(ii) For-profit Recipients (excluding
Insured CDFIs and State-Insured Credit
Unions) must submit to the CDFI Fund
financial statements audited in

Public Accountants by a time set forth
in the applicable NOFA or Assistance
Agreement.
(iii) Regulated financial institutions
(Insured Depository Institutions,
Depository Institution Holding

(2) Annual report. (i) The Recipient
shall submit a performance and
financial report that shall be specified in
the Assistance Agreement (annual
report). The annual report consists of
several components which may include,
but are not limited to, a report on
performance goals and measures,
explanation of any Recipient
noncompliance, and such other
information as may be required by the
CDFI Fund. The annual report
components shall be specified and
described in the Assistance Agreement.
(ii) The CDFI Fund will use the
annual report to collect data to assess
the Recipient’s compliance with its
performance goals and the impact of the
CMF and the CDFI industry.
(iii) The Recipient is responsible for
the timely and complete submission of
the annual report, even if all or a
portion of the documents actually are
completed by another entity. If such
other entities are required to provide
information for the annual report, or
such other documentation that the CDFI
Fund might require, the Recipient is
responsible for ensuring that the
information is submitted timely and
complete. The CDFI Fund reserves the
right to contact such other entities and
require that additional information and
documentation be provided.
(iv) The CDFI Fund’s review of the
compliance of an Insured CDFI, a
Depository Institution Holding
Company or a State-Insured Credit
Union with the terms and conditions of
its Assistance Agreement may also
include information from the
Appropriate Federal Banking Agency or
Appropriate State Agency, as the case
may be.

§ 1807.903 Compliance with government
requirements.
In carrying out its responsibilities
pursuant to an Assistance Agreement,
the Recipient shall comply with all
applicable Federal, State, and local
laws, regulations, and ordinances,
Uniform Administrative Requirements,
and Executive Orders. Furthermore,
Recipients must comply with the CDFI
Fund’s environmental quality
regulations (12 CFR part 1815), as well
as all other Federal environmental
requirements applicable to Federal
awards.

Lobbying restrictions.
No CMF Award may be expended by
a Recipient to pay any person to
influence or attempt to influence any
agency, elected official, officer or
employee of a State or local government
in connection with the making, award,
extension, continuation, renewal,
amendment, or modification of any
State or local government contract,
grant, loan or cooperative agreement as
such terms are defined in 31 U.S.C.
1352.

Criminal provisions.
The criminal provisions of 18 U.S.C.
657 regarding embezzlement or
misappropriation of funds are
applicable to all Recipients and
insiders.

CDFI Fund deemed not to
The CDFI Fund shall not be deemed
to control a Recipient by reason of any
CMF Award provided under the Act for
the purpose of any applicable law.
§ 1807.907
Limitation on liability.
The liability of the CDFI Fund and the
United States Government arising out of
any CMF Award shall be limited to the
amount of the CMF Award. The CDFI
Fund shall be exempt from any
assessments and other liabilities that
may be imposed on controlling or
principal shareholders by any Federal
law or the law of any State. Nothing in
this section shall affect the application
of any Federal tax law.

Fraud, waste and abuse.
Any person who becomes aware of
the existence or apparent existence of
fraud, waste or abuse of a CMF Award
should report such incidences to the
Office of Inspector General of the U.S.
Department of the Treasury.

AGENCY:
ACTION:
The Coast Guard will enforce
various safety zones for maritime events
in the Captain of the Port Northern
Great Lakes. Enforcement of these safety
zones is necessary to protect the safety
of life and property on the navigable
waters immediately prior to, during, and
immediately after this event. During the
period, the Coast Guard will enforce
restrictions upon, and control
movement of, vessels in a specified area
immediately prior to, during, and
immediately after events. During each
enforcement period, vessels must stay
out of the established safety zone and
may only enter with permission from
the designated representative of the
Captain of the Port Northern Great
Lakes.
SUMMARY:
The regulations listed in 33 CFR
165.918 will be enforced for the safety
zones identified in the SUPPLEMENTARY
INFORMATION section below for the dates
and times specified.

