As required by 25 CFR 293.4, all compacts and amendments are subject to review and approval by the Secretary. The Amendment authorizes Class III card games in addition to blackjack, adds definitions, regulatory standards for Class III card games, background investigations, and provisions for enforcement and dispute resolution. This proclamation does not affect title to the lands described above, nor does it affect any valid existing easements for public roads, highways, public utilities, railroads and pipelines, or any other valid easements or rights-of-way or reservations of record. 14 DEPARTMENT OF THE INTERIOR Indian Gaming; Approval by Operation of Law of Amendment to Class III Gaming Compact (Swinomish Indian Tribal Community and the State of Washington) AGENCY: within the 45 days, IGRA provides the Tribal-State compact is considered to have been approved by the Secretary, but only to the extent the compact is consistent with IGRA. See 25 U.S.C. 2710(d)(8)(C). The IGRA also requires the Secretary to publish in the Federal Register a notice of any approved Tribal-State compacts for the purpose of engaging in Class III gaming activities on Indian lands. See 25 U.S.C. 2710(d)(8)(D). The Department’s regulations at 25 CFR 293.4 require all compacts and amendments to be reviewed and approved by the Secretary prior to taking effect. The Secretary took no action on the Amendment to the compact between the Swinomish Indian Tribal Community and the State of Washington within the 45-day statutory review period. Therefore, the Amendment is considered to have been approved, but only to the extent it is consistent with IGRA.
