Operation
The license for the Alice Falls
Hydroelectric Project No. 5867 was
issued for a period ending September
30, 2023.
Section 15(a)(1) of the FPA, 16 U.S.C.
808(a)(1), requires the Commission, at
the expiration of a license term, to issue
from year-to-year an annual license to
the then licensee(s) under the terms and
conditions of the prior license until a
new license is issued, or the project is
otherwise disposed of as provided in
section 15 or any other applicable
section of the FPA. If the project’s prior
license waived the applicability of
section 15 of the FPA, then, based on
section 9(b) of the Administrative
Procedure Act, 5 U.S.C. 558(c), and as
set forth at 18 CFR 16.21(a), if the
licensee of such project has filed an
application for a subsequent license, the
licensee may continue to operate the
project in accordance with the terms
and conditions of the license after the
minor or minor part license expires,
until the Commission acts on its
application. If the licensee of such a
project has not filed an application for
a subsequent license, then it may be
required, pursuant to 18 CFR 16.21(b),
to continue project operations until the
Commission issues someone else a
license for the project or otherwise
orders disposition of the project.

Environmental Assessment for the
Proposed System Alignment Program
Project
The staff of the Federal Energy
Regulatory Commission (FERC or
Commission) has prepared an
environmental assessment (EA) for the
System Alignment Program Project
(Project), proposed by East Tennessee
Natural Gas, LLC (East Tennessee) in the
above-referenced docket. East Tennessee
requests authorization to construct
approximately 16.1 miles of 24-inchdiameter pipeline loop (Boyds Creek
Loop) adjacent to its existing 16-inchdiameter pipeline (Line 3300–1) in
Knox and Sevier Counties, Tennessee; a
new 6,000-horsepower compressor
station (the Talbott Compressor Station)
in Jefferson County, Tennessee; a new
19,000-horsepower compressor station
in Rockingham County, North Carolina
(the Draper Compressor Station); and
ancillary facilities in Knox County and
Sevier Counties, Tennessee and
Washington and Wythe Counties,
Virginia. East Tennessee would also
replace approximately 6.4 miles of 8inch-diameter pipeline with new 24inch-diameter pipeline within its
existing right-of-way in Washington
County, Virginia and complete a
hydrotest of an approximately 1.2-milelong segment of existing pipeline in
Patrick County, Virginia.
The EA assesses the potential
environmental effects of the
construction and operation of the
Project in accordance with the
requirements of the National
Environmental Policy Act (NEPA). The
FERC staff concludes that approval of
the Project, with appropriate mitigating
measures, would not constitute a major
federal action significantly affecting the
quality of the human environment.
The Commission mailed a copy of this
Notice of Availability of the EA to
federal, state, and local government
representatives and agencies; elected
officials; non-governmental
organizations, environmental, and
