under the Privacy Act of 1974, as
amended, 5 U.S.C. 552a.
The Request for Individual Access to
Records Protected under the Privacy Act
form is used by individuals seeking
access to their records under the Privacy
Act and any information pertaining to
them that are maintained in Treasury’s
systems of records. The Privacy Act
provides that ‘‘the parent of any minor,
or the legal guardian of any individual
who has been declared to be
incompetent due to physical or mental
incapacity or age by a court of
competent jurisdiction, may act on
behalf of the individual.’’ Therefore, this
form may also be used by a parent or
legal guardian.

Abstract: VA Form 21P–8416b is used
to gather information about certain
expenses related to securing
compensation based on personal injury
or death. The form is used by claimants
for VA income-based benefits to
determine the amount of countable
income. Without this information, the
VA would be unable to properly
determine entitlement to income-based
benefits and the rate payable.
An agency may not conduct or
sponsor, and a person is not required to
respond to a collection of information
unless it displays a currently valid OMB
control number. The Federal Register

soliciting comments on this collection

primarily used to gather information
that is necessary to determine whether
a valid common law marriage was
established. The form is used by persons
claiming to be common law widows/
widowers of deceased veterans and by
veterans and their claimed common law
spouses. Benefits cannot be authorized
unless a valid marriage is established.
No changes have been made to this
form. The respondent burden has
decreased due to the estimated number
of receivables averaged over the past
year.
