Type of submission, new, revision, or extension: Revision. 2. The title of the information collection: ``NRC Forms 366, 366A, 366B, `Licensee Event Report''. 3. The form number if applicable: NRC Forms 366, 366A, 366B. 4. How often the collection is required: On occasion, as defined reactor events are reportable as they occur. 5. Who will be required or asked to report: Holders of operating licenses for commercial nuclear power plants. 6. An estimate of the number of annual responses: 400. 7. The estimated number of annual respondents: 104. 8. An estimate of the total number of hours needed annually to complete the requirement or request: 32,000 (25,600 reporting + 6,400 record keeping). This is estimated to be 80 hours for each of 400 reports annually. 9. An indication of whether Section 3507(d), Public Law 104-13 applies: Not applicable. 10. Abstract: With NRC Forms 366, 366A, and 366B, the NRC collects reports of the types of reactor events and problems that are believed to be significant and useful to the NRC in its efforts to identify and resolve possible threats to the public safety. These forms are designed to provide the information necessary for engineering studies of operational anomalies and trends and patterns analysis of abnormal occurrences. The same information is used for other analytic procedures that aid in identifying accident precursors. The Nuclear Regulatory Commission (NRC) is publishing for public comment a notice of receipt of a petition for rulemaking, dated January 25, 2007, which was filed with the Commission by Christine O. Gregoire, Governor of the State of Washington. The petition was docketed by the NRC on March 15, 2007, and has been assigned Docket No. PRM-71-13. The petitioner requests that the NRC adopt the use of global positioning satellite (GPS) tracking as a national requirement for mobile or portable uses of highly radioactive sources. The petitioner states that another alternative is for the Commission to grant states the flexibility to impose more stringent requirements than those required under current NRC regulations.

The NRC is preparing a submittal to OMB for review of continued approval of information collections under the provisions of the Paperwork Reduction Act of 1995 (44 U.S.C. Chapter 35). Information pertaining to the requirement to be submitted: 1. The title of the information collection: 10 CFR part 21, ``Reporting of Defects and Noncompliance.'' 2. Current OMB approval number: 3150-0035. 3. How often the collection is required: As necessary in order for NRC to meet its responsibilities to conduct a detailed review of defects in basic components of nuclear power plants or failures to comply that could create a substantial safety hazard. 4. Who is required or asked to report: All directors and responsible officers of firms and organizations building, operating, owning, or supplying basic components to NRC licensed facilities. 5. The number of annual respondents: 35. 6. The number of hours needed annually to complete the requirement or request: 7,574 hours (4,970 hours reporting and 2,604 hours recordkeeping). 7. Abstract: 10 CFR part 21 implements Section 206 of the Energy Reorganization Act of 1974 (42 U.S.C. 5846), as amended. Section 206 requires individual directors and responsible officers of firms constructing, owning, operating, or supplying the basic components of any facility or activity licensed under the Atomic Energy Act to report immediately to the Commission the discovery of defects in basic components or failures to comply that could create a substantial safety hazard (SSH). In addition to imposing obligations on the individual directors and responsible officers of NRC licensees, Section 206 also imposes obligations on the directors and responsible officers of non- licensees that construct facilities for, or supply basic components to, licensed facilities or activities. Any individual officer or director who knowingly fails to comply with the notification requirements is subject to civil penalties. Submit, by June 25, 2007, comments that address the following questions: 1. Is the proposed collection of information necessary for the NRC to properly perform its functions? How often the collection is required: Forms are used by shippers whenever radioactive waste is shipped. Quarterly or less frequent reporting is made to NRC depending on specific license conditions. 5. Who will be required or asked to report: All NRC-licensed low- level waste facilities. All generators, collectors, and processors of low-level waste intended for disposal at a low-level waste facility must complete the appropriate forms. 6. An estimate of the number of annual responses: NRC Form 540 and 540A: 13,400 licensees. NRC Form 541 and 541A: 13,400 licensees. NRC Form 542 and 542A: 756 licensees. 7. The estimated number of annual respondents: NRC Form 540 and 540A: 2,500 licensees. NRC Form 541 and 541A: 2,500 licensees. NRC Form 542 and 542A: 22 licensees. 8. An estimate of the total number of hours needed annually to complete the requirement or request: NRC Form 540 and 540A: 10,050 (.75 hours per response). NRC Form 541 and 541A: 44,341 (3.3 hours per response). NRC Form 542 and 542A: 567 (.75 hours per response). 9. An indication of whether Section 3507(d), Pub. L. 104-13 applies: Not applicable. 10. Abstract: NRC Forms 540, 541, and 542, together with their continuation pages, designated by the ``A'' suffix, provide a set of standardized forms to meet Department of Transportation (DOT), NRC, and State requirements. The forms were developed by NRC at the request of low-level waste industry groups. The forms provide uniformity and efficiency in the collection of information contained in manifests which are required to control transfers of low- level radioactive waste intended for disposal at a land disposal facility. NRC Form 540 contains information needed to satisfy DOT shipping paper requirements in 49 CFR Part 172 and the waste tracking requirements of NRC in 10 CFR Part 20. NRC Form 541 contains information needed by disposal site facilities to safely dispose of low-level waste and information to meet NRC and State requirements regulating these activities. NRC Form 542, completed by waste collectors or processors, contains information which facilitates tracking the identity of the waste generator. That tracking becomes more complicated when the waste forms, dimensions, or packagings are changed by the waste processor. Each container of waste shipped from a waste processor may contain waste from several different generators. The information provided on NRC Form 542 permits the States and Compacts to know the original generators of low-level waste, as authorized by the Low-Level Radioactive Waste Policy Amendments Act of 1985, so they can ensure that waste is disposed of in the appropriate Compact. The U.S. Nuclear Regulatory Commission (NRC) is publishing for public comment a notice of receipt of a petition for rulemaking, dated February 21, 2007, which was filed with the Commission by David Lochbaum, Director, Nuclear Safety Project, on behalf of the Union of Concerned Scientists. The petition was docketed by the NRC on February 23, 2007, and has been assigned Docket No. PRM-73-13. The petitioner requests that the NRC amend its regulations to close a loophole in current regulations that would enable persons who do not meet trustworthiness and reliability standards for unescorted access to protected areas of nuclear power plants the permission to enter protected areas with an unarmed escort. The petitioner believes that current regulations create a security vulnerability that could potentially compromise public health and safety.
