The U.S. Nuclear Regulatory Commission (NRC) is issuing a confirmatory order to Tennessee Valley Authority (TVA or Licensee), the holder of License Nos. DPR-33, DPR-52, DPR-68, authorizing the operation of Browns Ferry Nuclear Plant, Units 1, 2, and 3. The facility is located on the Licensee's site in Athens, Alabama. The order was a result of Alternative Dispute Resolution between the NRC and TVA, and required TVA to complete a number of corrective actions to address the submittal of information to the NRC that was not complete and accurate in all material respects, and to address TVA's change to a license condition without submitting an amendment request. The order is related to control room staffing levels that were not sufficient to implement certain fire response procedures and achieve safe shutdown on the three-unit site during a postulated fire event.

The U.S. Nuclear Regulatory Commission (NRC) is issuing NUREG- 1966, ``Final Safety Evaluation Report Related to the Certification of the Economic Simplified Boiling-Water Reactor Standard Design.'' On August 24, 2005, General Electric-Hitachi Nuclear Energy tendered its application for certification of the economic simplified boiling-water reactor (ESBWR) standard nuclear reactor design to the NRC. The application included the ESBWR design control document (DCD) and the ESBWR probabilistic risk assessment (PRA). On March 24, 2011, the NRC published the proposed rule in the Federal Register.

We are required to publish this notice in the Federal Register under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: 10 CFR part 61, Licensing Requirements for Land Disposal of Radioactive Waste. 2. Current OMB approval number: 3150-0135. 3. How often the collection is required: Applications for licenses are submitted as needed. Other reports are submitted annually and as other events require. 4. Who is required or asked to report: Applicants for and holders of an NRC license (to include Agreement State licensees) for land disposal of low-level radioactive waste; and all generators, collectors, and processors of low-level waste intended for disposal at a low-level waste facility. 5. Abstract: Part 61 of Title 10 of the Code of Federal Regulations establishes the procedures, criteria, and license terms and conditions for the land disposal of low-level radioactive waste. The reporting and recordkeeping requirements are mandatory and, in the case of application submittals, are required to obtain a benefit. The information collected in the applications, reports, and records is evaluated by the NRC to ensure that the licensee's or applicant's disposal facility, equipment, organization, training, experience, procedures, and plans provide an adequate level of protection of public health and safety, common defense and security, and the environment. The title of the information collection: Evaluation of Outreach Efforts Related to the NRC's Safety Culture Policy Statement. 3. Current OMB approval number: 3150-XXXX. 4. Who will be required or asked to report: Respondents asked to voluntarily participate in this information collection activity will include licensees of the NRC's Office of Federal and State Materials and Environment Management Programs, fuel cycle, transportation and storage, and greater than critical mass licensees overseen by the NRC's Office of Nuclear Materials Safety and Safeguards, and materials licensees of the following Agreement States that have expressed interest in participating: Illinois, Minnesota, North Carolina, Ohio, Rhode Island, Virginia, Washington, and Wisconsin. 7. An estimate of the number of annual responses: 6,158 licensees of the NRC and participating Agreement States will be invited to participate in this one-time, voluntary information collection activity. Because the survey will only be administered once during the three year clearance period, the annualized number of responses is 1,026.3 responses. 8. An estimate of the total number of hours needed annually to complete the requirement or request: The survey is estimated to take no more than 20 minutes (0.33 hours) per respondent. The total annualized burden is estimated to be 338.7 hours. 10. Abstract: In June 2011, the NRC issued its Safety Culture Policy Statement, which describes the Commission's expectation that the NRC's regulated community maintain a positive safety culture. The NRC continues to seek ways to engage with stakeholders, licensees, members of the public, and the international community to provide outreach and education on the Safety Culture Policy Statement. The purpose of the current information collection activity is to gather feedback on whether NRC's outreach and communication activities have been effective in promoting awareness of the Safety Culture Policy Statement, and to determine if changes to current activities and/or new activities are necessary and appropriate. To support this evaluation, the NRC staff plans to conduct a voluntary survey of its materials regulated community, specifically materials users, organizations involved in the fuel cycle, and storage and transportation of nuclear materials. The NRC staff has also invited Agreement States (i.e., States that have signed formal agreements with the NRC to assume regulatory responsibility over certain byproduct and source nuclear materials, as well as small quantities of special nuclear materials) to participate by voluntarily administering the survey to materials users they regulate, and eight states have agreed to participate. The NRC has determined that a standardized voluntary survey is the most practical means of gathering feedback on its outreach and communications regarding the Safety Culture Policy Statement. Using a survey approach for the evaluation allows for input to be solicited from a wide range of licensees in an efficient and consistent manner. ESBWR Design Certification

