SUPPLEMENTARY INFORMATION: The
Paperwork Reduction Act of 1995
(PRA), Public Law 104–13, Section 2,
109 Stat. 163 (1995) (codified as revised
at 44 U.S.C. 3501–3520), and its
implementing regulations, 5 CFR part
1320, require Federal agencies to issue
two notices seeking public comment on
information collection activities before
OMB may approve paperwork packages.
44 U.S.C. 3506, 3507; 5 CFR 1320.5,
1320.8(d)(1), 1320.12. On September 25,
2024, FTA published a 60-day notice
(89 FR 78429) in the Federal Register
soliciting comments on the ICR that the
agency was seeking OMB approval. FTA
received no comments after issuing this
60-day notice. Accordingly, DOT
announces that these information
collection activities have been reevaluated and certified under 5 CFR
1320.5(a) and forwarded to OMB for
review and approval pursuant to 5 CFR
1320.12(c).
Before OMB decides whether to
approve these proposed collections of
information, it must provide 30 days for
public comment. 44 U.S.C. 3507(b); 5
CFR 1320.12(d). Federal law requires
OMB to approve or disapprove
paperwork packages between 30 and 60
days after the 30-day notice is

Collection of Qualitative Feedback on
Agency Service Delivery.

Background: The information
collection activity will garner
qualitative customer and stakeholder
feedback in an efficient, timely manner,
in accordance with the Administration’s
commitment to improving service
delivery. By qualitative feedback we
mean information that provides useful
insights on perceptions and opinions,
but are not statistical surveys that yield
quantitative results that can be
generalized to the population of study.
This feedback will provide insights into
customer or stakeholder perceptions,
experiences and expectations, provide
an early warning of issues with service,
or focus attention on areas where
communication, training or changes in
operations might improve delivery of
products or services. These collections
will allow for ongoing, collaborative and
actionable communications between the
Federal Transit Administration and its
customers and stakeholders. It will also
allow feedback to contribute directly to
the improvement of program
management.
The solicitation of feedback will target
areas such as: timeliness,
appropriateness, accuracy of
information, courtesy, efficiency of
service delivery, and resolution of
issues with service delivery. Responses
will be assessed to plan and inform
efforts to improve or maintain the
quality of service offered to the public.
If this information is not collected, vital
feedback from customers and
stakeholders on the Agency’s services
will be unavailable.
The Agency will only submit a
collection for approval under this
generic clearance if it meets the
following conditions:
• The collections are voluntary;
• The collections are low-burden for
respondents (based on considerations of
total burden hours, total number of
respondents, or burden-hours per
respondent) and are low-cost for both

sampling frame, the sample design
(including stratification and clustering),
the precision requirements or power
calculations that justify the proposed
sample size, the expected response rate,
methods for assessing potential
nonresponse bias, the protocols for data
collection, and any testing procedures
that were or will be undertaken prior to
fielding the study. Depending on the
degree of influence the results are likely
to have, such collections may still be
eligible for sub mission for other generic
mechanisms that are designed to yield
quantitative results.

This notice announces the
calendar year 2025 drug and alcohol
random testing rates for specific
recipients of FTA financial assistance.
The minimum random drug testing rate
will remain at 50 percent, and the
random alcohol testing rate will remain
at 10 percent.

SUPPLEMENTARY INFORMATION: On
January 1, 1995, FTA required large
transit employers to begin drug and
alcohol testing of employees performing
safety-sensitive functions and to submit
annual reports by March 15 of each year
beginning in 1996, pursuant to drug and
alcohol regulations adopted by FTA at
49 CFR parts 653 and 654 in February
1994. The annual report includes the
number of employees who had a
verified positive test for the use of
prohibited drugs and the number of
employees who tested positive for the
misuse of alcohol during the reported
year. Small employers commenced the
required testing on January 1, 1996, and
began reporting the same information as
the large employers beginning March
15, 1997.
FTA updated the testing rules by
merging them into a new 49 CFR part
655, effective August 1, 2001 (66 FR
42002). The regulation maintained a
random testing rate for prohibited drugs
at 50 percent and the misuse of alcohol
at 10 percent. The Administrator may
lower the random testing rate to 25
percent if the violation rates drop below
1.0 percent for drug testing and 0.5

percent for alcohol testing for two
consecutive years. Accordingly, in 2007,
FTA reduced the random drug testing
rate from 50 percent to 25 percent (72
FR 1057). In 2018, however, FTA
returned the random drug testing rate to
50 percent for calendar year 2019 based
on verified industry data for calendar
year 2017, which showed that the rate
had exceeded 1 percent (83 FR 63812).
Pursuant to 49 CFR 655.45, the
Administrator’s decision to determine
the minimum annual percentage rate for
random drug and alcohol testing is
based, in part, on the reported positive
drug and alcohol violation rates for the
entire public transportation industry.
The information used for this
determination is drawn from the Drug
and Alcohol Management Information
System (MIS) reports required by 49
CFR 655.72. To ensure the reliability of
the data, the Administrator must
consider the quality and completeness
of the reported data, obtain additional
information or reports from employers,
and make appropriate modifications in
calculating the industry’s verified
positive results and violation rates.
For calendar year 2025, the
Administrator has determined that the
minimum random drug testing rate for
covered employees will remain at 50
percent based on a verified positive rate
for prohibited drug use of 1.23 percent
for calendar year 2023 and 1.090
percent for calendar year 2022. Further,
the Administrator has determined that
the minimum random alcohol testing
rate for the calendar year 2025 will
remain at 10 percent because the
violation rate was lower than 0.5
percent for the calendar years 2023 and
2022. The random alcohol violation
rates were 0.18 percent for 2023 and
0.18 for 2022.
