Under 5 U.S.C. 553(b)(B), the Coast Guard finds that there is good cause to waive the requirement to publish this final rule without providing notice and taking comments because there is insufficient time to do so between now and the time that the rule must be in effect to serve its intended purpose. Under 5 U.S.C. 553(d)(3), the Coast Guard also finds that good cause exists for making this rule effective less than 30 days after publication in the Federal Register. Delaying the effective date of this rule would be contrary to public interest because immediate action is needed to respond to the potential safety hazards associated with an air show. III. Legal Authority and Need for Rule The Coast Guard is issuing this rule under authority in 46 U.S.C. 70034. The Captain of the Port Maryland-National Capital Region (COTP) has determined that potential hazards associated with this August 22–25, 2024, air show will be a safety concern for anyone operating within certain waters of the North Atlantic Ocean adjacent to Ocean City, MD.
