Defense Nuclear Facilities Safety Board – Federal Register Recent Federal Regulation Documents

The Defense Nuclear Facilities Safety Board (Board) published a document in the Federal Register on April 2, 2015, (80 FR 17735), concerning notice of a public meeting and hearing on April 29, 2015, regarding the underground recovery of the Waste Isolation Pilot Plant and safe resumption of waste operations. That notice stated that the Board would be setting aside time for three public comment periods: (1) At the conclusion of Sessions II; (2) at the conclusion of Session III; and (3) just prior to the Board beginning deliberations in Session IV. The Board wishes to correct that statement to indicate that opportunity for public comment is limited to just two comment periods: (1) At the conclusion of Session II; and (2) just prior to the Board's deliberations in Session IV.

The Defense Nuclear Facilities Safety Board (Board) is promulgating a final rule which establishes procedures for conducting preliminary and formal safety investigations of events or practices at Department of Energy (DOE) defense nuclear facilities that the Board determines have adversely affected, or may adversely affect, public health and safety. The Board's experience in conducting formal safety investigations necessitates codifying the procedures set forth in this final rule. Among other benefits, these procedures will ensure a more efficient investigative process, protect confidential and privileged safety information, and promote uniformity of future safety investigations. The rule also promotes public awareness through greater transparency in the conduct of Board investigations.

Pursuant to 42 U.S.C. 2286a(b)(5), the Defense Nuclear Facilities Safety Board has made a recommendation to the Secretary of Energy concerning the need to take actions to improve the emergency preparedness and response capability at the Department of Energy's (DOE) defense nuclear facilities.

Pursuant to the provisions of the ``Government in the Sunshine Act'' (5 U.S.C. 552b), and as authorized by 42 U.S.C. 2286b, notice is hereby given of the Defense Nuclear Facilities Safety Board's (Board) public meeting and hearing described below. The Board invites any interested persons or groups to present any comments, technical information, or data concerning safety issues related to the matters to be considered.

The Defense Nuclear Facilities Safety Board (Board) published a document in the Federal Register on March 7, 1991 (56 FR 9609), implementing the provisions of the Government in the Sunshine Act. Subsequently, the Fiscal Year 2013 National Defense Authorization Act further amended the Atomic Energy Act of 1954, changing and renumbering the Board's enabling legislation. This document corrects the final regulations by changing the referenced sections in the Board's rules implementing the Government in the Sunshine Act.

The Defense Nuclear Facilities Safety Board is publishing its Freedom of Information Act (FOIA) Fee Schedule Update pursuant to the Board's regulations.

Pursuant to the Board's regulations, the Defense Nuclear Facilities Safety Board is publishing its proposed Freedom of Information Act (FOIA) Fee Schedule Update and solicits comments from interested organizations and individual members of the public.

The Defense Nuclear Facilities Safety Board (Board) published a document in the Federal Register of August 13, 2013, (78 FR 49262), concerning notice of intent to convene a public meeting and hearing on October 22, 2013, at the Knoxville Convention Center, 701 Henley Street, Knoxville, Tennessee 37902 with regard to safety-related matters at defense nuclear facilities at the Y-12 National Security Complex. Due to the lapse in appropriations and subsequent federal government shutdown, the Board decided to postpone the meeting and hearing to a future date. The Board was unable to publish notice of the postponement in the Federal Register due to the shutdown. The Board has now decided on a new time and date for the proceeding. There is no change to the hearing location or the matters to be considered that were originally described in the Board's August 13, 2013, notice cited above.

This notice announces the membership of the Defense Nuclear Facilities Safety Board (DNFSB) Senior Executive Service (SES) Performance Review Board (PRB).

The Defense Nuclear Facilities Safety Board (Board) published a document in the Federal Register on January 22, 2013, (78 FR 4393), as amended, February 19, 2013, (78 FR 11632). The publication concerned notice of a hearing and meeting on March 14, 2013, regarding safety culture, emergency preparedness, and safety issues at the Pantex Plant. The Board stated in the January 22, 2013, hearing notice that the hearing record would remain open until April 15, 2013, for the receipt of additional materials. The Defense Nuclear Facilities Safety Board (Board) published a document in the Federal Register of March 3, 2011 (76 FR 11764), concerning notice of a public hearing and meeting on March 31, 2011, with regard to the Department of Energy's and National Nuclear Security Administration's safety management and oversight of the contracts and contractors they rely upon to accomplish the mission assigned under the Atomic Energy Act of 1954, as amended, at defense nuclear facilities. The public hearing and meeting has been postponed. The Board intends to reschedule the hearing and meeting and will publish a notice of the rescheduled date in the Federal Register when that date has been determined.