The U.S. Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to certify the Economic Simplified Boiling-Water Reactor (ESBWR) standard plant design. The proposed ESBWR design certification rule was published for public comment on March 24, 2011. The NRC is publishing this supplemental proposed rule to provide an opportunity for the public to comment on two matters. The first is proposed changes related to the analysis methodology supporting the ESBWR steam dryer design that were made after the close of the public comment period for the proposed ESBWR design certification rule. The second is the NRC's proposed clarification of its intent to treat 50 referenced documents within Revision 10 of the ESBWR design control document (DCD) as requirements and matters resolved in subsequent licensing and enforcement actions for plants referencing the ESBWR design certification. In addition, the supplemental proposed rule clarifies that the NRC intends to obtain approval for incorporation by reference from the Director of the Office of the Federal Register for the generic DCD and 20 publicly-available documents that are referenced in the DCD that are intended by the NRC to be requirements. The supplemental proposed rule does not offer an opportunity for public comment on this clarification of the NRC's intent. Finally, the supplemental proposed rule updates the version of the DCD (from Revision 9 to Revision 10) which the NRC proposes to obtain approval for incorporation by reference from the Office of the Federal Register. Revision 10 of the DCD was needed to address the previously described matters. The applicant for certification of the ESBWR design is GE- Hitachi Nuclear Energy (GEH).

The U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment a draft NUREG-1022, Revision 3, Supplement 1, ``Event Reporting Guidelines: 10 CFR 50.72(b)(3)(xiii).'' In draft NUREG-1022, Revision 3, Supplement 1, the NRC proposes to endorse Nuclear Energy Institute (NEI) 13-01, ``Reportable Action Levels for Loss of Emergency Preparedness Capabilities,'' dated October 2013. NEI 13-01 provides specific guidance for reporting to the NRC any event that results in a major loss of emergency assessment capability, offsite response capability, or offsite communications capability.

Under conditions listed in the license, the Source and Byproduct Materials License SUA- 1601 authorizes Strata to operate its facilities as proposed in its license application, as amended, and to possess uranium source and byproduct material at the Ross ISR Facility. In addition, the NRC staff has published a record of decision (ROD) that supports the NRC's decision to approve Strata's license application for the Ross ISR Facility and to issue the license.

The U.S. Nuclear Regulatory Commission (NRC) is granting an exemption to allow a departure from the certification information of Tier 1 of the generic design control document (DCD) and issuing License Amendment No. 11 to Combined Licenses (COL) NPF-93 and NPF-94. The COLs were issued to South Carolina Electric and Gas (SCE&G) and South Carolina Public Service Authority (Santee Cooper) (the licensee), for construction and operation of the Virgil C. Summer Nuclear Station (VCSNS), Units 2 and 3 located in Fairfield County, South Carolina. The amendment requests changes that modify the Chemical and Volume Control System (CVS), including changes to information located in Tier 1 Tables 2.3.2-1 and 2.3.2-2, and Tier 1 Figures 2.2.1-1 and 2.3.2-1. The granting of the exemption allows the changes to Tier 1 information as specified in the license amendment request (LAR). Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.

The COLs were issued to Southern Nuclear Operating Company (SNC), Georgia Power Company, Oglethorpe Power Corporation, Municipal Electric Authority of Georgia, and City of Dalton, Georgia (the licensee), for construction and operation of the Vogtle Electric Generating Plant (VGEP), Units 3 and 4, located in Burke County, Georgia. The amendment revises the UFSAR by making changes to the Non-Class 1E dc and Uninterruptible Power Supply System (EDS) and Class 1E dc and Uninterruptible Power Supply System (IDS) and making changes to the corresponding Tier 1 information in Appendix C to the Combined Licenses. The granting of the exemption allows the changes to Tier 1 information asked for in the amendment. Because the acceptability of the exemption was determined in part by the acceptability of the amendment, the exemption and amendment are being issued concurrently.

These conditions apply during termination of the worker's employment, at the request of the workers, former workers, or when the worker's employer (the NRC licensee) must report radiation exposure information on the worker to the NRC. Part 19 also establishes requirements for instructions by licensees to individuals participating in licensed activities and options available to these individuals in connection with Commission inspections of licensees to ascertain compliance with the provisions of the Atomic Energy Act of 1954, as amended, Title II of the Energy Reorganization Act of 1974, and regulations, orders and licenses there under regarding radiological working conditions. The worker should be informed of the radiation dose he or she receives because: (a) That information is needed by both a new employer and the individual when the employee changes jobs in the nuclear industry; (b) the individual needs to know the radiation dose received as a result of the accident or incident (if this dose is in excess of the 10 CFR Part 20 limits) so that he or she can seek counseling about future work involving radiation, medical attention, or both, as desired; and (c) since long-term exposure to radiation may be an adverse health factor, the individual needs to know whether the accumulated dose is being controlled within the NRC limits. On March 24, 2014, the U.S. Nuclear Regulatory Commission (NRC) published for public comment a proposed rule revising the acceptance criteria for the emergency core cooling system (ECCS) for light-water nuclear power reactors. The NRC is also seeking public comment on three draft regulatory guides that would support the implementation of the proposed rule. The public comment period for the proposed rule and associated draft guidance was to have ended on June 9, 2014. The public comment period for information collection aspects of this rule was to have ended on April 23, 2014. Due to requests from members of the public, the NRC has extended the comment periods for the proposed rule, the associated draft guidance, and the information collection aspects until August 21, 2014.
