Pursuant to the National Environmental Policy Act of 1969, as amended (NEPA) (42 U.S.C. 4321 et seq.), the Council on Environmental Quality Regulations for Implementing the Procedural Provisions of NEPA (40 CFR parts 1500-1508), and NASA policy and procedures (14 CFR part 1216 subpart 1216.3), NASA has prepared and issued an FPEIS for the MEP. The FPEIS addresses the potential environmental impacts associated with continuing the preparations for and implementing the program. The MEP would be a science-driven, technology-enabled effort to characterize and understand Mars using an exploration strategy which focuses on evidence of the presence of water. The Proposed Action, that is NASA's Preferred Alternative, addresses the preparation for and implementation of a coordinated series of robotic orbital, surface, and atmospheric missions to gather scientific data on Mars and its environments through 2020. Continued planning for missions to return Martian samples to Earth would be included. Some MEP missions could use radioisotope power systems (RPSs) for electricity, radioisotope heater units (RHUs) for thermal control, and small quantities of radioisotopes in science instruments for experiments and instrument calibration. Environmental impacts associated with specific missions would be addressed in subsequent environmental documentation, as appropriate. Missions launched from the United States would likely originate from either Cape Canaveral Air Force Station (CCAFS), Florida, or Vandenberg Air Force Base (VAFB), California.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed on an interim rule amending the Federal Acquisition Regulation (FAR) to implement Section 637 of Division H of the Consolidated Appropriations Act, 2005. Section 637 provides that no funds made available under the Consolidated Appropriations Act for fiscal year 2005, or under any other Act for fiscal year 2005 and each fiscal year thereafter, shall be expended for purchase of a product or service offered by Federal Prison Industries, Inc., unless the agency making the purchase determines that the offered product or service provides the best value to the buying agency, pursuant to Governmentwide procurement regulations issued pursuant to 41 U.S.C. 421(c)(1) that impose procedures, standards, and limitations of 10 U.S.C. 2410n.

Pursuant to the National Environmental Policy Act of 1969, as amended (NEPA) (42 U.S.C. 4321 et seq.), the Council on Environmental Quality Regulations for Implementing the Procedural Provisions of NEPA (40 CFR parts 1500-1508), and NASA's policy and procedures (14 CFR subpart 1216.3), NASA, in cooperation with the U.S. Department of Energy (DOE), intends to prepare a PEIS for the research and development activities associated with space nuclear fission reactors for electric power production in potential future NASA missions. The design and development effort would take advantage of relevant knowledge gained from earlier space nuclear reactor development efforts. NASA will hold public scoping meetings as part of the scoping process associated with the PEIS. If the proposed technology proves to be feasible for space applications, the first mission could be launched from the Cape Canaveral, Florida area. A separate mission-specific EIS would be prepared prior to launch of a space nuclear reactor powered mission.

Pursuant to the National Environmental Policy Act of 1969, as amended (NEPA), the Council on Environmental Quality Regulations for Implementing the Procedural Provisions of NEPA, and NASA's implementing regulations, the National Historic Preservation Act, as amended, NASA regulations for implementing Executive Order (EO) 11988, Floodplain Management, and EO 11990, Protection of Wetlands, and the NASA Environmental Justice Strategy (1994) for implementing EO 12898, Federal Actions to Address Environmental Justice in Minority Populations and Low-Income Populations; NASA has made a Finding of No Significant Impact (FONSI) for the three proposed alternatives including: the Proposed and Preferred Action (Alternative A, lease and operation of the NASA Shared Services Center (NSSC) at any of the following three sites: NASA Stennis Space Center, Mississippi, Aerospace Technology Park, Brook Park, Ohio, and Cummings Research Park, Huntsville, Alabama); Alternative B (Virtual Consolidation); and Alternative C (No Action). Accordingly, an environmental impact statement is not required.

NASA hereby gives notice that the Modine Manufacturing Company of Racine, Wisconsin, has applied for a partially exclusive license to practice the NASA inventions disclosed in (1) Patent No. U.S. 6,399,020 B1, entitled Aluminum-Silicon Alloy Having Improved Properties at Elevated Temperatures and Articles Cast Therefrom; (2) Patent No. U.S. 6,419,769 B1, entitled Aluminum-Silicon Alloy Having Improved Properties at Elevated Temperatures and Process for Producing Cast Articles Therefrom; and (3) PCT International Application No. PCT/ US03/10372 entitled, High Strength Aluminum Alloy for High Temperature Application filed April 3, 2003, for European Patent Organizations (EPO), Australia, Brazil, Canada, Japan, Columbia, India, Indonesia, Mexico, Philippines, and Vietnam. All three inventions are assigned to the United States of America as represented by the Administrator of the National Aeronautics and Space Administration. Written objections to the prospective grant of a license should be sent to Mr. Jerry L. Seemann, Chief Patent Counsel/LS01, Marshall Space Flight Center, Huntsville, AL 35812. NASA has not yet made a determination to grant the requested license and may deny the requested license even if no objections are submitted within the comment period.

The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council (Councils) have agreed on a final rule amending the Federal Acquisition Regulation (FAR) governing the procurement program for Service-Disabled Veteran-Owned Small Business Concerns (SDVOSB). The final rule retains the interim rule with changes. The final rule deletes commissary or exchange resale items from a list of actions excluded from the SDVOSB program and modifies protest procedures. The final rule also includes technical corrections adding service-disabled veteran-owned small, veteran-owned small, and HUBZone small business concerns to the list of socioeconomic programs, and makes changes to the Optional Form 347, Order for Supplies and Services, Standard Form 1447, Solicitation/Contract, and Standard Form 1449, Solicitation/Contract/Order for Commercial Items.
