The U.S. Nuclear Regulatory Commission (NRC) is requesting public comment on the proposed model safety evaluation (SE) for plant- specific adoption of Technical Specifications (TS) Task Force (TSTF) Traveler TSTF-432, Revision 1, ``Change in Technical Specifications End States (WCAP-16294).'' TSTF-432, Revision 1, is available in the Agencywide Documents Access and Management System (ADAMS) under Accession Number ML103360003; the model application is available in ADAMS under Accession Number ML113202614. The proposed model SE for plant-specific adoption of TSTF-432, Revision 1, is available electronically under ADAMS Accession Number ML112991526. The proposed change revises the Improved Standard Technical Specification (ISTS), NUREG-1431, ``Standard Technical Specifications Westinghouse Plants,'' to permit, for some systems, entry into a hot shutdown (Mode 4) end state rather than a cold shutdown (Mode 5) end state. The model SE will facilitate expedited approval of plant- specific adoption of TSTF-432, Revision 1. This TS improvement is part of the consolidated line item improvement process (CLIIP).

The U.S. Nuclear Regulatory Commission (NRC or the Commission) is closing a petition for rulemaking (PRM-31-5) submitted by the Organization of Agreement States, Inc. (OAS). The petition requested that the NRC amend its regulations to strengthen the regulation of radioactive materials by requiring a specific license for higher- activity devices that are currently available under a general license, and change the compatibility designation of applicable regulations from category B to category C. The petition also addresses a request filed by the Florida Department of Health, Bureau of Radiation Control, to change the compatibility category of a certain part of the applicable regulation from category B to category C. In response to the petition, the NRC developed a proposed rule that would have changed the compatibility of the applicable regulations, and would have limited the quantity of byproduct material contained in a generally-licensed device to below one-tenth of the International Atomic Energy Agency (IAEA) Category 3 thresholds. After further review, the NRC has decided to withdraw the proposed rule and to change the compatibility designation of the applicable regulations from category B to category C.

The U.S. Nuclear Regulatory Commission (NRC) is correcting the preamble, or statements of consideration (SOC), and the codified text in a final rule that was published in the Federal Register on June 21, 2011 (76 FR 36232). The final rule amended the NRC's regulations to incorporate by reference various editions and addenda to the ASME Boiler and Pressure Vessel (B&PV) Code, and the ASME Code for Operation and Maintenance of Nuclear Power Plants (OM Code). The final rule also incorporated by reference (with conditions on their use) ASME B&PV Code Cases N-722-1 and N-770-1. This document is necessary to correct typographical, formatting, and punctuation errors.

The U.S. Nuclear Regulatory Commission (NRC) plans to conduct a public meeting on January 24, 2012, in Rockville, Maryland, to solicit input on a draft Branch Technical Position (BTP) on the Import of non-U.S. Origin Radioactive Sources. In 2010, the NRC published a final rule amending 10 CFR part 110 (75 FR 44072; July 28, 2010). Among other things, it added the phrase ``Of U.S. origin'' to the first exclusion to the definition of ``radioactive waste'' in Sec. 110.2. The phrase was added to the final rule in response to a public comment on the proposed rule to clarify the exclusion. Since publication of the final rule, industry has raised concerns with NRC staff regarding established industry practices and the need for guidance on implementation of the ``U.S. origin'' exclusion. The staff is holding a public meeting to obtain comments from stakeholders on the draft BTP and to discuss implementation issues associated with the ``U.S. origin'' exclusion.

Notice is hereby given that the U.S. Nuclear Regulatory Commission (NRC) is issuing for public comment the Draft Environmental Impact Statement (EIS) for the Proposed Fluorine Extraction Process and Depleted Uranium Deconversion Plant. By letter dated December 30, 2009, International Isotopes Fluorine Products, Inc. (IIFP), a wholly-owned subsidiary of International Isotopes, Inc., submitted a license application, which included an Environmental Report that proposes the construction, operation, and decommissioning of a fluoride extraction and depleted uranium deconversion facility to be located in Lea County, New Mexico (the ``proposed action''). This Draft EIS is being issued as part of the NRC's process to decide whether to issue a license to IIFP, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 40, to build and operate the proposed depleted uranium deconversion facility. Specifically, IIFP proposed to deconvert depleted uranium hexafluoride (DUF6) into uranium oxide compounds for long-term disposal. The NRC staff will hold a public meeting on February 2, 2012, to present an overview of the licensing process and the contents of the Draft EIS, and to accept oral and written public comments on the Draft EIS. The meeting will take place at the Lea County Event Center, 5101 Lovington Highway in Hobbs, New Mexico. For 1 hour prior to the public meeting, the NRC staff will be available to informally discuss the proposed IIFP project and answer questions in an ``open house'' format. This ``open house'' format provides for one-on-one discussions with the NRC staff involved with the preparation of the Draft EIS. The Draft EIS public meeting will officially begin at 5:30 p.m. The meeting will include the following agenda items: (1) A brief presentation of NRC's roles and responsibilities and the licensing process; (2) a presentation summarizing the contents of the Draft EIS; and (3) an opportunity for interested government agencies, Tribal governments, organizations, and individuals to provide comments on the draft EIS. The public meeting will be transcribed by a court reporter, and the meeting transcript will be made publicly available at a later date. Persons wishing to provide oral comments at the public meeting may register in advance by contacting Ms. Antoinette Walker-Smith at (800) 368-5642, ext. 6390 no later than January 26, 2012. Those who wish to present comments may also register at the meeting. Individual oral comments may have to be limited by the time available, depending upon the number of persons who register. Written comments can also be provided at the meeting, and should be given to an NRC staff person at the registration desk at the meeting entrance. If special equipment or accommodations are needed to attend or present information at the public meeting, the need should be brought to the attention of Ms. Antoinette Walker-Smith at (800) 368-5642, ext.6390, no later than January 26, 2012, to provide NRC staff with adequate notice to determine whether the request can be accommodated. The U.S. Nuclear Regulatory Commission (NRC or the Commission) is issuing a new regulatory guide (RG) 3.74, ``Guidance for Fuel Cycle Facility Change Processes.'' This regulatory guide describes the types of changes for which fuel cycle facility licensees should seek prior approval from the NRC and discusses how licensees can evaluate potential changes to determine whether NRC approval is required before implementing a change. This regulatory guide also describes the level of information that the NRC staff considers acceptable for use in documenting and reporting changes made without prior NRC approval.
