VerDate Sep<11>2014 22:19 Sep 04, 2024 Jkt 262001 Abstract: The Acid Rain Program was established under Title IV of the 1990 Clean Air Act Amendments to address acid deposition by reducing emissions of sulfur dioxide (SO2) and nitrogen oxides (NOX). This information collection extension is necessary to continue implementation of the Acid Rain Program. It includes burden and costs associated with developing and modifying permits, complying with NOX permitting requirements, monitoring emissions, transferring allowances, participating in the annual allowance auctions, and participating in the program as an opt-in source. Form numbers: Agent Notice of Delegation #5900–172, Certificate of Representation #7610–1, General Account Form #7610–5, Allowance Transfer Form #7610–6, Retired Unit Exemption #7610–20, Allowance Deduction #7620–4, Acid Rain Permit Application #7610–16, Acid Rain NOX Compliance Plan #7610–28, Acid Rain NOX Averaging Plan #7610–29, New Unit Exemption #7610–19, Opt-In Permit Application #7610–26, Opt-In Utilization Report #7620–9. Respondents/affected entities: Electricity generating plants, industrial sources, and other persons. Respondents’ obligation to respond: Voluntary and mandatory (Clean Air Act sections 403, 407, 408, 410, 412, and 416). Estimated number of respondents: 1,195 (total); includes 1,127 sources and 68 non-source entities participating in allowance trading activities. Frequency of response: On occasion, quarterly, and annually. Total estimated burden: 1,760,519 hours (per year). Burden is defined at 5 CFR 1320.03(b). Total estimated cost: $286,211,330 (per year); includes $123,208,182 annualized capital or operation & maintenance costs. Changes in estimates: There is a decrease of 65,614 hours in the total estimated respondent burden compared with the ICR currently approved by OMB. The decrease is principally due to the switching to less burdensome monitoring methodologies for some affected sources and the number of retired sources. The other factors contributing to the decrease in burden are reductions in the estimated numbers of allowance transfers and auction bids submitted. At that time, EPA will issue another Federal Register notice to announce the submission of the ICR to OMB and the opportunity to submit additional comments to OMB. Abstract: EPA is renewing an ICR for the Cross-State Air Pollution Rule (CSAPR) trading programs to allow for continued implementation of the programs. The information collection requirements under six CSAPR trading programs and the Texas SO2 Trading Program are reflected in the existing ICR as most recently revised in 2021. Most affected sources under the CSAPR and Texas SO2 trading programs are also subject to the Acid Rain Program (ARP). The information collection requirements under the CSAPR and Texas SO2 trading programs, which consist primarily of requirements to monitor and report emissions data in accordance with 40 CFR part 75, substantially overlap and are fully integrated with ARP information collection requirements. The burden and costs of overlapping requirements are accounted for in the ARP ICR (OMB Control Number 2060– 0258). This ICR accounts for information collection burden and costs under the CSAPR and Texas SO2 trading programs that are incremental to the burden and costs already accounted for in the ARP ICR. All data received by EPA will be treated as public information. Respondents/affected entities: Industry respondents are stationary, fossil fuel-fired boilers and combustion turbines serving electricity generators subject to the CSAPR and Texas SO2 trading programs, as well as non-source entities voluntarily participating in allowance trading activities. Potential state respondents are states that can elect to submit state-determined allowance allocations for sources located in their states. Respondents’ obligation to respond: Industry respondents: voluntary and mandatory (sections 110(a) and 301(a) of the Clean Air Act). State respondents: voluntary. Estimated number of respondents: EPA estimates that there are 136 industry respondents, covering 450 units subject to one or more of the CSAPR trading programs for Texas SO2 trading program, and 27 potential state respondents. Frequency of response: on occasion, quarterly, and annually. Total estimated burden: 109,233 hours (per year). Burden is defined at 5 CFR 1320.03(b). Total estimated cost: $16,855,9766 (per year); includes $6,529,816 annualized capital or operation & maintenance costs. Changes in estimates: There is decrease of 4,279 hours in the total estimated respondent burden compared with the ICR currently approved by OMB. This decrease is due to a decrease in the number of units subject to the CSAPR trading programs for the Texas SO2 trading program due to retirements.
