Pursuant to statute (see below), the Commission monitors U.S. imports of fresh or chilled tomatoes and fresh or chilled peppers, other than chili peppers, for the purpose of expediting an investigation under certain U.S. safeguard laws, should an appropriate petition be filed. As part of that monitoring, the Commission has instituted investigations under section 332 of the Tariff Act of 1930 (19 U.S.C. 1332) for the purpose of compiling data on trade and the domestic industry. The Commission is in the process of preparing its data series for the period ending June 30, 2007, and is seeking input from interested members of the public. The Commission expects to make its data series available to the public in electronic form on the Commission's Web site in November 2007.

Since February 1991, the U.S. International Trade Commission (``Commission'') has issued an annual report on the status of its practice with respect to violations of its administrative protective orders (``APOs'') in investigations under Title VII of the Tariff Act of 1930 in response to a direction contained in the Conference Report to the Customs and Trade Act of 1990. Over time, the Commission has added to its report discussions of APO breaches in Commission proceedings other than under Title VII and violations of the Commission's rules including the rule on bracketing business proprietary information (``BPI'') (the ``24-hour rule''), 19 CFR 207.3(c). This notice provides a summary of investigations completed during calendar year 2006 of breaches in proceedings under Title VII. In 2006, there were no completed investigations of breaches in proceedings other than Title VII. The Commission intends that this report inform representatives of parties to Commission proceedings as to some specific types of APO breaches encountered by the Commission and the corresponding types of actions the Commission has taken.

The purpose of the proposed review investigation is to determine whether revocation of the existing antidumping duty order on imports of certain orange juice from Brazil is likely to lead to continuation or recurrence of material injury. On August 1, 2006, the Department of Commerce (``Commerce'') initiated and the U.S. International Trade Commission (``Commission'') instituted a five-year review concerning the antidumping duty order on hot-rolled steel products (``hot-rolled steel'') from the Netherlands. 71 FR 43443 and 71 FR 43521. However, on May 4, 2007, Commerce published notice in the Federal Register of the implementation of the findings of the World Trade Organization Panel under section 129 of the Uruguay Round Agreements Act and the revocation of the antidumping duty order concerning hot-rolled steel from the Netherlands effective April 23, 2007. 72 FR 25261. On June 27, 2007, Commerce published notice in the Federal Register of its final results of the sunset review of the antidumping duty order on hot-rolled steel from the Netherlands. 72 FR 35220. In that notice, Commerce determined that a finding of likelihood in a sunset review ``presumes the existence of an antidumping duty order currently in force, which is manifestly not the case here. Consequently, in the absence of an order currently in force, the Department cannot make a finding that it is likely that dumping will continue or recur if the order is revoked.'' 72 FR 35221. Commerce further stated that it was revoking the antidumping duty order on hot- rolled steel from the Netherlands effective November 29, 2006, the fifth anniversary of the date of publication of the order. Accordingly, pursuant to section 751(c) of the Tariff Act of 1930 (19 U.S.C. 1675(c)), the five-year review of the antidumping duty order concerning hot-rolled steel from the Netherlands (investigation No. 731-TA-903 (Review)) is terminated.

On July 2, 2007, the only scheduled witness for the hearing in investigation No. 332-485, Canned Peaches, Pears, and Fruit Mixtures: Conditions of Competition between U.S. and Principal Foreign Supplier Industries, scheduled for July 12, 2007, withdrew his request to appear. Therefore, the public hearing in this investigation has been canceled. Background: The Commission published notice of institution of the investigation and hearing in the Federal Register on February 13, 2007 (72 FR 6744). The notice asked that persons interested in appearing at the hearing file their requests by the close of June 28, 2007, and stated that the hearing would be canceled if no requests were received by that date. The complaint, as supplemented, alleges violations of section 337 in the importation into the United States, the sale for importation, and the sale within the United States after importation of certain buffer systems and components thereof used in container processing lines by reason of infringement of U.S. Patent No. 6,168,005. The complaint, as supplemented, further alleges that a domestic industry exists in the United States as required by subsection (a)(2) of section 337. The complainants request that the Commission institute an investigation and, after the investigation, issue a permanent general exclusion order and permanent cease and desist orders.
