Equal Opportunity for Religious Organizations in USDA Programs: Implementation of E.O. 13559

This rule proposes to revise USDA's regulation that covers equal opportunity for participation of faith-based (religious) organizations in USDA programs. These revisions are being undertaken to implement Executive Order 13559, Fundamental Principles and Policymaking Criteria for Partnerships with Faith-Based and Other Neighborhood Organizations. Executive Order 13559 amended Executive Order 13279, Equal Protection of the Laws for Faith-Based and Community Organizations, which provides the legal basis for USDA's current equal participation regulations to protect religious liberty rights of beneficiaries of USDA funded programs. This rule adopts changes to Executive Order 13279 made by Executive Order 13559, including changes to specific terminology, additional beneficiary protections, and clarifications on the responsibilities of intermediaries. In addition to proposing regulatory amendments to implement Executive Order 13559, USDA is also publishing for public comment a Paperwork Reduction Act information collection notice of beneficiary protections for use by religious organizations.

On April 27, 2015, the Natural Resources Conservation Service (NRCS) published an NOA in the Federal Register announcing the availability of a draft EA for VPA-HIP and requesting public comment. The draft EA was available for a 30-day public comment period that ended May 27, 2015. The draft EA was prepared to meet the requirements of the National Environmental Policy Act (NEPA) of 1969 and NRCS implementing regulations. Brief comments were received from one State and those comments expressed no concerns about the analysis or the effects of the program. NRCS has determined that implementing VPA-HIP is not a major Federal action significantly affecting the quality of the human environment within the context of NEPA and, therefore, an Environmental Impact Statement will not be prepared.

The Rural Housing Service (Agency) announces the timeframe to submit applications to participate in a demonstration program to preserve and revitalize existing Rural Rental Housing (RRH) projects under Section 514, Section 515, and Section 516 of the Housing Act of 1949, as amended. Under this demonstration program, existing Section 515 Multi-Family Housing (MFH) loans and Sections 514/516 Off-Farm Labor Housing (FLH) loans will be restructured to ensure sufficient resources are available to preserve the ability of rental projects to provide safe and affordable housing for very low-, low-, or moderate- income residents. Projects participating in this program will be expected to be revitalized to extend their affordable use without displacing tenants because of increased rents. No additional Agency Rental Assistance (RA) will be made available under this program.

This proposed rule would address recommendations submitted to the Secretary of Agriculture (Secretary) by the National Organic Standards Board (NOSB) following their October 2014 meeting. These recommendations pertain to the 2015 Sunset Review of substances on the U.S. Department of Agriculture's (USDA) National List of Allowed and Prohibited Substances (National List). Consistent with the recommendations from the NOSB, this proposed rule would remove two non- organic agricultural substances from the National List for use in organic handling, fortified cooking winesmarsala wine and sherry wine. This proposed rule would also remove two listings for synthetic substances allowed for use in organic crop production on the National List, streptomycin and tetracycline, as their use exemptions expired on October 21, 2014.

Rural Broadband Access Loans and Loan Guarantees

The Rural Utilities Service, an agency of the United States Department of Agriculture, hereinafter referred to as the Agency, is amending its regulation for the Rural Broadband Access Loan and Loan Guarantee Program (Broadband Loan Program) to implement the Agricultural Act of 2014 (the 2014 Farm Bill). The enactment of the 2014 Farm Bill made changes the Agency must adopt prior to accepting applications for future loans. The Agency is publishing this regulation as an interim rule, which will take effect upon publication in the Federal Register, and will allow the Agency to begin accepting applications once again. In addition, the Agency is seeking comments regarding this interim rule to guide its efforts in drafting the final rule for the Broadband Loan Program.

Dairy Tariff-Rate Quota Import Licensing Program

This final rule amends the regulation that provides for the issuance of licenses to import certain dairy articles under tariff-rate quotas (TRQs) as set forth in the Harmonized Tariff Schedule of the United States. The three most significant changes to the rule are to suspend for an additional seven years the historical license reduction provision which was set to expire with the beginning of quota year 2016; to modify procedures for collecting licensing fees in order to better align the fee collection to the costs of administering the program; and to exclusively use electronic communications in the application, reporting and payment processes. The expected outcome from these changes is to allow license holders to adjust to changing market conditions impacting the dairy sector; increase the Department's ability to more closely align cost recovery with the actual costs of administering the program; and allow the Department to reduce lag times, minimize paper files, and increase the efficiency of the program operations.

As part of the National Institute of Food and Agriculture's (NIFA) strategy to implement section 7404 of Public Law 113-79, the Agricultural Act of 2014, NIFA is soliciting topics from eligible commodity board entities (Federal and State-level commodity boards, as defined below) which they are willing to equally co-fund with NIFA. Such topics must relate to the established priority areas of the Agriculture and Food Research Initiative Competitive Grants Program (AFRI) to be considered for inclusion in future AFRI Requests for Applications (RFAs). Commodity boards are those entities established under a commodity promotion law (as such term is defined under section 501(a) of the Federal Agriculture Improvement and Reform Act of 1996 (7 U.S.C. 7401(a))) or a State commodity board (or other equivalent State entity). See the SUPPLEMENTARY INFORMATION section of this Notice under the heading ``Eligibility for Submitting Topics'' for further information. If proposed topics are accepted for inclusion in an AFRI RFA after evaluation by NIFA, they will be incorporated into AFRI competitive grants program RFAs. As a condition of funding grants in a topic, NIFA will require an agreement with the commodity board to provide funds that are equal to the amount NIFA is contributing under the agreed upon topic. This Notice invites topic submissions from commodity boards as defined above, outlines the process NIFA will use to evaluate the appropriateness of these topics for inclusion in AFRI RFAs, and describes the commitment commodity boards will be required to make in order for NIFA to jointly fund AFRI applications competitively selected for award within a topic area submitted by the commodity boards.

The Forest Service proposes to revise its internal Agency directives for American Indian and Alaska Native Relations to establish better direction for the Agency to work effectively with Indian tribes. Specifically, the proposed directives modify Forest Service staff roles and responsibilities, establish staff training standards, describe authorities for working with Indian tribes, delineate consultation procedures, explain the historical trust and treaty responsibility underlying the government-to-government relationship, and outline Dispute Resolution options within the Forest Service. The proposed directives cross reference to other Forest Service directives, including those detailing aspects of Business Operations, National Forest System Management, State and Private Forestry, and Research and Development. The proposed directives were reorganized and revised to be consistent with the 2013 U.S. Department of Agriculture (USDA) Departmental Regulation No. 1350-002 ``Tribal Consultation, Coordination, and Collaboration''; Report to the Secretary, USDA Policy and Procedures Review and Recommendations: Indian Sacred Sites (2012), legislation (including the Culture and Heritage Cooperation Authority provisions of the Food, Conservation, and Energy Act of 2008 [Public Law 110-246; the Farm Bill]), and input from Forest Service Field staff. The directives were last revised in 2004, with an Interim Directive issued in 2012. These proposed directives have tribal implications as defined by Executive Order 13175, ``Consultation and Coordination with Indian Tribal Governments.'' The 120-day consultation with Tribes was conducted from June 6, 2013, to November 27, 2013, consistent with the Executive Order and the current Forest Service directives. Tribal consultation continued after October 6, 2013, and will end at the same time as the public comment period. All comments received so far have been supportive of the revised directives. Tribal consultation and public comment are invited and will be considered by the Agency in determining the scope of the final directives.
