determined that this action is one of a
category of actions that do not
individually or cumulatively have a
significant effect on the human
environment. This rule involves a
temporary safety zone in the navigable
waters around the loading, staging,
transit, and display of fireworks near
Pier 50 in San Francisco Bay and on
Redwood Creek in Redwood City. It is
categorically excluded from further
review under paragraph L60(a) of
Appendix A, Table 1 of DHS Instruction
Manual 023–01–001–01, Rev. 1. A

supporting this determination is

(a) Location. The following area is a
safety zone: all navigable waters of San
Francisco Bay, from surface to bottom,
within a circle formed by connecting all
points 100 feet out from the fireworks
vessel during loading and staging at Pier
68 in San Francisco, CA as well as
transit and arrival to Redwood Creek,
Redwood City, CA. Between 9 p.m. and
10:20 p.m. on July 4, 2024, the safety
zone will expand to all navigable

waters, from surface to bottom, within a
circle formed by connection all points
850 feet out from the fireworks vessel in
approximate position 37°30′28.48″ N–
122°12′51.53″ W (NAD 83) or as
announced via Broadcast Notice to
Mariners.
(b) Definitions. As used in this
section, ‘‘designated representative’’
means a Coast Guard Patrol
Commander, including a Coast Guard
coxswain, petty officer, or other officer
operating a Coast Guard vessel, or a
Federal, State, or Local officer
designated by or assisting the Captain of
the Port San Francisco (COTP) in the
enforcement of the safety zone.
(c) Regulations. (1) Under the general
safety zone regulations in subpart C of
this part, you may not enter the safety
zone described in paragraph (a) of this
section unless authorized by the COTP
or the COTP’s designated representative.
(2) The safety zone is closed to all
vessel traffic, except as may be
permitted by the COTP or the COTP’s
designated representative.
(3) Vessel operators desiring to enter
or operate within the safety zone must
contact the COTP or the COTP’s
designated representative to obtain
permission to do so. Vessel operators
given permission to enter or operate in
the safety zone must comply with all
lawful orders or directions given to
them by the COTP or the COTP’s
designated representative. Persons and
vessels may request permission to enter
the safety zone on VHF–23A or through
the 24-hour Command Center at
telephone (415) 399–3547.
(d) Enforcement period. This section
will be enforced from 9 a.m. until 10:20
p.m. on July 4, 2024.
(e) Information broadcasts. The COTP
or the COTP’s designated representative
will notify the maritime community of
periods during which this zone will be
enforced, in accordance with 33 CFR
165.7.

8:30 p.m. until 10 p.m. on July 2, 2024,
or those same hours on July 3, 2024, in
the case of inclement weather on July 2,

The Coast Guard is
establishing a safety zone for
reoccurring firework displays on the
Mobile River in the vicinity of the
Arthur R. Outlaw Convention Center in
Mobile, AL. The safety zone will be
enforced only during the firework
displays. Establishment of this safety
zone is necessary to protect waterway
users and vessels from potential hazards
associated with these firework displays.
This rulemaking will prohibit entry into
the safety zone during the firework
displays unless authorized by the
Captain of the Port Mobile (COTP), or a
COTP designated representative.
DATES: This rule is effective July 31,
2024.

II. Background Information and
Regulatory History
The Coast Guard receives numerous
event applications for firework displays
on the Mobile River, to be held in the
vicinity of the Arthur R. Outlaw
Convention Center in Mobile, AL. These
displays are sponsored by multiple
organizations and held sporadically
throughout the year. Based on previous
years, approximately five to ten displays
are expected to be held on any given
year. The purpose of this rule is to
ensure the safety of vessels,
participants, and waterways users
within a 100-yard radius of the
fireworks barge immediately before,
during, and after scheduled events. In
response, on March 14, 2024, the Coast
Guard published a notice of proposed
rulemaking (NPRM) titled ‘‘Safety Zone;
Reoccurring Firework Displays Near
Convention Center on the Mobile River,
Mobile, AL’’ (89 FR 18583). There we
stated why we issued the NPRM and
invited comments on our proposed
regulatory action related to these
fireworks displays. During the comment
period that ended April 15, 2024, we
received one comment which favored
the establishment of the safety zone.
The final rule is unchanged from that
which we proposed in the NPRM.
III. Legal Authority and Need for Rule
The Coast Guard is issuing this rule
under authority in 46 U.S.C. 70034. The
Captain of the Port Sector Mobile
Region (COTP) has determined that
potential hazards associated with the
fireworks to be used in these
reoccurring firework displays will be a
safety concern for anyone within a 100yard radius of the barge. The purpose of
this rule is to ensure safety of vessels
and the navigable waters in the safety
zone before, during, and after the
scheduled event.
IV. Discussion of Comments, Changes,
and the Rule
As noted above, we received one
comment on our NPRM published
March 14, 2024, that was in favor of the
rulemaking. There are no changes in the
regulatory text of this rule from the
proposed rule in the NPRM.
This rule establishes a reoccurring
safety zone covering all navigable
waters within a 100-yard radius of
barge-based firework displays on the
Mobile River. The safety zone will be
subject to enforcement for
approximately one hour when a bargebased fireworks display is scheduled to

100 yards of the fireworks barges
immediately before, during, and
immediately after firework displays.
The duration of the zone is intended to
ensure the safety of vessels and these
navigable waters before, during, and
after the fireworks display. No vessel or
person will be permitted to enter the
safety zone without obtaining
permission from the COTP, or a COTP
designated representative.
V. Regulatory Analyses
We developed this rule after
considering numerous statutes and
Executive orders related to rulemaking.
Below we summarize our analyses
based on a number of these statutes and
Executive orders, and we discuss First
Amendment rights of protestors.
A. Regulatory Planning and Review
Executive Orders 12866 and 13563
direct agencies to assess the costs and
benefits of available regulatory
alternatives and, if regulation is
necessary, to select regulatory
approaches that maximize net benefits.
This rule has not been designated a
‘‘significant regulatory action,’’ under
section 3(f) of Executive Order 12866, as
amended by Executive Order 14094
(Modernizing Regulatory Review).
Accordingly, this rule has not been
reviewed by the Office of Management
and Budget (OMB).
This regulatory action determination
is based on the size, location, duration,
and time of day of the safety zone.
Vessel traffic may be able to safely
transit around this safety zone which w
impact a small, designated area of the
Mobile River for less than 1 hour during
the evening for the duration of the
firework display.
B. Impact on Small Entities
The Regulatory Flexibility Act of
1980, 5 U.S.C. 601–612, as amended,
requires Federal agencies to consider
the potential impact of regulations on
small entities during rulemaking. The
term ‘‘small entities’’ comprises small
businesses, not-for-profit organizations
that are independently owned and
operated and are not dominant in their
fields, and governmental jurisdictions
with populations of less than 50,000.
The Coast Guard received no comments
from the Small Business Administration
on this rulemaking. The Coast Guard
certifies under 5 U.S.C. 605(b) that this
rule will not have a significant
economic impact on a substantial
number of small entities.
While some owners or operators of
vessels intending to transit the safety
zone may be small entities, for the
reasons stated in section V.A above, this
