The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) are proposing to amend the Federal Acquisition Regulation (FAR) to implement the Governmentwide Enterprise Software Licensing Program, also known as SmartBUY. This action is necessary to comply with Office of Management and Budget Memorandum M-04-08, Maximizing Use of SmartBuy and Avoiding Duplication of Agency Activities with the President's 24 E-Gov Initiatives, dated February 25, 2004. By leveraging the Federal Government Enterprise Software Licensing Program, the Government will achieve the maximum cost savings and favorable terms and conditions for acquiring software and software maintenance. This rule impacts contracting officers and other acquisition officials responsible for reviewing the terms, conditions, and prices for the acquisition of commercial software and software maintenance.

Each Federal agency is required by the Privacy Act of 1974 to publish a description of the systems of records it maintains containing personal information when a system is substantially revised, deleted, or created. In this notice, NASA provides the required information for a new system of records on users of NASA's Earth Observation System Data and Information System (EOSDIS). The EOSDIS is a system that processes, archives and distributes NASA's Earth science data, the bulk of which consists of satellite observations from EOS missions and data products derived from them. User information is gathered and maintained by this SOR to establish voluntary user accounts that enable distribution to the users, upon their request, data from Goddard Space Flight Center or one of the eight (8) Distributed Active Archive Centers (DAACs) across the United States.

NASA hereby gives notice of its intent to grant an exclusive license in the United States to practice the inventions described and claimed in U.S. Patent No. 6,745,942 B1 and U.S. Patent No. 7,017,812 B1 to QI3 Corporation, DBA Quest Integrated., having its principal place of business in Kent, Washington. The patent rights in this invention have been assigned to the United States of America as represented by the Administrator of the National Aeronautics and Space Administration. The prospective exclusive license will comply with the terms and conditions of 35 U.S.C. 209 and 37 CFR 404.7. NASA has not yet made a determination to grant the requested license and may deny the requested license even if no objections are submitted within the comment period.

Notice is hereby given that NASA is amending the standard appendices that it regularly publishes with the Agency's systems of records under the Privacy Act of 1974. In this notice, NASA (1) names an additional location, the NASA Shared Services Center, and updates Locations 16 and 17 for clarity in Appendix A where NASA systems of records may be maintained; (2) updates Office of Inspector General locations; (3) revises its previous routine use in Appendix B, the Agency's Standard Routine Uses to ensure the Agency's litigation routine use is in compliance with the Office of Management and Budget (OMB) Privacy Act GuidanceUpdate dated May 24, 1985; and (4) sets forth a new routine use in Appendix B, the Agency's Standard Routine Uses as required by OMB Memorandum 07-16 dated May 22, 2007 entitled ``Safeguarding Against and Responding to the Breach of Personally Identifiable Information.'' This new routine use enables the Agency to quickly and effectively respond to a breach of personally identifiable information through disclosure of information regarding the breach to those individuals affected by it, as well as to persons and entities in a position to cooperate, either by assisting in notification to affected individuals or playing a role in preventing or minimizing harms from the breach.
