Consistent with the Medicare Conditions of Participation (COPs) for home health agencies (HHAs) and the decision of the US Court of Appeals 2nd Circuit decision in Lutwin v. Thompson, HHAs must provide the HHCCN to a beneficiary whenever they reduce or terminate that beneficiary’s home health services due to physician/provider orders or limitation of the HHA in providing the specific service.
