The U.S. Nuclear Regulatory Commission (NRC) is soliciting public comment on its Proposed License Renewal Interim Staff Guidance LR-ISG-2008-01 (LR-ISG) for clarification to its previously issued LR- ISG-02, ``Staff Guidance on Scoping of Equipment Relied on to Meet the Requirements of the Station Blackout (SBO) Rule (10 CFR 50.63) for License Renewal,'' dated April 1, 2002, which has been incorporated in the License Renewal Standard Review Plan. This LR-ISG provides additional clarification to the staff position on the license renewal scoping requirements regarding the offsite power system for SBO recovery. The NRC staff issues LR-ISGs to facilitate timely implementation of the license renewal rule and to review activities associated with a license renewal application. Upon receiving public comments, the NRC staff will evaluate the comments and make a determination to incorporate the comments, as appropriate. Once the NRC staff completes the LR-ISG, it will issue the LR-ISG for NRC and industry use. The NRC staff will also incorporate the approved LR-ISG into the next revision of the license renewal guidance documents.

The Nuclear Regulatory Commission (NRC) staff is making available preliminary draft rule language that would constitute amendments to its regulations on emergency preparedness (EP). The release of the preliminary draft requirements is intended to inform stakeholders of the current status of the NRC's activities on its EP rulemaking. The goal of this rulemaking is to enhance EP regulations based on operating experience and the post-September 11, 2001, threat environment. The Commission has not reviewed the preliminary draft rule language, and this preliminary draft rule language may be subject to significant revisions during the rulemaking process.

The U.S. Nuclear Regulatory Commission (NRC) is withdrawing a direct final rule that would have revised the Holtec International HI- STORM 100 cask system listing within the ``List of Approved Spent Fuel Storage Casks'' to include Amendment No. 5 to the Certificate of Compliance. The NRC is taking this action because it has received a significant adverse comment in response to the direct final rule. This significant adverse comment shall be considered as a comment to the companion proposed rule that was published concurrently with the direct final rule.

As required by Title 10 of the Code of Federal Regulations (10 CFR) Part 51, the NRC has prepared a final Environmental Assessment (EA) as its evaluation of a request by the PSEG Nuclear, LLC (PSEG) for a license amendment to increase the maximum thermal power at Hope Creek Generating Station (HCGS) from 3,339 megawatts-thermal (MWt) to 3,840 MWt. The EA assesses environmental impacts up to a maximum thermal power level of 3,952 MWt, as the applicant's environmental report was based on that power level. The NRC staff did not identify any significant impact from the information provided in the licensee's EPU application for HCGS or from the NRC staff's independent review. The final EA and Finding of No Significant Impact are being published in the Federal Register. The NRC published a draft EA and finding of no significant impact on the proposed action for public comment in the Federal Register on October 22, 2007 (72 FR 59563). Two sets of comments were received on the draft EA: (1) From PSEG Nuclear, LLC by letter dated November 21, 2007 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML073600851); and (2) from the State of New Jersey Department of Environmental Protection (NJDEP) by letter dated November 21, 2007 (ADAMS Accession No. ML073600859). These comments are addressed below.

How often the collection is required: As necessary in order for the NRC to assess the adequacy of proposed seismic design bases and the design bases for other site hazards for nuclear power and test reactors constructed and licensed in accordance with 10 CFR parts 50 and 52 and the Atomic Energy Act of 1954, as amended. 4. Abstract: 10 CFR part 100, ``Reactor Site Criteria,'' establishes approval requirements for proposed sites for the purpose of constructing and operating stationary power and testing reactors pursuant to the provisions of 10 CFR parts 50 or 52. These reactors are required to be sited, designed, constructed and maintained to withstand geologic hazards, such as faulting, seismic hazards, and the maximum credible earthquake, to protect the health and safety of the public and the environment. Non-seismic siting criteria must also be evaluated. Non-seismic siting criteria include such factors as population density, the proximity of man-related hazards, and site atmospheric dispersion characteristics. NRC uses the information required by 10 CFR part 100 to evaluate whether natural phenomena and potential man-made hazards will be appropriately accounted for in the design of nuclear power and test reactors.
