The Nuclear Regulatory Commission (NRC) is proposing to amend the size standards it uses to qualify an NRC licensee as a small entity under the Regulatory Flexibility Act and making the same change to its annual fee rule. NRC proposes to increase the receipts-based small business size standard from $5 million to $6.5 million to conform to the standard set by the Small Business Administration (SBA). This size standard reflects the most commonly used SBA size standard for the nonmanufacturing industries. SBA adjusted this standard on January 23, 2002 (67 FR 3041) and on December 6, 2005 (70 FR 72577) to account for inflation.

How often the collection is required: Reports of medical events, doses to an embryo/fetus or nursing child, or leaking sources are reportable on occurrence. A certifying entity desiring to be recognized by the NRC must submit a one-time request for recognition. 5. Who will be required or asked to report: Physicians and medical institutions holding an NRC license authorizing the administration of byproduct material or radiation therefrom to humans for medical use. 6. An estimate of the number of annual responses: 259,332 (53,346 responses from NRC Licenses + 1,862 recordkeepers and 197,235 responses from Agreement States + 6,889 recordkeepers) . 7. An estimate of the number of annual respondents: 8,751 (1,862 for NRC Licenses and 6,889 for Agreement States). 8. An estimate of the total number of hours needed annually to complete the requirement or request: 987,764 hours (251,200 for NRC Licenses and 736,564 for Agreement States). 9. Abstract: 10 CFR Part 35, ``Medical Use of Byproduct Material,'' contains NRC's requirements and provisions for the medical use of byproduct material and for issuance of specific licenses authorizing the medical use of this material. These requirements and provisions provide for the radiation safety of workers, the general public, patients, and human research subjects. 10 CFR Part 35 contains mandatory requirements that apply to NRC licensees authorized to administer byproduct material or radiation therefrom to humans for medical use. The information in the required reports and records is used by the NRC to ensure that public health and safety is protected, and that the possession and use of byproduct material is in compliance with the license and regulatory requirements. Who will be required or asked to report: Applicants for and holders of specific NRC licenses to receive title to, own, acquire, deliver, receive, possess, use, or initially transfer special nuclear material. 6. Privacy Act of 1974, as Amended; New Routine Use

The Nuclear Regulatory Commission (NRC) proposes to adopt a new routine use that will apply to all of its systems of records allowing disclosure to appropriate persons and entities for purposes of response and remedial efforts in the event that there has been a breach of data contained in the systems. This routine use will facilitate an effective response to a confirmed or suspected breach by permitting disclosure to those individuals affected by the breach, as well as to others who are in a position to assist in the NRC's response efforts, either by assisting in notification to affected individuals or by otherwise playing a role in preventing, minimizing, or remedying harm from the breach.
NUREG-1556, Volume 9, Revision 2, “Consolidated Guidance About Materials Licenses Program-Specific Guidance About Medical Use Licenses; Draft Guidance Document for Comment

The Nuclear Regulatory Commission (NRC) has amended its regulations to include jurisdiction over certain radium sources, accelerator-produced radioactive materials, and certain naturally occurring radioactive material, as required by the Energy Policy Act of 2005 (EPAct), which was signed into law on August 8, 2005. The EPAct expanded the Atomic Energy Act of 1954 definition of byproduct material to include these radioactive materials. Subsequently, these radioactive materials were placed under NRC's regulatory authority. NRC is revising its regulations to provide a regulatory framework that includes these newly added radioactive materials. See SECY-07-0062, ``Final Rule: Requirements for Expanded Definition of Byproduct Material,'' dated April 3, 2007, for information on that rulemaking. Two licensing guidance documents in the NUREG-1556 series are being revised along with these new regulations to provide guidance related to the new requirements: (1) NUREG-1556, Volume 13, Revision 1, ``Consolidated Guidance About Materials LicensesProgram-Specific Guidance About Commercial Radiopharmacy Licenses,'' and (2) NUREG-1556, Volume 9, Revision 2, ``Consolidated Guidance About Materials LicensesProgram Specific Guidance About Medical Use Licenses.'' A new volume in the NUREG-1556 series has also been developed to address the production of radioactive material using an accelerator. This NUREG is entitled NUREG-1556, Volume 21, ``Consolidated Guidance About Materials LicensesProgram-Specific Guidance About Possession Licenses for Production of Radioactive Material Using an Accelerator.'' This notice is announcing the availability of one of these three licensing guidance documents for public comment: NUREG-1556, Volume 9, Revision 2. The other two NUREGs were previously noticed for public comment: (1) NUREG-1556, Volume 13, Revision 1, on July 3, 2007 (72 FR 36526), and (2) NUREG-1556, Volume 21, on May 29, 2007 (72 FR 29555).
