III. Certification of the Hearing Record
and Agency Final Determination
Following the close of the hearing and
the post-hearing comment period, the
ALJ will certify the record to the
Assistant Secretary of Labor for
Occupational Safety and Health. The
record will consist of all of the written
comments, oral testimony, and
documentary evidence received during
the proceeding. The ALJ, however, will
not make or recommend any decisions
as to the content of the final standard.
Following certification of the record,
OSHA will review all the evidence
received into the record and will issue
the final rule based on the record as a
whole.

The Environmental Protection
Agency (EPA) is extending the comment
period for a proposed rule that
published July 3, 2024. The current
comment period for the proposed rule
was set to end on August 2, 2024. In
response to requests from commenters,
the EPA is extending the comment
period for the proposed action to
September 3, 2024.
DATES: The comment period for the
proposed rule published on July 3,
2024, at 89 FR 55140 is extended.
Comments must be received on or
before September 3, 2024.
