The NRC has recently submitted to OMB for review the following proposal for the collection of information under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). The NRC hereby informs potential respondents that an agency may not conduct or sponsor, and that a person is not required to respond to, a collection of information unless it displays a currently valid OMB control number. The NRC published a Federal Register Notice with a 60-day comment period on this information collection on February 9, 2009.

The Nuclear Regulatory Commission (NRC) has received a petition for rulemaking dated December 14, 2007, and revised on December 19, 2007, filed by Raymond A. West (petitioner). The petition was docketed by the NRC and has been assigned Docket No. PRM-50-89. The petitioner is requesting that the NRC amend the regulations that govern domestic licensing of production and utilization facilities at nuclear power plants. Specifically, the petitioner is requesting that the regulations that govern codes and standards at nuclear power plants be amended to provide applicants and licensees a process for requesting NRC approval of changes or modifications to American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code) cases that are listed in the relevant NRC-approved regulatory guides cited in the current regulations. The petitioner believes that the current requirements do not allow changes or modifications to be proposed as alternatives to NRC-approved ASME Code cases. This action provides notice that the NRC will consider the petitioner's request in the NRC's rulemaking process.

The Nuclear Regulatory Commission (NRC) is issuing this Advance Notice of Proposed Rulemaking (ANPR) to begin the process of establishing generic requirements for NRC research and test reactor (RTR) licensees to obtain fingerprint-based criminal history record checks on individuals having unescorted access to their facilities. This action is taken to inform all interested parties of the options that the NRC is considering for implementing the requirements of the Energy Policy Act of 2005 (EPAct) as they pertain to RTRs.

The NRC invites public comment about our intention to request the OMB's approval for renewal of an existing information collection that is summarized below. NRC will convene a meeting of the Advisory Committee on the Medical Uses of Isotopes (ACMUI) on May 7-8, 2009. A sample of agenda items to be discussed during the public session includes: (1) Summary of the enforcement process and enforcement actions against medical licensees; (2) regulatory responsibilities of the U.S. Food and Drug Administration; (3) ACMUI subcommittee report on byproduct material events; (4) ACMUI subcommittee report on training and experience for yttrium-90 microspheres users; (5) National Academy of Science report on the production of medical isotopes using highly enriched uranium and low enriched uranium; (6) briefing on the Veterans Affairs medical events; (7) infiltrations of therapeutic radiopharmaceuticals as medical events; (8) National Council on Radiation Protection & Measurements Report 160 ``Ionizing Radiation Exposure of the Population of the United States'' and its implications for NRC programs; (9) ACMUI subcommittee report on training and experience for American Board of Radiology certification; (10) medical event reporting to the International Nuclear Event Scale; and (11) potential changes to 10 CFR Part 35.
