Affairs (VA), is announcing an
opportunity for public comment on the
proposed collection of certain
information by the agency. Under the
Paperwork Reduction Act (PRA) of
1995, Federal agencies are required to
publish notice in the Federal Register
concerning each proposed collection of
information, including each proposed
revision of a currently approved
collection, and allow 60 days for public
comment in response to the notice.
DATES: Comments must be received on
or before November 22, 2024.

SUPPLEMENTARY INFORMATION: Under the
PRA of 1995, Federal agencies must
obtain approval from the Office of
Management and Budget (OMB) for each
collection of information they conduct
or sponsor. This request for comment is
being made pursuant to Section
3506(c)(2)(A) of the PRA.
With respect to the following
collection of information, VBA invites
comments on: (1) whether the proposed
collection of information is necessary
for the proper performance of VBA’s
functions, including whether the
information will have practical utility;
(2) the accuracy of VBA’s estimate of the
burden of the proposed collection of
information; (3) ways to enhance the
quality, utility, and clarity of the
information to be collected; and (4)
ways to minimize the burden of the
collection of information on
respondents, including through the use
of automated collection techniques or
the use of other forms of information
technology.

ensure the compliance of IHLs and NCD
training institutions that are approved
by the VA to ensure that no more than
85% of students in any approved
program are students in receipt of

this information, VA might pay benefits
in error. Except as otherwise provided
by regulation, VA shall not approve an
enrollment in any course for an eligible
Veteran, not already enrolled, for any
period during which more than 85
percent of the students enrolled in the
course are having all or part of their
tuition, fees or other charges paid for
them by the educational institution or
by VA under title 38, U.S.C., or under
title 10, U.S.C. This is known as the 85/
15 Rule and is applicable to Institutions
of Higher Learning (IHLs) and NonCollege Degree postsecondary schools
(NCDs). The requirements apply to all
courses, not otherwise exempt, or
waived, offered by all educational
institutions, regardless of whether the
institution is degree-granting,
proprietary profit, proprietary nonprofit,
eleemosynary, public and/or taxsupported. These schools are required to
submit information necessary to
determine if their programs of training
are approved for the payment of VA
educational assistance. This specified
information is submitted either to VA or
to the State Approving Agency (SAA)
having jurisdiction over that school.
