On September 20, 2023, Commission staff issued a notice of intent to prepare a draft and final Environmental Assessment (EA) to evaluate the effects of relicensing the Broadwater Project. The notice of intent included an anticipated schedule for issuing the draft and final EA. By this notice, Commission staff is updating the procedural schedule for completing the draft and final EAs. Energy Transfer LP also requests that the Commission clarify its test for determining whether facilities are non-jurisdictional gathering facilities under the Natural Gas Act, as more fully explained in the Petition. Any person desiring to intervene or to protest this filing must file in accordance with Rules 211 and 214 of the Commission’s Rules of Practice and Procedure (18 CFR 385.211, 385.214).
