counties, AZ, and Riverside County, CA, to the list of regulated areas and by removing certain areas or fields in Maricopa and Pinal Counties, AZ, and Imperial County, CA, from the list of regulated areas. Those actions were necessary to prevent the spread of Karnal bunt to noninfected areas of the United States and to relieve restrictions on certain areas that are no longer necessary

Change in Minimum Quality and Handling Standards for Domestic and Imported Peanuts Marketed in the United States

This rule changes the peanut quality and handling standards (Standards) to require that domestic and imported peanuts be dried to 18 percent moisture or less prior to inspection and to 10.49 percent or less prior to storing or milling. Virginia-type peanuts used for seed must be dried to 18 percent or less prior to inspection and to 11.49 percent or less prior to storing or milling. The Standards and the Peanut Standards Board (Board) were established by the Department of Agriculture (USDA), pursuant to section 1308 of the Farm Security and Rural Investment Act of 2002. The Board suggested changing the peanut quality and handling standards to allow handlers and importers to receive or acquire high moisture peanuts to promote the development of new drying technologies, increase efficiencies, and reduce costs to the industry.