p.m. on July 4, 2024. The zone includes
all U.S. navigable waters of the St.
Marys River within an approximate
1000-foot radius around the eastern
portion of the U.S. Army Corp of
Engineers Soo Locks North East Pier,
centered in position: 46°30′19.66″ N,
084°20′31.61″ W. This notice also
includes alternative rain dates one day
after any affected event.
(6) Boyne City Fourth of July
Celebration Fireworks (Boyne City, MI)
from 9:30 p.m. through 11 p.m. on July
4, 2024. The zone includes all U.S.
navigable waters of Lake Charlevoix, in
the vicinity of Veterans Park, within the
arc of a circle with an approximate
1400-foot radius from the fireworks
launch site located in position 45°13′30″
N, 085°01′40″ W. This notice also
includes alternative rain dates one day
after any affected event.
(7) Mackinac Island Fourth of July
Celebration Fireworks (Mackinac Island,
MI) from 9:30 p.m. through 11 p.m. on
July 4, 2024. The zone includes all U.S.
navigable waters of Lake Huron within
an approximate 750-foot radius of the
fireworks launch site, centered
approximately 1000 yards west of
Round Island Passage Light, at position
45°50′34.92″ N, 084°37′38.16″ W. This
notice also includes alternative rain
dates one day after any affected event.
(8) Harbor Springs Fourth of July
Celebration Fireworks (Harbor Springs,
MI) from 10 p.m. through 11:30 p.m. on
July 4, 2024. The zone includes all U.S.

a circle with an approximate 1200-foot
radius from the fireworks launch site

Petoskey Harbor, in the vicinity of Bay
Front Park, within the arc of a circle
with an approximate 1200-foot radius
from the fireworks launch site located in
position 45°22′40″ N, 084°57′30″ W.
(12) National Cherry Festival Finale
Fireworks (Traverse City, MI) from 10
p.m. through 10:30 p.m. on July 6, 2024.
The zone includes all U.S. navigable
waters of the West Arm of Grand
Traverse Bay within the arc of a circle
with an approximate 1200-foot radius
from the fireworks launch site located
on a barge in position 44°46′12″ N,
085°37′06″ W.
Under the provisions of 33 CFR
165.918, entry into, transiting, or
anchoring within the safety zones
during an enforcement period is
prohibited unless authorized by the
Captain of the Port Northern Great Lakes
or his designated representative. Those
seeking permission to enter the safety
zone may request permission from the
Captain of Port Northern Great Lakes via
channel 16, VHF–FM. Vessels and
persons granted permission to enter the
safety zone shall obey the directions of
the Captain of Port Northern Great Lakes
or his designated representatives. While
within the safety zone, all vessels shall
operate at the minimum speed
necessary to maintain a safe course.
This notice of enforcement is issued
under authority of 33 CFR 165.918 and
5 U.S.C. 552 (a). In addition to this
notice of enforcement in the Federal
Register, the Coast Guard will provide
the maritime community with advance
notification of this enforcement period
via Broadcast Notice to Mariners or
Local Notice to Mariners. If the Captain
of the Port Sault Sainte Marie
determines that the safety zone need not
be enforced for the full duration stated
in this notice he or she may suspend
such enforcement and notify the public
of the suspension via Broadcast Notice
to Mariners and grant general

The Coast Guard will enforce
safety zone for the Town of Swansboro
Fireworks Display—July 4 Celebration
display on July 3, 2024, to provide for
the safety of life on navigable waterways
of the Atlantic Intracoastal Waterway
during this event. Our regulation for
marine events within the Fifth Coast
Guard District identifies the regulated
area for this event in Swansboro, NC.
During the enforcement period, entry of
vessels or persons into this safety zone
is prohibited unless specifically
authorized by the Captain of the Port
(COTP) North Carolina or any Official
Patrol displaying a Coast Guard ensign.
DATES: The regulation for the event
listed in item 15, in Table 4 to
paragraph (h)(4) to 33 CFR 165.506, will
be enforced from 9 p.m. until 9:45 p.m.
on July 3, 2024.
