Third, on or around July 27, 2020, the
State of Colorado made a SIP
submission addressing the 2015 Ozone
Marginal Area Certification (Base year
inventory and Emission Statement). The
proposed consent decree would require
EPA to sign a notice of final rulemaking
by December 15, 2025.
Fourth, the State of Utah made 11 SIP
submissions regarding nonattainment
planning requirements such as BACT,
BACM, control measures, as well as
redesignation requests and maintenance
plans, for the Salt Lake City and Provo
PM2.5 Moderate and Serious
nonattainment areas.1 The proposed
consent decree would require EPA to
sign final notices of rulemaking on these
SIP submissions, as well as on the
following SIP submission, by December
15, 2025: Utah’s SIP revision addressing
Interstate Transport for 2008 Ozone—
Prong 2 SIP, submitted on or around
January 29, 2020.
In accordance with section 113(g) of
the CAA, for a period of 30 days
following the date of publication of this
document, the Agency will accept
written comments relating to the
proposed consent decree. EPA or the
Department of Justice may withdraw or
withhold consent to the proposed
